PRESENT: Acting Chairman Ray Hart, Member Gary Elliott, Member Bill Koester, Member Jason Cooper ABSENT: Chairman James West VISITORS: Clint Reading, Jill Reading , and Connie Murdock Acting Chairman Hart welcomed everyone and led with the Pledge of Allegiance . Approval of Minutes: Acting Chairman Hart entertained a motion. Member Koester moved to approve the minutes for May 19th , 2021. Member Cooper seconded the motion. All in favor , the motion carried. Items of Business: Variance Application -Clint & Jill Reading, Variance for Commercial Parking at 3388 N. Main Street Acting Chairman Hart invited the Readings to stand . Clint Reading came to the microphone. The Readings are looking to open a restaurant in the old Ernie 's Building , and because they are not able to purchase the adjacent lot , they are looking to have parking approved along the street for their business. Acting Chairman Hart asked how much acreage they own around the building , and Clint Reading stated that there is about a foot on either side . Member Elliott noted that they are limited to the parking out front on the curb. Acting Chairman Hart inquired what they anticipated the amount of customers to be. Mr. Reading noted that there is room for 60 people to be seated in the restaurant , but because they are doing fast/casual dining they expect that people will be coming and going . Member Cooper asked about the dining room square footage. Mr . Reading stated that Entire restaurant is 2500 square feet and about half of that is seating. Member Elliott asked if they would like to have 45 degree parking directl y in front of the restaurant and then parallel parking in the other areas noted. Acting Chairman Hart noted that when Emies was open , they parked along the South side of the building , in Parcel# 3. Member Koester noted that in City Code it requires 1 parking space per every 200 sq. feet. He asked if the 200 sq feet per parking space is based on the dining area or the entire square footage , and then asked how many parking spaces they still need. Jill Reading clarified that currently they don 't have any spaces , hence why they need the variance. Member Cooper noted that if it were based on the dining area they would need 12.5 parking spaces on site . Member Cooper stated that the variance might not be necessary because section § 11-12-1 (B) states that "The provisions of this Chapter shall not apply to any existing building or structure unless and until there is a change of use , substantial alteration or addition, or an enlargement of a current use ." He stated that they would not need this variance because the use of the venue is not being changed. Jill Reading stated that she desires to have off-street parking , and intends to in the future. Member Koester asked if Parcel 5 would have an issue with parking in front of the lot , but Member Elliott clarified that we shouldn't make decisions based on "what-ifs " Acting Chairman Hart invited Clint Reading to sit. He asked if there was anyone there that would oppose the action . He closed the open discussion. He asked if there was any signage disallowing on-street parking . Mrs. Reading stated that there is no signage to limit parking. Member Cooper noted that there is the ability to have 90 degree parking in front of the restaurant , or 45 degree parking to Wilde Avenue. Mr. Reading stated that they could have about 7 cars in front of the restaurant , and another 5 parallel parked across the street. Member Koester asked how many employees they would have . Mrs. Reading added that at the busiest they would have about 4 employees. Acting Chairman Hart postulated that her employees would need a place to park. She stated that they could park next to their home. Acting Chairman Hart summarized that he doesn 't see any reason why not to have the on-street parking Member Cooper moved that the variance for on-street parking ordinance be approved with continued talks with the parcel owner to the South. Member Koester seconded , all in favor , the motion carried. Discussion of Iona City Code§ 10-1; Iona Subdivision Ordinance, regarding plat requirements for properties adjoining new developments Acting Chairman Hart noted that in the email they received, Mayor Gubler doesn't feel it is necessary for an adjacent property owner to provide a preliminary plat when there is a subdivision Cooper read from section § I 0-1-17 "Streets that temporarily dead-end may be permitted with a distance of greater than 400 feet in length , provided the Developer files or has already filed a Preliminary Plat of an adjoining Development depicting a through Street connecting to such temporary dead-end street that is not a dead-end street , and provided further the Council may order the Developer to file a Final Plat for such Preliminary Plat , at any time .... " Acting Chairman Hart stated that he doesn 't think we need to change it. He believes that the developer needs to provide a plan to show the accesses. The Members of the commission think that it is inappropriate to have the neighbor file a preliminary plat, but currently the City Code states that the developer is the responsible party. They believe there needs to be a plan for the road to meet City Code . Acting Chairman Hart stated that as a commission, or City Council there might be times they ask for the developer to talk to neighbors . They don't think it should be a requirement for the neighboring property to have to go through the preliminary plat process. Acting Chairman Hart stated that any cul de sac longer than 400 feet needs to have a second access , or provide for a future access. At the discretion of the building council they may ask property owners to address issues. Member Gary Elliott motioned to adjourn the meeting. Member Koester seconded the motion .
