HomeMy Public PortalAbout17-1616ORDINANCE NO. 17-1616 AN ORDINANCE OF THE CITY OF CARSON, CALIFORNIA, ADOPTING ZONE TEXT AMENDMENT NO. 27-16 TO THE ZONING ORDINANCE, AMENDING SECTION 9159.2 (D)(10) (PART 5 — OPEN SPACE ZONE AND SPECIAL USES; SU -BP ZONE (BLIMP PORT); SITE DEVELOPMENT STANDARDS; SIGNS) OF THE CARSON MUNICIPAL CODE REGARDING BLIMP PORT SIGNS WHEREAS, the Planning Commission held a duly noticed public hearing on March 14, 2017 at which time it considered all evidence presented, both written and oral, and at the conclusion of the public hearing the Planning Commission adopted Resolution No. 17-2600 recommending to the City Council adoption of Zone Text Amendment No. 27- 16 to amend Section 9159.2 (D)(10) (Part 5 — Open Space Zone And Special Uses; SU -BP Zone (Blimp Port); Site Development Standards; Signs) of the Carson Municipal Code regarding blimp port signs NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF CARSON HEREBY ORDAINS AS FOLLOWS: Section 1. Section 9159.2 (D)(10) (SU -BP Zone (Blimp Port); Signs) of Part 5 (Open Space Zone and Special Uses) of Chapter 1 (Zoning) of Article IX (Planning and Zoning) of the Carson Municipal Code is hereby amended as follows: 10. Signs. a. Not more than two (2) large identification sign structures shall be permitted, with not more than four (4) sign faces totaling not more than twenty-one thousand five -hundred twenty-eight (21,528) square feet of sign face area. Said signs shall not exceed eight -eight (88) in height, and three -hundred seventy feet in length. Section 2. Findings. A. The City Council of the City of Carson, California finds that the above recitals are true and correct and are incorporated by reference herein. B. The proposed amendment ensures and maintain. internal consistency with the goals, policies and implementation measures of the General Plan, and would not create any inconsistencies with the Zoning Ordinance as described, follows: Applicable General Plan Implementing Goals and Policies Consistency of Proposed Project Land Use Element Policy LU -6.4: Coordinate redevelopment Consistent: The proposed project is a one - 1 of 3 and planning activities and resources to of -a kind facility with a distinctive regional, balance land uses, mnenities, and civic national and international identity an t facilities. character- which provides a unique landmark for the City. C. That the proposed Ordinance is in the public interest and represents good land use practice because it is consistent with the stated Carson General Plan mission, goals and policies. D. On June 8, 2016, the City Council approved an exception to the moratorium for the modification to the Carson airship base to accommodate the new fleet of airships, finding the project to be consistent with and complementing the "Signature Project" as a regional destination that serves the local market (Resolution No. 16-066) E. A Mitigated Negative Declaration was prepared for the proposed Ordinance Amendment and Development Project and all potential impacts would be mitigated to a less than significant level. Section 3. If any provision(s) of this Ordinance or the application thereof to any person or circumstances is held invalid or unconstitutional by any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any other provision or application, and to this end the provisions of this ordinance are declared to be severable. The City Council hereby declares that they would have adopted this ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof, irrespective of the fact that any one or more sections, subsections, clauses, phrases, parts or portions thereof be declared invalid or unconstitutional. Section 4. The City Council hereby adopts Ordinance No. 17-1616 which amends Section 9159.2 (D) (10) of the Carson Municipal Code for parcel 7339-017-002. Section 5. The City Clerk shall certify to the adoption of this Ordinance, and shall cause the same to be posted and codified in the manner required by law. Section 6. This ordinance shall be effective thirty (30) days following its adoption. 2of3 PASSED, APPROVED, and ADOPTED this 4th day of April, 2017.
