The regular meeting of the City Council was called to order by 2. Mayor Merritt at 7:30 P. M. Father Burch of St. Lukes Catholic Church of Temple City gave the invocation, followed by the Pledge 3. of Allegiance to the Flag led by Mayor Merritt. 4. APPROVAL OF MINUTES: Councilman Harker moved to approve the minutes of the regular meeting of the City Council held on Nov- ember 23, 1964, as mailed, Councilman Nunamaker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None UNFINISHED. BUSINESS: 6. ORDINANCE NO. 64 -142: 2nd reading. City Manager !^loollett read title to Ordinance No. 64 -142 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMEND- ING SECTION 8100 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO GLASS DOORS AND GLASS PANELS, & THE RE- NUMBERING OF THE CHAPTER ON REVIEWING STANDS, GRANDSTANDS AND BLEACHERS. Councilman Harker moved to waive further reading and adopt Ordinance No. 64 -142, Councilman Nunamaker seconded, and carried by the follow- ing roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None PUBLIC HEARINGS: CURB & GUTTER: Councilman Dickason moved to open the Public Hearing, Councilman Harker seconded, and carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None. Asst. City manager Koski presented the following locations for public hearing; A. north side Olive, Cambury to Baldwin, and advised 52% of block has existing curb and gutter and the sole owner of the remainder is in favor with adequate width given to parking entry. No one came forward to speak for or against. B. east side McCulloch, Daines to Freer, and advised this sec- tion is non- dedicated street. There is 100% sign up on peti- tion and all will sign agreement whereby they will dedicate right of way necessary for a dedicated street. No one came forward to speak for or against. C. Temple City Blvd., east side Sparklett to Lower Azusa at followine addressee: 1. 4836 Temple City Blvd. 56 ft. frontage, 2. 4830 r Temple City Blvd. 56 ft. frontage, 3. 4324 Temple City Blvd. 46 ft. frontage, 4. 4816 Temple City Blvd. 55 ft. frontage. He advised curb and gutter exists on 73% of the footage with Five property owners remaining representing 213 ft. Richard M. McKee, 4836 Temple City Blvd., requested informa- tion regarding procedure and installation. No one else came forward to speak for or against. D. Temple City Blvd. east side La Rosa to Sparklett at following locations: 1. 5008 Temple City Blvd. 60 ft. frontage, 2. 5002 Temple City Blvd. 60 ft. frontage. He advised curb and gutter exists representing 80% of footage and these two properties remain representing 120 ft. He advised 96% of block has curb and gutter, with just this one property remaining representing 30 ft. No one came forward to speak for or against. F. Lemon Ave., north side Oak to Temple City Blvd. He advised this petition called for curb, gutter and sidewalk on the following locations: 1. 9433 Lemon Ave. 96.5 ft. frontage, 9427 Lemon Ave. 80 ft. Frontage, 3. 9413 Lemon Ave. 100.5 ft. frontage, 4. 9401 Lemon Ave. 120 ft. frontage. He advised 77% of the block has curb and gutter, and 68% has sidewalk existing. The four properties remaining repre- sent 397 ft. of frontage. Earl Dietrich, 9401 Lemon, favored sidewalk but would have only 10. ft. from property line to house to which he objected Merle Funk, 9413 Lemon, did not object to curb and gutter but did not see the need for sidewalks. Robert Brooks, 9427 Lemon, asked for information regarding costs of installation. No one else came forward at this time to speak for or against G. Lemon Ave. south side Oak to Temple City Blvd. at 9504 Lemon Ave. He advised there is 84% existing curb and gutter and this one property without representing 62 ft. No one came forward to speak for or against. H. Agnes Ave., west side Olive to Howland: 3662 Olive 147 ft. frontage. He advised 51% existing curb and gutter on the west side. 4. L. Bolter, asked for information concerning rebate and costs. No one else came forward to speak for or against. I, Agnes Ave. east side Olive to Howland, at 9904 Olive 145 ft. frontage. No one came forward to speak for or against. J, Agnes Ave. east side La Rosa to Lower Azusa at the following locations: 1. 5014 Agnes Ave. 55 ft. frontage, 2. 5020 Agnes Ave. 65 ft. frontage 3. 5023 Agnes Ave. 135 ft. frontage. He advised there is 82% existing curb and gutter with 255 ft.. still required. No one came forward to speak for or against. Councilman Tyrell moved to close the public hearings, seconded an carried. Councilman Tyrell moved that with the exception of the sidewalks in Item F that the projects be found in the public in- terest and to instruct the Supt. of Streets to cause the work to be done, and that the sidewalks be continued to next meeting and the Mayor and City Clerk be authorized to sign the road deeds for dedication, Councilman Nunamaker seconded, and carried by the Following called vote: AYES: Councilmen - Dickason, Harker, Munamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None The Asst. City Manager presented the petition for public hearing on the north side of Daines Dr. Hallowell to Halifax signed by 100% of the property owners. Councilman Tyrell moved to open the public hearing, seconded and carried. No one came Forward to . speak for or against. Councilman Tyrell moved to close the public hearing, Councilman Harker seconded, roll call vote carried the motion unanimously. Councilman Tyrell moved to find the project to be in the public interest and to instruct the Supt. of Streets to cause the work to be done, Councilman Harker seconded, carried by the Following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None PUBLIC HEARING: CURB & GUTTER ASSESSMENT: 10619 Daines Drive The Asst, City Manager advised this was a completed curb and gutter project, the property owner did not hire a contractor and the City installed at a cost of $2.40 per ft., and therefore the property owner should not be granted the rebate, and recom- mended the assessment of $168. be approved. Councilman Nunamaker moved to open the public hearing, Councilman Tyrell seconded and carried. Mayor Merritt asked if any one wish- ed to speak for or against, and no one came forward. Councilman Nunamaker moved to close the public hearing, Councilman Tyrell seconded and carried. RESOLUTION NO, 64 -419: Catherine M. Capp Variance City Attorney Shatford read title to Resolution No. 64 -419 RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY GRANTING THE APPEAL OF CATHERINE M. CAPP TO MODIFY DECISION OF THE PLANNII\ COMMISSION IN ZONE CASE NO. 64 -129. Councilman Harker moved to adopt Resolution No. 64 -419, Councilman Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilmen -None ABSTAINING: Councilman - Tyrell 8. ORDINANCE NO. 64 -143: Amend. Mun. Code re fences. '1ST READ. City Attorney Shatford read title to Ordinance No. C7k -143 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AMENDING SECTION 8115 OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO BARBED WIRE AND ELECTRICALLY CHARGED FENCING, Councilman Tyrell moved to waive further reading of Ordinance No. 64 -143, Councilman Dickason seconded and carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None As this was the first reading no Further action was taken. 9. RESOLUTION NO. 64 -422: re parking restrictions on Baldwin Ave. George Envall, Traffic Engineer, read title to Resolution No. 64 -422 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING THE CITY MANAGER TO POST BALD,1IN AVENUE BETWEEN DAINES DRIVE AND LOWER AZUSA ROAD BETWEEN DECEMBER 26, 1964, AND MARCH 11, 1965, (SUNDAYS EXCEPTED) WITH CERTAIN NO PARKING - TOW AWAY SIGNS. Councilman Nunamaker moved to adopt Resolution No. 64 -422, Councilman Tyrell seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 10. RESOLUTION NO. 64 -423: re additional traffic control from sheriff George Envall, Traffic Engineer, read title to Resolution No. 64 -423 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REQUESTING ADDITIONAL LA.! ENFORCEMENT SERVICES WITHIN THE CITY OF TEMPLE CITY, CALIFORNIA, FROM THE LOS ANGELES COUNTY SHERIFF'S DEPARTMENT UNDER THE LAW ENFORCEMENT SERVICES AGREEMENT This is for traffic control during the racing season and the costs are paid by the Santa Anita Turf Club. Councilman Tyrell moved to adopt Resolution No. 64 -423, Councilman Nunamaker se- conded and carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None RESOLUTION NO. 64 -424: re liability amendment agreement with County. City Attorney Shatford read title to Resolution No. 64 -424 RE- SOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHOR- IZING EXECUTION OF ASSUMPTION OF LIABILITY AMENDMENT AGREEMENT BETWEEN THE CITY OF TEMPLE CITY AND THE COUNTY OF LOS ANGELES t1r. Shatford explained this protected the City when county em- ployees were conducting City business and /or any suit was filed on such employees concerning their conduct, etc. Councilman Tyrell moved to adopt Resolution No. 64 -424, Councilman Nunamaker seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 12. REPORT LEAGUE CALIF. CITIES DEC. 3 MEETING: Councilman Harker Councilman Harker requested recommendations from the City Council concerning their stand on proposed changes concerning the Local Agency Formation Commission receiving salaries or payment for 683 Council Minutes, December 14, 1964, page 4 their services, and an amendment to County Ordinance #5582 per - taining to turning over complete control to the Sheriff's Dept. for emergency at time of major disaster. Also regarding the Local Agency Formation Commission it was proposed they change their name, also to end the power of the body to instigate annex- ations. There followed a lengthy discussion concerning the pro- posals, following which Councilman Tyrell moved to vote in favor of the recommendations with the exception of compensation to the Local Agency Formation Commission,(this motion pertaining only to the recommendations concerning this Commission), Councilman Nunamaker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None The second request for advice regarding the City's position re- garding the amendment to County Ordinance No. 6582 whereby the Sheriff takes over control in a major disaster was presented by Councilman Harker. Following considerable discussion the City Manager recommended before making wishes of the Council known that the City Attorney take some time and give a resume of exist- ing state law as to who has authority during disaster. Following his research and report to you a decision can then be made as to the City's stand on this amendment. 13. RESOLUTION URGING STATE LEGISLATURE TO ENACT A GENERAL STATUTE RETURNING "HOME RULE" TO CITIES OF CALIFORNIA. Councilman Dicke - son presented a recommendation that the City adopt a resolution similar to one adopted by Culver City incorporating the above request, Councilman Nunamaker seconded. There followed consider- able discussion. The motion was carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilman - Tyrell ABSENT: Councilmen -None 14. PLANNING COMMISSION RECOMMENDATIONS: City Manager Woollett presented Resolution No. 64 -133PC finding proposed Parking District #3 conforms to the General Plan of Temple City and Resolution No. 64 -134PC finding the proposed Parking District #4 conforms to the General Plan of Temple City, both resolutions adopted by the Planning Commission. Councilman Tyrell moved to receive and file, Councilman Dickason seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 15. TRAFFIC COMMISSION RECOMMENDATIONS: Item 3. Market Basket Parking Lot at Longden & Rosemead: place- ment of red curb markings north side Longden commencing 107 ft. east of east curb return of Rosemead Blvd. to point 19 ft. east of said curb return; a distance of 84 ft, from second drive easterly of Rosemead Blvd. and red curb markings on south side Longden from point 35 ft. east of east curb return distance of 47 ft. b. red curb -south side `:\Joocruff between Temple City Blvd. & Camellia c. Also Resolution No. 64 -421 supporting Holiday Safety Program of 684 Council Minutes, December 14, 1964, page 5 Greater Los Angeles Chapter of the National Safety Council, Traffic Engineer Envall presented the above recommendations to the City Council. Councilman Tyrell moved to adopt the recommendations of the Traffic Commission as presented and to adopt Resolution No. 64 -421, Councilman Harker seconded, roll call vote to carry as fol lows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 16. ZONE VARIANCE CASE #64 -139 APPEAL Carl G. Lindeman, 6202 N. Rose- mead Blvd. Temple City. City Manager Woollett requested this be held over until the next Council meeting on January 11, 19)65. Councilman Tyrell so moved, Councilman Harker seconded, and carried. 17. RESOLUTION NO. 64 -1420: Warrants &- Demands Councilman Nunamaker moved to adopt Resolution No. 64 -420, war- rants and demands Nos. 5845 through 5926 in sum of $42,522.94, Councilman Tyrell seconded, carried by the following; called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 18. CORRESPONDENCE: a. American Cancer Society: City Manager Woollett presented a request for their annual appeal during April, 196:5. Councilman Tyrell moved to grant, Councilman Harker seconded, and carried. b. Charitable Solicitation Permits: (1) Temple City Seventh Day Adventist Church for Christmas caroling and solicitation Dec. 6 -9 (2) Senior Class of Temple City High School for car wash Dec. 12, 10 AM to 4 PM at Rays Standard Station. The City Manager stated due to the dates he had granted permissi- on on these two requests and requested Council approval. Councilman Nunamaker moved to approve, Councilman Dickason second- ed, and carried. c. L. A. County Boundary Commission: proposed Annexation #71 City of So. El Monte. Councilman Tyrell moved to receive and file, Councilman Nunamaker seconded and carried. 1 9 . TIME FOR THOSE I N THE AUDIENCE JH0 WISH TO SPEAK: No one came forward to speak at this time. 20. MAtTERS FROM CITY OFFICIALS: Councilman Nunamaker presented a letter from the Jr. Chamber of Commerce requesting Jan. 17 -23 be proclaimed National 'Junior Chamber of Commerce 'Week in Temple City. Councilman Nunamaker so moved, Councilman Tyrell seconded and carried. Mayor Merritt presented a request from the T. C. Teenage Republi- can Club to sell mistletoe to raise funds to build a float for the Camellia Parade. Councilman Nunamaker moved to approve, Councilman Harker seconded and carried. Councilman Dickason asked if anyone had any information regarding proposed heliport in the area, with no further information at the present time available. Councilman Dickason also requested information regarding the radar unit and City Manager 'Ioollett will have a report back to the Council some time in January. Following discussion regarding the Parking Districts Councilman Dickason requested a schedule report on each district. Councilman Tyrell reported on the Contract Cities Seminar program and that this year it will be held between May 20 and 23 and at the El Mirador. Asst. City Manager Koski requested public hearings be set for curb and gutter for (1) Glickman Ave. 5800 -5000 block east and west side, Lower Azusa to La Rosa and (2) Daines Dr. 10800 block north and south side Welland to McCulloch. Councilman Tyrell moved to set public hearings on the above for 7 :30 P. M. on January 11, 1965, Councilman Nunamaker seconded, and carried. City Manager Joollett recommended study sessions be scheduled for once a month which would be open meetings. It was agreed to set aside the last Thursday of each month starting in January at 7:30 P. M. 685 Council Minutes, December 14, 1964, page 6 The City Manager recommended after the first meeting in January that the Council appoint two members to the Parks & Recreation Commission and have a joint meeting with them. Also the Council will have to appoint a Planninc; Commissioner to replace Norman Erickson who will be leaving Febr. 1, 1965. These appointments can be made at a personnel session following the regular meeting on Jan. 11, 1965. 21. ADJOURNMENT: Councilman Nunamaker moved to adjourn to December 17, 1964, at 7:30 P.
