ITEM #2: Request of L.W. Walker, Inc. to Rezone 21,363 square feet at 316 West Corbin
Street from R-20 (Residential, 20,000 sq. ft. minimum lot size) to R-10 (10,000
sq. ft. minimum lot size) (Tax Map 4.13.B.3b)(Attachments).
ITEM# 3: Request of Ben G. Johnston heirs to Rezone .42 acres at 131 West King Street
from R-20 (Residential) to CC (Central Commercial) (Tax Map 4.36.A.12)
(Attachments).
ITEM #4: Correction of Zoning Map Error. Rezone 1.75 acres at 412 NC 86 N from R-40
(Residential 40,000 sq. ft. minimum lot size) to GC(General Commercial)(Tax
Map 4.5.A.9d)(Attachments).
ITEM #5: Zoning Ordinance Text Amendments (attachment):
a. To amend Section 3.4, Permitted Use Table to allow single family
residences and duplexes in Office -Institutional Zoning Districts.

Substantive changes in the proposed amendments may be made by the Town Board

JOINT PUBLIC HEARING
July 28, 1992

Mayor Johnson called the public hearing to order at 7:05 pm. Mayor passed the gavel to
Crowther, chairman of the Planning Board. Crowther announced that Item 3, the Winecoff
Rezoning request would be tabled and continued until the October Public Hearing. Crowther
briefly explained public hearing procedures to the audience.
ITEM #2: Hauth presented the Walker rezoning application briefly, describing the location of the project
and the differences between the two zoning classifications. Crowther recognized Adkins,
representing Walker. Adkins distributed copies of a petition from property owners not
opposed to the application.
E. Ellis read a letter she sent to the Planning Department noting her opposition to the
application. Her main objection being that the neighborhood previously banded together to
request the R-20 zoning and that Walker was seeking to place three houses on what was a
single dwelling lot. She also presented a map indicating the location of property owners who
had signed the protest petition. Hauth clarified that she would be presenting the protest
petition after the public comment.
C. Burger spoke as both a property owner and professional planner. He noted that this
application is out of context with the existing neighborhood. He said the conflict gives the
appearance of spot zoning and is the reason for his opposition. B. Burger noted some
drainage problems in the area. She said a drainage way runs along the line between the
Walker property and the Burger property and that water tends to collect in low area on the
Corbin Street side of each property. She said it did not seem practical to build another house
in such an area.
Kenion said that he allowed his property along Revere Road to be zoned R-20 for the benefit
of the larger neighborhood, sacrificing some personal financial gain. He added that the
neighborhood has been pretty cohesive for the sixty years he lived there. E. Ellis asked
Crowther to request a show of hands by the property owners present. Adkins asked that
show of hands indicate whether property is on Revere or West Corbin, Approximately 13

people in the audience were present for this item, but not all are property owners. The vote
was as follows: 1 for, 7 against (5 on Revere and 2 on Corbin).
Hauth read and circulated the protest petition and described the petition's affect on the
application. Hauth also read 4 letters from neighbors opposing the application. The letters
were from: Charles and Barbara Burger, Joseph Page, Oliver and Matthew Clayton, and Mrs.
Willie Jones. Jones letter was to request her signature on Walker's petition be disregarded
as she had not understood Walker intent to construct 3 houses, to which she is opposed..
Jones's name had been stricken from Walker's petition.
Jones asked if all the property on West Corbin and Revere was zoned R-20 and Hauth said
it was, except the commercial buildings at the Corbin/Revere intersection. Adkins asked how
many properties in the area did not currently meet the R-20 minimum lot size. Hauth said
there were 4 within the 500 feet notification area. Adkins asked how many properties were
notified. Hauth said she sent approximately 27 notices but that some owners hold more than
one property.
ITEM #3: Crowther announced again that this application was being continued until October at the
applicant's request. Webb asked if he could make a brief statement, somewhat related to this
item. Webb suggested that the time was right to look into allowing non-commercial uses,
by special permits, in residential neighborhoods within the Historic District.
ITEM #4: Hauth briefly presented the rezoning request/correction of Thompson's Garage on NC 86
North. She indicated the location of the property and noted the request was to rezone
commercial from R-40. Olson asked what the minimum lot size in the GC category is.
Hauth said it is 5,000 square feet. There was no comment from the public.
ITEM #5: Hauth briefly presented the text amendment to allow single family and duplex residential uses
within the Office Institutional district. She noted that these uses are allowed in every other
district except General Industrial. Hauth noted that offices uses are typically used as a buffer
between commercial and residential uses. She added that surrounding jurisdictions (Orange
County, Carrboro, and Chapel Hill) allow single family and duplex residential in OI districts.
She said the exact amendment would be to allow single family dwellings as a permitted use
and duplexes with Condition Use Permit 2. There was no comment from the public.
Crowther closed the public hearing and returned the gavel to Mayor Johnson. Johnson
invited the Planning Board members to remain for the Town Board portion of the meeting.
Commissioner Rose made a motion to open the regular session, seconded by E. Lloyd.

ITEM #6: Mayor Johnson asked Hauth to present the proposed job description for the Code
Enforcement Officer. She said she had consulted job descriptions for code enforcement and
building inspectors in North Carolina to devise the description. She noted the removal of fire
code enforcement and certification from the description which was seen during the budget
process. Swanson said that he and Hauth had been working together to establish the
responsibilities of the position. Hauth added that a memo to Swanson from her was also
included, describing a search process.
Commissioner Smith noted his difficulty with the word "utility" as it implies electrical,
plumbing and other things in addition to water an sewer. The members discussed alternate
wording. It was the consensus of the Board to direct Hauth to present a revision at the
August Town Board meeting.
ITEM #6a:Mayor Johnson added the appointment of additional members to the Entranceway Committee
to the agenda at this point. He decreed the following appointments: Hunt McKinnon,
Craufurd Goodwin, David Ballard, and Dr. Robert Murphy (Planning Board Representative).
The members were in consensus.
ITEM #7: Mayor Johnson said that New Sharon United Methodist Church and Walnut Grove United
Methodist Church have requested permission to use the Town Parking lot on Friday,
September 11, 1992 for a barbecue benefiting OCIM.
Motion by Commissioner Smith to approve, seconded by Rose.
Commissioner Rose asked if they would be using the existing holes in the pavement and
Mayor Johnson said they would. The vote was unanimous (4-0).
Motion by Commissioner Rose, seconded by E. Lloyd to go into executive session.
Executive session ensued. Following Executive session, the meeting adjourned at
approximately 10:00 pm.
