HomeMy Public PortalAbout2020_09_22_O015 TLZM-2020-0001 McDavit Rezoning Application Approval The Town of Leesburg, Virginia PRESENTED: September 22, 2020 ORDINANCE NO. 2020-0-015 ADOPTED: September 22, 2020 AN ORDINANCE: APPROVING TLZM-2020-0001, MCDAVIT ZONING MAP AMENDMENT TO REZONE 1.75 ACRES FROM 0-1 GENERAL OFFICE DISTRICT TO THE R-1 SINGLE FAMILY RESIDENTIAL ZONING DISTRICT WHEREAS, a rezoning application TLZM-2020-0001, McDavit, has been filed by Michel McDavit and Catherine Visintainer to allow one single-family detached dwelling on land identified as Loudoun County Parcel Identification Number(PIN)230-35-8464-000; and WHEREAS, a duly advertised Planning Commission public hearing was held on August 6, 2020; and WHEREAS, at a regular meeting of the Planning Commission on August 6, 2020, the Planning Commission recommended approval of this application to the Town Council; and WHEREAS, the Town Council held a duly advertised public hearing on this application on September 22, 2020; and WHEREAS, staff recommends approval; and WHEREAS, the Approval Criteria of TLZO Section 3.3.15 has been satisfied; and WHEREAS, the Council has concluded that the approval of the application would be in the public interest and in accordance with sound zoning and planning principles. THEREFORE, ORDAINED, by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The rezoning application TLZM-2020-0001,McDavit,is hereby approved to allow a single family dwelling unit, subject to the proffer statement, TLZM-2020-0001, McDavit, dated September 1, 2020, at the property identified as Loudoun County Parcel Identification Number 230-35-8464-000; and -2- AN ORDINANCE: APPROVING TLZM-2020-0001, MCDAVIT ZONING MAP AMENDMENT TO REZONE 1.75 ACRES FROM 0-1 GENERAL OFFICE DISTRICT TO THE R-1 SINGLE FAMILY RESIDENTIAL ZONING DISTRICT SECTION II. Development of this property shall be in substantial conformance with the plan set (Concept Plan) entitled "Michael McDavit and Catherine Visintainer Property Zoning Map Amendment (TLZM-2020-0001) Leesburg, Virginia" last amended August 27, 2020 By Tri-Tek Engineering; and SECTION III. Severability: If a court of competent jurisdiction declares any provision of this ordinance invalid, the decision shall not affect the validity of the ordinance as a whole or any remaining provisions of this ordinance; and SECTION IV. This ordinance shall be effective upon its passage. PASSED this 22'day of September, 2020.
