Members present: Mayor, Wayne Neddermeyer; Councilmen, Arthur Theis, William Reiser, Robert Franklin, Donald DesLauriers; Planning and Zoning Administrator, Anne Dor- weiler; Attorney Richard Sehieffer arrived at 8:05 P.M.; Clerk, Donna Roehl arrived at 9:00; Councilman Arthur Theis arrived at 9:00 P.M. Minutes of May 4, 1976 corrected as follows: Page 31, Item 2, Line 10: Substitute the word "bond" for "would." Page 32, Item 4, Add: "Wayne Neddermeyer noted that division of assessment must be fair." Motion by Donald DesLauriers, seconded by Robert Franklin to accept minutes of May 4, 1976, as corrected. FIDEL THEIS Motion by Donald DesLauriers, seconded by Robert Franklin to approve Resolution 76-19, Fidel Theis Land Division. Motion carried unanimously 3. MINUTES OF BOARD OF REVIEW Motion by Robert Franklin, seconded by William Reiser to approve minutes of Board of Review meeting of May 10, 1976. Motion carried unanimously 4. DOCKSIDE INN INC. Richard Schieffer distributed copies of memo regarding issuance of licenses to William Cole- man. Council discussed same. The following items were supplied by Gary Persian, attorney for Er1e,Anderson: Affadavits signed by Mr. Anderson Information that it would take from 2-3 weeks to secure bonding and therefore they are seeking a letter of credit instead Mr. Coleman presented a list from Minnesota Health Dept. of items to be taken care of before reppening. Mr. Schieffer inquired as to ownership of other bars by Mr. Coleman. Mr. Coleman stated that he owned a 3.2 bar in Independence and that he also owns Coleman's, a 3.2 bar in Minneapolis, but leases it to someone else. Discussion of issuance of license contingent on satisfaction of any prior and present re- quirements. Mr. Persian stated that they need a license to secure a letter of credit. Mr. Schieffer suggested the following conditiins be met to satify granting of licenses 1. Filing of assignment of Contract for Deed and Quit Claim Deed 2. Filing of lease between Anderson and Coleman 3. Completing items 1 - 5 of Minnesota Health Dept. inspection report 4. File, with City Clerk, agreement of Coleman and Anderson 5. Payment of SAC charges 6. Letter of credit issued in excess of lien claims from which lien claimants may draw either by judgement or settlement Clerk to hold licenses until all conditions are satisfied. Letter of credit to be in excess of $80,000 or amounts of liens. r 37 Motion by Donald DesLauriers, seconded by ,William Reiser to grant an 0n-Sale Liquor license to William Coleman, dba Coleman's Dockside Inn, subject to Mr. anderson's attorney and Mr. Coleman completion of the above 6 requirements and authorize the Mayor and Clerk to sign licenses when conditions are met. Motion carried unanimously Motion by William Reiser, seconded by Arthur Theis to grant an Off -Sale Liquor license to Willaim Coleman, dba Coleman's Dockside Inn, subject to the same conditions. CURFEW ORDINANCE Motion by Donald DesLauriers, seconded by Arthur Theis to adopt Ordinance No. 161, Curfew Ordinance. Motion carried unanimously 6. NUISANCE ORDINANCE Discussion of changes incorporated into ordinance that had been suggested at previous meeting. Motion by Robert Franklin, seconded by Donald DesLauriers to add the following: Section 550.15, strike Line 3. Colon after the word "following" in line 2 Change paragraph (1) to read: (1) On any parcel of land 22,000 sq. ft.or less a. Three or more dogs, four months old, unless a Private Kennel license is obtained. b. Five or more cats, four months old. c. Fowl, other than waterfowl. d. Monkeys e. Six or more rodents Motion carried unanimously Motion by Donald DesLauriers , seconded by Arthur Theis to set the license fee under Section 550.25, Paragraph 3, at $20.00. Motion carried unanimously Motion by Robert Franklin, seconded by William Reiser to change wording in Section 550.20, Paragraph 1, line 2 to read 22,000 sq. ft. or less." and to adopt Ordinance No. 162. Motion carried unanimously 7. ANNE DORWEILER Robert Mealman Discussion of a variance for a side yard setback. Mr. Mealman presented sketch of buildings and the necessity of placing building 5 feet from side yard property line becauue of location of well. Motion by Robert Franklin, seconded by Donald DesLauriers to grant a variance to Robert Meal - man for a side yard set back of up to 5 feet because of small lot size and location of well. Motion carried unanimously Comprehensive Plan Anne Dorweiler presented a proposal from Weirman and Chapman regarding presentation of the Comprehensive Plan to the Metro Council. Members will study and discuss at the June 1 meeting. 3 8 8. EHLERS AND ASSOCIATES Robert Ehlers Jr, explained his letter regarding bond refunding and the savings the city could recognize if they were to refund. Discussion of procedure and several ways of refund- ing. Motion by Robert Franklin, seconded by Donald DesLauriers to authorize the sale of refunding bonds on July 20, 1976, at no cost to the city, as presented in letter to City Council date. May 18, 1976, from Ehlers and Associates with emphasis on savings in later years. Discussion of various wys of refunding and information on how school districts and other cities are proceeding. Robert Franklin withdrew his motion and Donald DesLauriers withdrew the second. Motion by robert Franklin, seconded by William Reiser to refer the matter to Joe Crow, City Auditor and table the matter until June 1, 1976. Motion carried unanimously 9. WILLIAM FENHOLT Mr. Fenholt explained letter he had written regarding the lots in Independence Beach he wished to purchase, and the fact that he had found out they were tax forfeit after he had paid an amount of money to the supposed owners. Various ways of selling the lots were discussed. Motion by Donald DesLauriers, seconded by Arthur Theis to direct the attorney to request a private sale on Lots 1 and northerly 40 feet of Lot 2, Block 7, Independence Beach, upon the condition that William Fenholt post a Cashier's check in the amount of the appraisal price; guarantee the payment of Special Assessments; and agree to purchase the property from the City at public auction on the above stated terms. Motion carried unanimously 10. CONTINENTAL TELEPHONE CO. Motion by Robert Franklin, seconded by Donald DesLauriers to revoke permits to all utilities to bury cables in the Independence Beach area because of damage that will be done to black - topped streets. Motion carried unanimously 11. LOT SIZE ORDINANCE Motion by Robert Franklin, seconded by Arthur Theis to make the following changes in the proposed ordinance: Section 23, B (2), Line 2, delete the words "reduced to" " ", A (5), Line 1, add "60" after"maxi.mum of" Motion carried unanimously Motion by Wayne Neddermeyer, seconded by Donald DesLauriers to change Section 23, A (3), Line 2 to "two (2) acres" Motion carried. Voting No, Robert Franklin Motion by Robert Franklin, seconded by Arthur Theis to adopt Lot Size Ordinance No. 163, as it is in accordance with Medina's Comprehensive Plan. Motion carried unanimously 12. TRUCK SPECIFICATIONS Donald DesLauriers read preliminary specifications for purchase of a new truck. Motion by Arthur Theis, seconded by William Reiser to authorize Donald DesLauriers to prepare final specifications and to advertize for bids for new truck on Tuesday June 15th at 8:00 P.M. Motion carried unanimously 13. REVENUE SHARING PLANNED USE REPORT Motion by Donald DesLauriers, seconded by Robert Franklin, to submit planned use report for $400 for police department expenses and $5540 for use on Medina roads. Motion carried unanimously 14. INDEPENDENCE BEACH PARK Motion by Robert Franklin, seconded by William Reiser to allow friends of Dale Provo the use of the City park on July 31 and August 1, providing they stay on the north side of boat launch area. Motion carried unanimously 15. SUMMER YOUTH EMPLOYMENT 3 9 Discussion of hiring 2 youths for summer employment through the Community Action Services. Motion by Robert Franklin, seconded by Arthur Theis to employ 2 youths on the roads for amount of time stated in agreement. "viMotion carried unanimously 16. BILLS Motion by Arthur Theis, seconded by Robert Franklin to pay the bills. Payroll # 4052-4058 in the amount of $2075.87. Motion carried unanimously Decision that wages for park maihtainence and mowing remain the same as 1975 that is $2.50 per hour. L. 17. COUNTY AID TO MUNICIPALITIES Clerk authorized to submit project plans for blacktopping of Brockton Lane from Hamel Rd. South to last fire hydrant and any remaining money to be used for seal coating. Donald DesLauriers to secure an estimate for the blacktopping. Amount apportioned for Medina is $6081.90. 18. HAMEL ROAD SODDING Motion by Robert Franklin, seconded by William Reiser to authorize Engineer to enter into a contract for sodding of Hamel Rd. to complete sewer and water extension project, as per quotes received in the fall of 1975. Motion carried unanimously 19. LETTERS TO PILLSBURY AND DUDE Motion by Robert Franklin, seconded by William Resier to write lettdrs to George Pillsbury and Tad Jude thanking them for their efforts on behalf of the smaller municipalities during the last legislative session. Motion carried unanimously 20. MEDINA MORNINGSIDE STREETS Motion by Donald DesLauriers, seconded by William Reiser to write a letter to Mr. Bergerson requesting that they fix the streets in Medina Morningside that were damaged when water mains were repaired.
