TOWN BOARD AND THE PLANNING BOARD

ITEM #1: Rezoning request of Jack Payne to rezone 15,000 sq. ft.
(second lot from the end on the south side of Rencher
Street) from R-10 (Residential) to MHP (Mobile Home
Park)(Tax Map 4.10.A.7).
ITEM #2: Zoning Ordinance Text Amendments:
a. To add Section 16 "Vested Rights" in which approved
site specific development plans have a vested right to
undertake and complete the development and use of
property.
b. To add subsection (m) to Section 4.9, to amend Section
5.18.3 (a), to add subsection (i) to Section 5.19.1,
to add subsection (k) to Section 5.20.1, the above
changes making the Zoning Ordinance consistent with
requirements of Section 16.
C. To amend Section 3.8.(b) to provide for .notice and
public hearing for Special Exception Permits as
required by Section 16.
d. To add subsection 4.4.11 and to amend Section 4.8(a)
to limit validity of Conditional Use Permits.
e. To add subsection (c) to Section 5.21 to limit
validity of approval of a site plan.
f. To amend Section 3.4, Permitted Use Table, to allow
limited retail sales in GI (General Industrial)
Districts.
Substantive changes in the proposed amendments may be made by
the Town Board following Public Hearing.
It is essential to have a quorum present at this Public

ABSENT: Jim Culbreth.

PRESENT: Ervin Thompson, Juddie Chavis, Margaret Clark, Dave Clark,
Martha Nichols, Bonnie Davis, Velma Terrell, Patricia Clayton,
Evelyn Poole -Kober, Robert Cearal, Evelyn Lloyd, Wesley Hyatt,
Blake Dickinson, Michael Brough, Joff Coe, and Margaret Hauth.
Mayor Johnson called the meeting to order at 7:05 p.m. and turned the chair
over to Sam Jones.
Jones noted a change in agenda order due to the need for the Town Attorney
to leave early.
ITEM #2: The Zoning Ordinance text amendments concerning vested rights
(a -e) were presented by Brough, Town Attorney. He stated that
this new section of the Ordinance was required by the State to
protect holders of site specific development plans from changes
to the ordinance for a period of two years. The State requires
the adoption of this ordinance by all local governments by
October 1, 1991.
Johnson asked if the two year period was from the time of
application or date of permit approval. Brough said the time
started at the permit approval. He also said this section would
put an expiration date on the permits by which time the permit
holders would have to act or lose their approval.
Johnson asked what affect a change of ownership would have on the
two year period. Brough said the time limit was not effected by
change in ownership.
Deetjen asked the consequences of being in mid -construction when
time elapsed. Brough stated that once a building permit is issued
its expiration date overrides that of the vested rights.
Evans confirmed that a change in ownership would have no effect
on the vesting period.
Poole -Kober asked when this ordinance would go into effect.
Brough said that it would apply to all projects after October 1,
1991.

Nichols stated that she wished Payne would develop the lot as if
he would live there.
Jones asked for a show of hands by those apposed to the proposal
and those in favor. The show was 10 to 2 against the rezoning
request.
Payne asked why the Mobile Home Park District was in the Ordinance
it was not to be applied to new lots. He said that not everyone
could afford to purchase a home in Hillsborough and it was his
intent and track record to provide affordable housing in terms
of mobile homes in town.
Evans asked if an addition to the existing single wide home would
make it equal to a double wide. Coe said it would not.
Poole -Kober said that the issue was not one of affordable housing
but whether the application met the ordinance requirements, which
it does not. Coe confirmed that a dimensional varience would be
required before the lot would meet ordinance requirements.
Jones thanked the mnembers of the audience for attending the
meeting and stated that the individual boards would decide on
the application during their August meeting.
