IONA COMMUNITY CENTER
March 10, 2021 6:30 P.M.
PRESENT: Chairman James West, Member James Cooper, Member Bill Koester, Member
Gary Elliott, and Member Ray Hart
ABSENT: None.
VISITORS: Kathy Koester.
Chairman West welcomed everyone and Member Elliott led with the Pledge of Allegiance.
Approval of Minutes: Member Hart moved to approve the minutes for February 13th, 2021.
Member Elliott seconded the motion. All in favor, the motion carried.
Items of Business:
Oath of Appointment
Keri West, City Clerk/Treasurer swore in Bill Koester and Jason Cooper as members of the
Planning and Zoning Commission.
Oath of Reappointment
Clerk West swore in James West with an Oath of Reappointment as a member of the Planning
and Zoning Commission.
Public Hearing: Ordinance for Annexation and Initial Zoning of Sunrise Acres Subdivision
Chairman West opened the Public Hearing for comment about annexation of the Sunrise Acres
Subdivision. No one came forward. He closed the Public Hearing and submitted it for discussion
amongst the commission.
Member Koester mentioned that they could make the end of the road 20 feet wider temporarily
since they're not doing a cul-de-sac. It would be beneficial if someone has a trailer or something
with a larger turn radius. Chairman West noted that they should have a dead-end sign. Member
Hart said he has an issue with the septic being flat. Member Elliott asked how wide the pipe is,
and member Hart said 6 or 8 inches. Clerk West noted that both IBSD (Iona Bonneville Sewer
District) and our City Engineer have approved the sewer. Member Hart says they might need to
require sump pumps or back check valves to avoid sewer backing up into the street. Clerk West
noted that at the final plat Sunrise Acres had to make some adjustments based on
recommendations by IBSD.
Chairman West asked if there wou ld be any reason not to pass the annexation with zoning as R
I . There were no concerns.
Member Hart motioned that they recommend approval of the Annexation of Sunrise Acres
Subdivision. Member Cooper seconded the motion . All in favor. Motion carried .
Ordinance to Amend Iona City Code§ 10-1-3(A)(41); changing the definition of
subdivision
Chairman West explained that the ordinance would change the definition of "subdivision " in the
City Code from 5 lots to 3 lots. He noted that Mayor Gubler was not concerned if someone split
their land once , but any more than that the City should be able to see the engineered plans.
Member Hart stated that with the new verbiage , the land can only be split once every 10 years.
There are many people who want to split their larger acreage property , which is fine , but they
could continually split that land in half, over and over, and the City would want to be able to
approve those plans to ensure safety. Member Koester asks if someone owns a large amount of
acreage , if they would need to subdivide , and then asked about if they would need annexation
first. Clerk West noted that with Sunrise Acres , they went to Bonneville County first, but
because the land was contiguous with the City , they were required to follow our Code. Chairman
West stated that if someone had five acres and they split the land once it wouldn 't require our
oversight, but if they wanted to split it again within ten years that would trigger the need for
them to appear before City Council.
Member Elliott made a motion that the Ordinance amending section 1 0-l-3(A)( 41) be
recommended for approval to the City Council. Member Koester seconded the motion . All in
favor . The motion carried.
Ordinance to Amend Iona City Code§§ 8-2-4 and 11-4-2; pertaining to private emergency
wells in R-1 Zones
Chairman West noted that this is a whole new ordinance for 8-2-4 and addition to 11-4-2(0)
pertaining to exclusivity of water systems , providing residents the opportunity to have a private
emergency well. This was not previously addressed in the City Code. There are several people
who have wells , as well as being connected to city water. The City had someone ask questions
about a well. Clerk West noted that the Planning and Zoning Commission was given input
because it is specifically for the R-1 zone. Member Elliott asked if he decided to get a well for
emergencies , what the protocol would be. Clerk West clarified that they would need to get
permitted through the City and also through the IDWR (Idaho Department of Water Rights).
Member Koester asked if someone were annexed in who had a well, if they would be added to
city water and their well would become an emergency well. Chairman West noted that they
would be grandfathered in , we don 't force people to connect to city water if they are annexed.
Clerk West noted that we need to be sure that the well is not then connected to city water, which
is the biggest concern. If they are not connected to the water system , they won 't be required to
pay a city water bill. We wouldn 't charge any permit fees if they were grandfathered in . Member
Koester stated that in section C it says that the use of the emergency well is only for the people
who live on the property . He postulated that if there were an emergenc y situation , like a natural
disaster, they wouldn 't be able to share water. Member Hart stated that the intention of this
wording is that you aren't able to use your well to provide water to someone else in lieu of city
water. Clerk West noted that the City has an emergency well connected to the pump outside of
the City Building that could be used by residents in the case of an emergency. Chairman West

stated that we could send a suggestion to the City Council that some kind of wording be added
that in times of emergency under the governance of the City, the distribution of water will be
allowed for drinking purposes. Member Koester stated that in section F it mentions maintaining
the permit, and questioned what that entailed. Clerk West noted that it would have to be
inspected by our Public Works Director, Zech Prouse, and that you'd need a permit from
theIDWR. Chairman West was originally concerned with the aquifer. He stated that his
understanding was that these wells will not affect the aquifer.
Member Hart motions to pass the amendment of Iona City Code 8-2-4 and 11-4-2 pertaining to
emergency wells in an R-1 zone with the amended changes to add in section C that the well
cannot be used for any person who does not reside at the residence in which the well is located,
without permission from the City. Member Elliott seconded the motion. All are in favor. The
motion carried.
Member Elliott moved to adjourn. Chairman West seconded. All in favor, motion carried.
