HomeMy Public PortalAbout2020_09_08_O014 Renewal of Ordinance to Ensure the Continuity of Government during the State of Emergency Caused by the COVID-19 Pandemic The Town of Leesburg, Virginia PRESENTED: September 8, 2020 ORDINANCE NO. 2020-0-014 ADOPTED: September 8, 2020 AN ORDINANCE : RENEW ORDINANCE TO ENSURE THE CONTINUITY OF GOVERNMENT DURING THE STATE OF EMERGENCY CAUSED BY THE COVID-19 PANDEMIC WHEREAS, on January 31, 2020, the Secretary of Health and Human Services declared a public health emergency in response to the spread of novel coronavirus which causes COVID- 19 ( "the Virus"); and WHEREAS, on March 12, 2020, the Governor of the Commonwealth of Virginia declared a state of emergency in the Commonwealth of Virginia in response to the spread of the Virus (the "State Declaration"); and WHEREAS, on March 17, 2020, the Board of Supervisors of Loudoun County declared a local state of emergency in Loudoun County(the "County") due to the outbreak of the virus in the County and the resulting danger to the public' s health, safety, and welfare due to the COVID-19 pandemic; and WHEREAS, on March 18, 2020, the Town Council of the Town of Leesburg consented to a declaration of a local emergency by the Town Manager finding that emergency measures are necessary to mitigate the ongoing emergency and disaster that is occurring in the Town due to the COVID-19 pandemic and to protect the health, safety, and welfare of the members of the public; and WHEREAS, on April 3, 2020, the Town Council of the Town of Leesburg adopted Ordinance No. 2020-0-008 Ensuring the Continuity of Government; and WHEREAS, the State Declaration has remained in effect and Governor Northam has continued to issue Executive Orders implementing the response to the COVID-19 pandemic; and WHEREAS, it is apparent to the Council of the Town of Leesburg that the disaster that exists as a result of the effects of COVID-19 is ongoing and that the findings set forth in -2- AN ORDINANCE: RENEW ORDINANCE TO ENSURE THE CONTINUITY OF GOVERNMENT DURING THE STATE OF EMERGENCY CAUSED BY THE COVID-19 PANDEMIC Ordinance No. 2020-0-008, adopted April 3, 2020,remain valid and are likely to remain valid through at least April 3, 2021; and WHEREAS, the Council now desires to adopt this ordinance to extend the duration of Ordinance No. 2020-0-008, adopted April 3, 2020, so that it will expire on April 3, 2021, instead of October 3, 2020, unless extended or rescinded by ordinance adopted by the Council prior to April 3, 2021. THEREFORE, ORDAINED, by the Council of the Town of Leesburg in Virginia that Ordinance No. 2020-0-008, Ensuring the Continuity of Government, is confirmed and renewed, except as expressly provided in this Ordinance, and shall remain in force and effect until April 3, 2021 or rescinded by ordinance. SECTION I. In addition to such other powers as were conveyed to the Town Manager under Ordinance No. 2020-0-008, the Town Manager may reduce budget line items to address revenue shortfalls. SECTION II. That this ordinance shall take effect on the date of its adoption. PASSED this 8th day of September, 2020.
