A RESOLUTION: MODIFYING THE ANNEXATION AREA DEVELOPMENT POLICIES, ADOPTING
A BOUNDARY LINE ADJUSTMENT AGREEMENT AND AUTHORIZING PUBLICA-
TION OF A REVISED CORPORATE BOUNDARY FOR THE TOWN OF LEESBURG
WHEREAS, the Board of Supervisors of Loudoun County, Virginia (the "Board"),
and the Town Council of the Town of Leesburg, Virginia (the "Council"), have
agreed to consider development proposals in accordance with the policies,
standards and guidelines set forth in the Annexation Area Development Policies
which are a part of the Annexation Agreement and Order of Annexation entered
on October 11, 1983; and
WHEREAS, the owner of the tract of land known as the Beus property desires
to bring the entire tract within the town limits in order that the Potomac
Crossing development proposal be considered under the Town Planned Residential
Community Development Regulations; and
WHEREAS, the Joint Policy Committee of the Board and the Council has
reviewed the proposed development and has determined that it is appropriate
to bring the entire tract within the town limits for the purpose of considering
the Potomac Crossing development proposal; and
WHEREAS, the Joint Policy Committee has recommended that the Annexation
Area Development Policies be modified to incorporate the changes set forth
in Attachment 1 to this resolution; and
WHEREAS, the Council agrees that modifications recommended by the Joint
Policy Committee are appropriate in light of the landowner's expressed willingness
to protect and preserve the environmentally significant and important historical
lands on the Beus property by the dedication of these lands to the Northern
Virginia Regional Park Authority:

CORPORATE BOUNDARY FOR THE TOWN OF LEESBURG
THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia
as follows:
SECTION I. The Annexation Area Development Policies are amended to incorporate
the changes set forth in Attachment 1 to this resolution subject to approval
of the Board.
SECTION II. The Boundary Line Adjustment Agreement set forth in Attachment
2 to this resolution is approved and the mayor is authorized to execute said
agreement on behalf of the town.
SECTION III. A description of the revised boundary line between the
town and county as generally depicted on Attachment 2 to the aforementioned
agreement shall be published at least once a week for two consecutive weeks
in the October 3, 1985 and October 10, 1985 editions of the Loudoun Times-Mirror
and the cost for said publication shall be a apportioned equally between the
Town of Leesburg and County of Loudoun pursuant to §15.1-1031.2 of the Code
of Virginia, as amended.

BOUNDARY LINE ADJUSTMENT AGREEMENT
THIS AGREEMENT made and entered into this . day of~ · I985,
by and between the County of Loudoun, Virginia (hereinafter the "County"),
by and acting through its governing body the Board of Supervisors of
Loudoun County, and the Town of Leesburg, Virginia (hereinafter the
"Town"), acting by and through its governing body the Town Council of the
Town of Leesburg, Virginia.
WHEREAS, the County and the Town in 1982 entered into a comprehensive
Annexation Agreement for the exchange and sharing of public services and
for the mutual benefit of the citizens of both Jurisdictions and for the
adjustment of their boundaries in order to provide services more
efficiently, which Agreement was affirmed and validated pursuant to
Chapter 26.1:1 of Title 15.1 by a Special Court duly constituted and
convened pursuant to Chapter 26.2 of Title 15.1; and
WHEREAS, this Annexation Agreement included a document entitled
Annexation Area Development Policies which provides a guide for the future
development of the area which was brought into the Town pursuant to the
Annexation Agreement; and
WHEREAS, there is currently pending before the Town a rezoning
application (ZM 66) for a parcel of land which lies partly within the Town
and partly within an unincorporated area of the County; and
WHEREAS, it is the desire of the Town, the County, and the landowner
to bring the entire parcel within the jurisdiction of the Town for the
purpose of reviewing the proposed development plan for the parcel; and

WHEREAS, the majority of the land which is the subject of this
Boundary Line Adjustment Agreement is environmentally significant and of
national historic importance; and
WHEREAS, the landowner has given assurances that in the event the
proposed development is approved by the Town approximately 170 of the
acres which are the subject of this Boundary Line Adjustment Agreement
shall be dedicated free of any and all liens and encumbrances to the
Northern Virginia Regional Park Authority or other appropriate
governmental body; and
WHEREAS, the Town and the County consider the proposed dedication of
this land to be in accord with the policies and guidelines of the
Annexation Area Development Policies and in the best interests of the
citizens of the Town, the County and the Commonwealth;
NOW, THEREFORE, the parties agree as follows:
I. The purpose of this boundary line adjustment is to allow the Town
to consider the Potomac Crossing Planned Development rezoning request from
the County R-1 zoning district to the Town PR-C zoning district.
2. The boundary line which is to be established is generally depicted
on Exhibit A and is more particularly described in Exhibit B which are
made a part of this Agreement.
3. The Annexation Area Development Policies are amended to
incorporate the changes set forth in Exhibit C which is made a part of
this Agreement.

4. The boundary line adjustment shall be effective on the date of entry
of the Circuit Court Order however, in the event that the request of the land-
owner for change in zoning classification to the town PR-C zoning district
is not approved or that the land identified in Exhibit A is not dedicated
to the Northern Virginia Regional Park Authority or other appropriate govern-
mental agency as designated by the Town and the County, by July 1, 1986, the
boundary line shall revert to the position established by order of the Annexa-
tion Court on October 11, 1983.

I. TEXT AMENDMENTS
A. Parks~ Recreation and Open Space (Section III D)
1. Add a paragraph 5 to the existing policies on page 10 as follows:
The town shall ensure the preservation of natural open
space areas 'adjacent to the Potomac River.
2. Add a paragraph 6 to the existing policies on page 10 as follows:
The town and county shall work to~ether t_~o ensure the pre-
servation o~f the Balls Bluff National Cemetery and
battlefield area.
B. Transportation (Section III E)
I. Revise the Route 15 Corridor South and Southern Area policies
(page 11) by revising paragraph (d) as follows:

existing paragraph (b) and replacing it with the following:

b. A new intersection with the Route 15 B~-pass should be con-
structed south of Ba--i~-i~f~-~d ~o link th~ ~-~ g5~
circumferential road with Route 15 Business. Existin~
Balls Bluff Road on the east side of the By-pass should be
provided access to the new intersection and its current
intersection with the By-pass closed when it becomes a
safet~ hazard. The new intersection should eventuall~ b_~e
grade-separated. The new Balls Bluff Road should be
designed t~o provide a safe and scenic access for visitors
to the National Cemetery and adjacent parkland by means of
reverse frontage lots and landscaping buffers.

3. Revise Route 7 Corridor policies (p.12) by revising paragraph
(c), to read as follows:
The existing intersection of Route 654 with Route 7
should be closed and realigned to intersect with adjacent
Leegate Industrial Park. Route 654 should be improved to
a four-lane divided roadway from Route 643_ 15 South to
Route ~t 15 Business North

II. PUBLIC FACILITY IMPROVEMENT TABLE AMENDMENT (SECTION IV)

Revise Table I to split Planning Section H into two parts:
H-1 (Beus) 475 ac, 2.05 units/acre, 975 maximum units~ and H-2 (remainder
of H), 144 ac., 2-3(4) units/acre, 300 maximum units. Total of H-1
and H-2 units = 1275 units.
MAP AMENDMENTS (SECTION V)
Revise Maps A, B and D as follows (See attached):

1. Move the Elementary School Site on the Carr tract to the
Beus tract.
2. Change the Town Limit Line to include entire Beus tract,

per acre.
