Amendment to lengthen the allowed time period for preliminary plats to 2 years, to allow for 6 months extensions upon Planning Board review and to make this retroactive to July 20, 1988; and b. Amendment to add an exemption to the definition of subdivision to allow for recordation of certain olcl surveys. ITEM #5: Questions and comments regarding the February 18th meeting with the Orange County Planning Board to discuss our Thoroughfare Plans. ITEM #6: Discussion of the upcoming T.I.P. request. February 11th at 7:00 - PUBLIC HEARING on Dr. Joseph Gatewood's property; and b. February 18th at 7:00 - JOINT MEETING with Orange County Planning Board to discuss the Thoroughfare Plan - will be held at the Orange County Planning Conference Room on Revere Rd. AN ORDINANCE AMENDING THE TOWN OF HILLSBOROUGH'S SUBDIVISION REGULATIONS BY CHANGING THE TIME PERIOD FOR PRELIMINARY PLATS THE BOARD OF COMMISSIONERS OF THE TOWN OF HILLSBOROUGH ORDAINS: Section 1: The Hillsborough Subdivision Regulations are hereby amended by adding a second paragraph to Section 3:D.1 to read as follows: Approval shall be valid for two (2) years. The Planning .Board may extend for a period up -to six months from 'the date when a preliminary subdivision plan would. otherwise expire it it concludes that: the preliipinary plan has not yet expired, the property owner or agent has proceeded with due diligence and in good faith, and conditions have not changed so substantially as to warrant a new application. Successive extensions may be granted for periods up to six months upon the same findings. This paragraph shall be applicable to all preliminary plans approved since Julv 20, 1988_ and to amend the Subdivision Regulations by deleting the last sentence of the first paragraph of Section 3.D.1 "Approval shall be valid for one year." Section 2: All ordinances in conflict with this ordinance are hereby repealed. Section 3: This ordinance shall become effective upon adoption. 00000000000000000000000000000000000000000000000000000000000000000000000000c AN ORDINANCE AMENDING THE TOWN OF HILLSBOROUGH SUBDIVISION REGULATIONS TO EXEMPT CERTAIN PLAT RECORDATIONS FROM THE TOWN'S SUBDIVISION REGULATIONS THE BOARD OF COMMISSIONERS OF THE TOWN OF HILLSBOROUGH ORDAINS: 'Section 1. The Hillsborough Subdivision Regulations are hereby amended by adding a new subsection (6) to the definition of the word "Subdivision" found in Section 2 to read as follows: (6) The recordation of a plat depicting lots previously shown on an unrecorded plat, which lots and unrecorded plat are specifically referenced in a deed recorded prior to March 13, 1978. The intent of this sub -part is to exempt property conveyed prior to March 13, 1978 in reference to an unrecorded subdivision plat. .Section 2. All ordinances in conflict with this ordinance are hereby repealed. .Section 3. This ordinance shall become effective upon adoption. MEMBERS Richard Simpson, Chesire Cole, Jim Culbreth (alternate) ABSENT: OTHERS Jerry Stone, Wesley Hyatt, Blake Dickinson, Sim Efland, Betsy PRESENT: Tilley, Janet Rigsbee, Joff Coe Crowther called the meeting to order at 6:35 PM. ITEM #1: Olson moved to approve the Hearing and the November 1, Tilley seconded the motion. VOTE: Unanimous. minutes of the October 23, 1990 Public 1990 and December 6, 1990 meetings. ITEM #2: Rigsbee asked to add Item #13, Distribution of the Annual Planning Activity Report, to the agenda and the members agreed. Sim Efland said he owned property in West Hillsborough and said he had heard about the possiblity of a road going through his property. He said he would like to know where it was going and if it would allow him access to his property. Crowther said the subject could be put on the agenda for future discussion about transportation issues but could be added to the agenda as Item # 5-C for information purposes and the members agreed. ITEM #3: Crowther had no comments. ITEM #4: Rigsbee summarized the Jerry Stone situation noting it had been discussed at the November Town Board meeting and had been sent back to the Planning Board for further review. She said Michael Brough, the Town Attorney, had submitted a text amendment to the Subdivision Regulations (agenda) which would allow Stone's subdivision plat to be recorded. She read the proposed amendment and noted it would be difficult to find out how many other lots in Town were in the same situation. Olson asked if the term recorded was defined and Rigsbee said yes. Olson asked what if lots subject to this amendment did not conform to the Subdivision Regulations and Rigsbee said non -conforming lots with contiguous frontage and the same owner are considered one lot for zoning purposes. Olson said she had spoken with Orange County Register of Deeds Betty June Hayes. Hayes had she was generally in favor of the change and offered to speak to the Board if necessary. Olson asked if the non -conforming lots would be grandfathered and Rigsbee said no, but it was possible to build on an existing non -conforming lot. Stone said at the Town Board meeting he had pointed out case law confirmed that a deed that refers to a plat incorporates that pla-F and that a plat description overrides a metes and bounds PLANNING BOARD February 7, 1991 MEMBERS Bill Crowther (Chair), Cheshire Cole, Wendy Olson (alt.), Margaret PRESENT: Moore, Sam Jones, Wayne Tilley MEMBERS Ken Chavious, Leif Deetjen, Stephen Jones, Ida Louise Evans, ABSENT: Jim Culbreth (alt.) OTHERS: Wesley Hyatt, Blake Dickinson, Janet Rigsbee The meeting was called to order at 6:4OPM. ITEM #1: Moore moved approval of the January 3, 1991 minutes. Jones seconded. Unanimous. ITEM #2: Rigsbee asked the words"and recommendations" be added to Item #4 and the members agreed. ITEM #3: There were no Chair comments. ITEM #4a: The amendment to the Subdivision Regulations to lengthen the allowed time period for preliminary plats to 2 years, to allow for 6 months extensions upon Planning Board review and to make this amendment retroactive to July 20, 1998 was briefly reviewed by Rigsbee. Tilley moved to recommend to the Town Board the amendment be adopted. Moore seconded. Unanimous. ITEM #4b: The amendment to the Subdivision Regulations to add an exemption to the definition of subdivision to allow for recordation of certain old surveys was explained by Rigsbee. She reviewed the comments of the Register of Deeds, Betty June Hayes, from the public hearing. Moore asked if this would result in more non -conforming lots and Rigsbee said yes as the old surveys didn't follow today's standards. Olson said she talked with Betty June Hayes and she is satisfied we would be making things easier without getting into trouble. Olson movedto recommend to the Town Board the amendment be adopted. Simpson seconded. Unanimous. ITEM #5: Rigsbee said on February 18th the Orange County and Hillsborough Planning Boards will get together to discuss their thoroughfare plans. Crowther said our Town Board has authorized us to do so. Crowther said items we could discuss may be:if Orange County has any requests to add to our T.I.P. request, maybe mass transit;and possibly the revision of our thoroughfare plan to accomodate Orange County's concerns although this may take 2 to 3 years but the groundwork could be laid now. Olson said she is a member of the Transportation Advisory Subcom- mittee to the Orange County Planning Board from its inception. The 1st phase of mainly classifying the county road system is complete and now the 2nd phase is underway. Page 2 PB 2/7/91 ITEM #6: The past requests and action taken regarding the T.I.P. requests was reviewed by Rigsbee (agenda). Crowther said it was a pretty dismal record of work done by NCDOT. Simpson said it is mostly politics which determines which roads get fixed. Olson said it depends on how much you rattle your cage if work gets done. Jones asked about improving McAdams Rd. and Rigsbee said it is a town road and improvements would have to be done by the town. Cole said a traffic light has been needed at Faucette Mill Rd. for 15 years. Olson said for the record the NCDOT said when Eno Mountain Rd. bridge is finished there will be a bike lane on both sides of the road. The members thought traffic especially truck traffic was too heavy downtown. They suggested re-routing truck traffic and synchronizing the traffic signals as possible helps. ITEM #7: Rigsbee said the Downtown Parking Committee filed their final report and is no longer meeting. The town has established a small Town Parking Committee of Chief Biggs, Commissioner Rose, L.D. Wagoner and herself. The purpose of the committee is to meet and put into action the recommendations of the Downtown Parking Committee. Simpson said parking on King St. by the county offices and the post office is very congested. Olson said better signage is needed for the town parking lot. ITEM #8: The Planning Boardrecommendation to place the France/Staley land in the public domain was addressed by Rigsbee. She said the town board authorized her to investigate price and financial sources and she has been doing that. She found the 128 acres would sell from 1.5 to 2.5 millon dollars. The land in the floodplain of about 58 acres may sell cheaper but there is no figure on that. Crowther said he, Margaret Nygard, and Don Cox walked the land. Rigsbee said getting a large sum funded is dismal and Olson said a park that large would be more in the county's park plan. Rigsbee said the county was not interested in obtaining the land. Rigsbee said she and Mr. Whitaker figured if a bond referendum was passed that 14 cents per $100. would be added to tax bills considerably raising our tax rate. Rigsbee said she would report to the town board in March. ITEM #9: The new pocket garden at Murray St. was explained by Rigsbee who said the town board authorized the use of the z acre as a garden and formed.the Murray St. Pocket Garden Committee who is beginning work on the project. Olson suggested it would be good for the town to have an umbrella park committee which would be responsible for all of the other park committees. ITEM #10: Rigsbee begged the members to call her if they cannot attend a meeting. It has been very difficult contacting members and very difficult establishing a quorum. Simpson said its very important to attend meetings and.members should be responsible and attend. ITEM #11: The members were reminded of two meetings in February. The meeting was adjourned at 7:45 PM.
