Just a reminder: prior ,to Wednesday we are meeting with the Cemetery Association
and Maryvale,Tuesday at4:00 at the Town Hall. The goal of this meeting is a final
attempt at compromising prior to gomgto the election on Ordinance 225. Also on
Tuesday at 7:30 p.m., we are meeting with the Sanitation District's tt;) have a general
"How's it going? discussion.
Mike Rantz will be interviewed by thel30ard Wednesday night at 7:00. . We'd like to
begin the meeting at 6:45 though, allowing you the opportunity to clarify the questions
you'd like to askMike. Jesse Clark is scheduledto be interviewed on 2/19.
I There are two action items Wednesday night: the immediate fate of P A28 and the three

i mile plan. Tuesday night's meeting with the Cemetery Association and Maryvaie will
determine whether the Board willco~ider repealing Ordinance 225 on Wednesday, or
if the ballot question setting the election question needs to be adopted. Wait & see. . .

Then (and finally) we met withWintet:Park regarding their concerns about our "tltree
mile plan." Pursuant to their concerns, we have modified Fraser's 1/ allowed use" of the
Water Board property immediately west of Winter Park -- from light industrial to a
more benign use. We will be working flosely with Winter Park over the next year ona
new and improved 3 mile plan. .
I There is a lot of activity surrounding tl}e coordinated growth strCltegies project as the

consultants have just provided the first draft of plans. On Monday, February 10th,
from 9:00 - 2:00, the consultants, dtize:q.s committee, staff, and interested parties would
like to meet with as many elected offiqals as possible to review the plan. Copies of the
draft will be available Wednesday. on: Thursday, February 13th, 7:00 p.m., Fraser is
hosting a meeting at which the vision ~tatement and growth objectives created by our
citizens committee will get a closer review. These should be dynamic meetings. . .
I I'll be in Glenwood Springs for a collfetence on Wednesday. I'll be thinking (fondly) of
all the fun you are having as Clay Brown leads a "guided tour of select Glenwood
Springs establishments" (beginning at 8:00 p.m..)! Catherine will stand-in for me while
I'm out so things should go smoother than ever. ..

JANUARY 15,1997
TOWN BOARD
The regular meeting of the Town Board was called to order at 7:30 p.m. Board present were
Mayor Johnston, Wirsing, Swatzell, Havens and Klancke. Also present were Reid, Skelton and
Winter.
Minutes of the 1-8-97 meeting were approved as written.
OPEN FORUM
Ed Barlow from Dana Kepner gave a presentation on water meters and had two samples to look
at. One meter is a radio read and the other was a phone read. A decision will be made soon as
to the type of meter upgrade.
ACTION ITEMS
8:00 p.rn HEARING ON AIR QUALITY ORDINANCE
The Board has discussed this Ordinance in various meetings prior to this meeting and Skelton
advised that a change will need to be made to the section relating to .review and contact with the
Colorado Forest Service. The Forest Service has advised they do not want to be a part of the
Ordinance as they feel it creates a liability position for them.
Havens moved to approve Ordinance 23] with the deletion of language relating to the Co. State
Forest Service, 2nd Klancke, camed.
Sign Code vallance request fi'om Sharkey's EatelY. Greg Blair is requesting advertising on the
Town's Mustang property. After discussion Board will nnt allow advertising on the Mustang
property, but advised that Greg should figure a good location for a large banner that will serve
the purpose nn his property and the Board would comdder granting the extra signage for the first
2 years of the business. Board also discussed that the vehicle with the sign should not be parked
on the ~lustang property but rather in his own lot.
Smart Shuffle. Maire Sullivan briefed the Board again on the shuttle service and funding.
Wirsing moved to grant $750 to the service at this time, Board will re\iew the sales ta"{
collection in June to make sure collection are as projected and at that time if collection are as
projected give the shuttle service the rest of the $750.00, motion 2nd by Havens, carried.
Jim Tucker, Public Works Dept. re"iewed bids and finances of the purchase of a loader. After
discussion Havens moved to lease/purchase the used Kamotso loader from Power Motive at a
price of $89,934 with finance charges @ 5. 56~~ after review and approval of the lease
document by the Town Aitomey, 2nd Wirsing, carried. it was discussed that with the purchase

Ordinance 232 Planning Commission tenns
Skelton reviewed the proposed Ordinance. After discussion Havens moved to approve
Ordinance 232 amending the Planning Commission terms of office., 2nd Wirsing, carried.
Three Mile Plan Resolution tabled until the next meeting.
DISCUSSION ITEMS
Proposed amendments to the water meter Ilolicy were discussed as well as plant investment fees.
Meter policy changes look fine but more information is necessary before the plant Investment
fees are changed other than to include a meter charge into the fee. Reid will inquire as to the
price to have an engineered study done to help set PlF fees.
STAFF CHOICE
Reid would like to have an Ad Hoc Economic Development Committee to help plan for the
redevelopment of the Safeway Store in the Fraser Center. Board gave approval for this.
Reid has met with the Town's financial consultant and the Town Attorney regarding the
proposed Maryvale Metro. District's. The Board indicated tentative approval to extending the
2/28/97 deadline stipulated in. the resolution approving the Metro Districts and requested that
staff move fOlWard in their analogies of the proposed Districts.
Reid has met with Stan Broom from the Governors office to pursue an commercial zoning use
at the Koppers property outside of Fraser.
We have penni~~ion to place a Town bulletin Board at the P09t Office.
Kremmling has asked for support from the Town to acquire a Amtrak Stop. Board is not
, interested in supporting the idea.
JatL 16th at 4:00 p.m. the Town is holding a meeting for the formation of the SOl C 3 for the
Visitors Center.
Mayor Johnston asked if Board was interested in one the of monthly meetings to be held in the
morning. Board will think about this.
Havens moved to have a Public Hearing on the amended Business Zone regulations set for Feb.
19, 1997, 2nd Wirsing, carried.

ORDINANCE NO.
AN ORDINANCE REPEALING ORDINANCE NO. 225 AND CANCELING THE
SPECIAL ELECTION SCHEDULED FOR MARCH 4, 1997.
WHEREAS, on September 4, 1996, the Board of Trustees passed
Town of Fraser Ordinance No. 225, concerning Maryvale Planning
Area 28 and an amendment to the Planned Development District Plan
for Planned Development District No. 1 (PDD #1) as it relates to
said Planning Area; and
WHEREAS, said Ordinance No. 225 was duly published in the
Winter Park Manifest on September 25, 1996; and
WHBR~AS, a referendum petition was filed with the Fraser
Town Clerk, protesting the effect of said Ordinance No. 225, and
the measure is scheduled to be submitted to a vote of the
registered electors of the Town of Fraser at a special election
to be held on March 4, 1997; and
WHEREAS, upon reconsideration, the Board of Trustees finds
and determines that the repeal of said Ordinance No. 225 would
serve the best interests of the citizens and taxpayers of the
Town of Fraser, and such repeal is necessary for the preservation
of the public health, safety and welfare; and
NOW THEREFORB, BB IT ORDAINED BY THE BOARD OF TRUSTBES OF THE
TOWN OF FRASER, COLORADO, THAT:
Seqti9n 1. Town of Fraser Ordinance No. 225 is hereby
repealed in its entirety.
Section 2. The special municipal election scheduled for
March 4, 1997, concerning said Ordinance No. 225, is hereby
canceled.
Section 3. The Board of Trustees finds and determines that
this Ordinance is necessary for the immediate preservation of the
public peace, health or safety; in order to avoid the unnecessary
expense of conducting such special election. This Ordinance
shall therefore take effect immediately upon its adoption by the
affirmative vote of three-fourths (3/4) of the members of the
Board of Trustees, as provided by law.

RESOLUTION NO.
A RESOLUTION ESTABLISHING THE BALLOT TITLE FOR THE SPECIAL
MUNICIPAL ELECTION TO BE HELD ON MARCH 4, 1997.
WHEREAS, on September 4, 1996, the Board of Trustees passed
Town of Fraser Ordinance No. 225, which Ordinance was duly
published in the Winter Park Manifest on September 25, 1996; and
WHEREAS, a referendum petition was filed with the Fraser
Town Clerk, protesting the effect of said Ordinance No. 225; and
WHEREAS, the Town Clerk determined that said petition met
the statutory requirements, and the Board of Trustees has ordered
that said measure be submitted to a vote of the registered
electors of the Town of Fraser at a sp~cial election to be held
on March 4, 1997; and !
WHEREAS, it is the duty of the Bo~rd of Trustees to fix the
ballot title for such special election, and the Board finds and
determines that the ballot title hereinafter set forth will
correctly and fairly express the true intent and meaning of the
measure submitted at the election.
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FRASER, COLORADO, AS FOLLOWS:
1. That at the special election to be held on March 4, 1997, the
question appearing on the ballot shall be as follows:
SHALL TOWN OF FRASER ORDINANCE NO. 225 BE ADOPTED, TO AMEND
THE PLANNED DEVELOPMENT DISTRICT PLAN FOR PLANNED
DEVELOPMENT DISTRICT NO. 1 (PDD #1) BY CHANGING THE
PERMITTED USE OF MARYVALE PLANNING AREA 28 FROM CONDOMINIUMS
TO MIXED USE; TO DEFINE SUCH MIXED USE TO MEAN AND ALLOW FOR
THE DEVELOPMENT OF SAID PLANNING AREA 28 FOR MULTI-FAMILY
RESIDENTIAL UNITS AT A DENSITY OF LESS THAN 20 UNITS PER
ACRE, WITH A MAXIMUM OF 40 UNITS, A SELF-CONTAINED STORAGE
FACILITY, AND COMMERCIAL OFFICE SPACE LIMITED TO A 5,000

A resolution ratifying the Town of Fraser's Three Mile Annexation Plan as approved by the
Fraser Planning Commission and as authorized by Colorado Revised Statutes.
WI IEREAS, the Town of Fraser is required by Colorado Revised Statutes 3 I -12- I 05 ( I ) (c) to
have in place a Three Mile Annexation PhUt prior to the completion of any annexation within a
three mile area frol11 the existing municipal town boundaries; and
WHEREAS, the Three Mile Annexation Plan will be used in conjunction with the Fraser
Community Plan Volume I and II, and the areas depicted as the "secondary growth areas'. have
been discussed in detail regarding land description, land use, utilities, transportation, community
services, open space, parks and recreation; and
WI IEREAS, the Fraser Planning Commission has reviewed the Three Mile Annexation Plan, and
has deemed it necessary f(lr the protection orthe health, salety, and welfare of the current and
future inhabitants orthe Town of Fraser, adopting said plan on December I 1, 1996: and

the "secondary growth areas," and are depicted on the Figure I. Futme Land Use ('vlap. and the
Figure 2, Circulation and TranspOltlltion I\lap. Copies of Figmes I and 2 are attached liS Exhihits

In determining which lands should be included within the three mile plan, consideration \vas given
to the fhtme needs of the conmlllltity. The f()lIowing critical issues were incorporated into the
discussions: the desire to provide meas fbr additional residential and cot11mercial (including light
industlial) development in sullicient quantities to satisfy the Hltllte needs of the C0t1111lllllity amI
the desire to protect open space meas mound thc cot11l1nmity ill order to plovidc fin wildlife
habitat. recreational opportunities, and maintain a natmal backdrop to the comlllllltity.

Utifitie,'t: There ale no utility services on site at this time. Town regulations require thai
pwpertics being annexed utili7.e the Town of Fn1ser municipal water system and the Frascr
Sanitation wastewater system. The developer will incur the cost of extending the necessmy
inflastlllclure to the site. It is prelerable, and maybe necessmy. that the land to he annexed
provide adequate and usoble woter tights. The Town may require the dcveloper to pay lces-in-lieu
of water rig.hts if the water rights nssocinted with the land are inadcqmtte.
Trmrsl'ortati01': This men is presently served by ('ounty Road 72 crossing only in the lower
southwest corner. Consideration must be given at the time of annexation to create proper
circulation to facilitate traffic movement. Any dcvelopment will be served by local sheets and
will be integrated with the Town's existing road system. Bike and pedestriml pathways will be
incorporated and extended onto this site and access to mljncellt properties will be negotiated.

The following information is required by the Town of Fraser as part of any annexation petition
submittal:
A. Statistical nata: Necessmy fucts including. bllt not limited to, acreage, number of
residential units, businesses, estimated population, street mileage-paved and unpaved, and
assessed valuation.
H. Ma'ls: Showing present and proposed municipal boundmies, general land use palterns,
existing and proposed 7.oning. present major tmnk water mains and proposed extcnsions. present
sewer interceptors, and proposed extensions. existing streets. and existing public areas.
c. Existing rublic Sen:ices: Public services to the area's residents should be smveyed and
e\'aluated. The methods of providing such services should he described and their costs
determined. These services include, but are not limited to: police, fire, water, sewer, rerhse.
Iibrmy. street maintenance and lighting, storm sewcrs, animal control, land use planning. huilding
inspectional services, public health protection, recreation, and emergency services.
n. Service Requirement Costs: The cost of extending or imjlroving services should be
detennined. Anticipated expenditllles should be contrasted with anticipated revenues.
Consideration of service costs should include all of the services mentioned at item (' ahm e. The
diflerence between revenues and expenditures Ii:>r cach category should be statcd as a liability 01
an asset. The extent 10 which such services arc already being provided. if at all. will determine the
degree to which additional services may be lequiled.
E. Othc..: The annexing party may be required to submit any neeessmy infiltll1ation for the
preparation of the impact report required by eR.S. 3 1-12-108.5. ifrequired by the Town. In
addition, the Fraser Board of Tlllstees may waive any or all of the nbove requirements ns it relates
to any specific parcel ofland, if the Board determines such waiver is in the public interest.
