PRESENT: Chairman James West, Member Bill Koester, Member Ray Hart, Member Jason Cooper, and Office Assistant Rylea Farrens. ABSENT: Member Gary Elliott. VISITORS: Kathy Koester. Chairman West led with the Pledge of Allegiance, and welcomed everyone. Approval of Minutes: Chairman West entertained a motion. Member Hart moved to approve the minutes for March 10, 2021. Member Cooper seconded the motion. All in favor, motion carried. Items o(Business: Public Hearings Application for Annexation-Shane & Aimee Harrigfeld, 4913 East 49th North, Parcel# RP03N38E366603 containing 19. 75 acres Chairman West noted that the Planning and Zoning Commission is also supposed to make a recommendation of zoning. He stated that Clerk West informed him the applicant is looking for an R-A zone. The property owner was not present for comment. Chairman West noted that he believes the property owner is planning on subdividing at a later date. Chairman West stated the property owner is hoping to have an R-A zoning instead of R-1. He explained that R-A zoning allows for animals, but the same amount as R-1. The only difference is in the amount of poultry. Member Hart noted there is something in the R-A Zone that allows you to apply for a variance to have more animals. Member Hart stated that if he wanted to subdivide that, he'd have to bring sewer from the other side of Sand Creek on 49th down to these properties. It is 18 feet deep at Sunrise Acres, making that an expensive and difficult endeavor. Chairman West is assuming that he went to Bonneville County and they told him no, because he is contiguous with Iona, the County will force him to annex into Iona to subdivide. Member Hart notes that he could have a Pioneering Agreement, making the people who tie in pay to connect to the sewer. Member Koester stated that we should give a stipulation to the City Council about the concern with the sewer. Member Hart mentions there is contiguous property that used to be the Telford Pit. It was a dump that has since been filled in. He noted that if we're going to have county property that cannot be developed next to this parcel of property, we could talk to our Mayor about having the county property contiguous to the property become a park, or public space, that the County could pay for, and the City could maintain. Member Cooper asked if they could put a parking lot there, 1 but Member Hart states that because it used to be a pit, there are issues with depressions in the ground. The commission discussed the differences between R-A and R-1, as previously noted. Chairman West noted that Clerk West has stated the property owner had asked for an R-A zoning. Chairman West noted that there was a mistake in the code in the l 1-4-2(B )4 it references 11-4-12, but it should actually be 11-4-9, there is no 11-4-12. Member Hart stated R-A noted that R-1 has slightly different clearances than R-A. Chairman West stated that by zoning with the City, the owner will have to pay the connection fee to get water to his home. Member Hart stated that it will require sewer. Member Hart discussed making a recommendation with stipulation that the property owner clarify what he would like to be zoned as, and why they would like to be zoned that way. With another stipulation of letting the City know how they will run sewer to the property if they develop. Member Cooper clarified that the property owner would not need to pull the sewer unless he was located within 300 feet of the sewer line, although he would need to access our sewer line. Chairman West noted that the property owner would need to disconnect his house from well water and it would become an emergency well. He would need to connect to our water system. Member Hart notes that he could subdivide his home, have two different properties and sell both. He wondered if he is using us to sidestep Bonneville County. Chairman West noted that he will have to connect his current home to the City Water. Chairman West stated there is an Agricultural Zone, which would mean that he doesn't have to connect to the sewer or water. Member Koster stated that according to the code in R-1, he must connect water to any dwellings in the city. He stated that he thinks R-A would be the best zoning. Chairman West moved to approve the annexation with a tie to an R-A zone into the City of Iona, Member Koester seconds. Member Cooper asked if we need stipulations. Chairman West wondered if that would be a better discussion for a Public Hearing. Member Cooper agrees. Member Hart guessed that the county gave away all of the splits of the land. The property owner has grounds to argue. Chairman West called for a vote. All were in favor, motion carried. Member Hart made a motion to adjourn the meeting. Member Cooper seconded the motion.
