ORDINANCE NO. 1990 -11 ® AN ORDINANCE AMENDING THE GREENCASTLE PLANNING AND ZONING ORDINANCE BY AMENDING THE ZONING MAP (PETITION OF AL TUCKER) WHEREAS, the Plan Commission of the City of Greencastle, having received the Petition for Rezoning from Al Tucker, has initiated and prepared this ordinance to amend the Greencastle Planning and Zoning Ordinance by amending the zoning map; WHEREAS, the Greencastle Plan Commission has reported that it held a public hearing concerning this ordinance on March 1.2, 1990, after timely notice of the hearing was given by publication in the Banner - Graphic Greencastle, Indiana on March 2, 1990; WHEREAS, the Greencastle Plan Commission has reported that it paid reasonable regard to the factors enumerated in IC 36 -7 -4- 603 in consideration of the ordinance and determination of a recommendation to made to the Common Council; WHEREAS, the Greencastle Plan Commission has certified this ordinance to the Common Council with a recommendation by a majority vote in favor of adoption; WHEREAS, the Common Council has considered the recommendation of the Greencastle Plan Commission and has paid reasonable regard to the factors enumerated in IC 36 -7 -4 -603 before acting on this ordinance; WHEREAS, the Common Council has determined that this ordinance should be adopted without amendment as certified by the Greencastle Plan Commission. Therefore, BE IT ORDAINED AND ADOPTED BY THE COMMON COUNCIL OF THE CITY OF GREENCASTLE, INDIANA: SECTION 1. REZONING That the City of Greencastle Zoning Map, Chapter 806 -5 (b) of the City of Greencastle Code, is hereby amended by changing the zoning classification for the following described real estate from R A Residential - Agricultural to R- P-- Professional Office - Residence Districts: ® 1202 South Bloomington Street Situate in the State of Indiana, County of Putnam and being a part of the Southeast quarter of Section 21, Township 14 North, Range 4 West of the second Principal Meridian more particularly described to -wit: 1. " Beginning at a point in the centerline of Indiana State Road 43 that is North 24 degrees 40 minutes West 525.615 feet from a point in the centerline of said State Road 43 on the South line of said Section 21; thence from said point of beginning South 79 degrees West 207.5 feet to a point; thence North 24 degrees 40 minutes West 60 feet to a point; thence North 79 degrees East 207.5 feet to a point in the centerline of said State Road 43; thence South 24 degrees 40 minutes East with the centerline of said road 60 feet to the point of beginning containing 0.276 acres more or less. 1204 South Bloomington Street A part of the southeast quarter of Section 21, township 14 north range 4 west described as follows, to -wit: Beginning at a point in the center of the Bloomington road said point being 24 degrees and 40 minutes west 7 chains and 82.75 links from a point in the center of said road and on the south line of said section 21 and running thence south 79 degrees west 207 feet and 6 inches; thence north 24 degrees and 40 minutes west 69 feet; thence in an eastwardly direction parallel to the south line of said section 207 feet and 6 inches; thence with the center of said road 69 feet to the place of beginning; also a part of said section 21, township 14 north, range 4 west described as follows, to -wit: Commencing at a point in the center of the Bloomington road which point is north 24 degrees and 40 minutes " west 7 chains and 82.75 links from a point in the center of said road on the south line of said section 21; thence south 79 degrees west 3 chains and 72 links; thence in a southeastwardly direction parallel to the said Bloomington Road 47 feet; thence in an eastern direction 3 chains and 72 links to a point in said center of said Bloomington road which is 72 feet from the place of beginning; thence 72 feet to the place of beginning. Except therefrom 10 feet of uniform width off of the south side of the above described tract. 1208 South Bloomington Street Situate in the State of Indiana, County of Putnam and being a part of the East half of the Southeast quarter of Section 21, Township 14 North, Range 4 West of the Second Principal Meridian more particularly described to -wit: Commencing at the intersection of the South line of the East half of the Southeast quarter of Section 21, Township 14 North, Range 4 West and the centerline of U.S. Highway #231; thence North 24 degrees West 222.69 feet with the centerline of said U.S. Highway #231 to the true point of beginning of the real estate herein described; thence West 218.9 feet; thence North 24 degrees West 72.33 feet; thence East 218.9 feet to the centerline of the aforesaid U.S. Highway 4231; " thence South 24 degrees East 72.33 feet with said centerline to the point of beginning, containing 0.33 of an acre. ALSO: Situate in the State of Indiana, County of Putnam and being a part of the East half of the Southeast 2. This ordinance takes effect upon passage. The Clerk- Treasurer of the City of Greencastle is ordered to have this ordinance published by inserting a copy of the ordinance in each of the two (2) sets of the City of Greencastle Code maintained on file for public inspection in the office of the Clerk- Treasurer. Harmless Mayor ATTEST: i 7 � Judith Berry Cller Treasurer SYNOPSIS • This ordinance amends the Greencastle Zoning Map, Chapter 806 -5(b) of the City of Greencastle Code to rezone 1202, 1204, and 1208 South Bloomington Street from R- A-- Residential- Agricultural to R- P-- Residential - Professional. 3. quarter of Section 21, Township 14 North, Range 4 West of the Second Principal Meridian, more particularly described to -wit: Commencing at the intersection of the South line of the East half of the Southeast quarter of Section 21, Township 14 North, Range 4 West and the centerline of U.S. Highway #231; thence North 24 degrees West 295.02 feet with the centerline of said U.S. Highway 9231. to the true point of beginning of real. estate herein described; thence West 218.9 feet to a corner post; thence North 24 degrees West 72.33 feet; thence East 21.9 feet; thence North 24 degrees West 54.0 feet; thence North 81 degrees 16 minutes East 186.6 feet to the centerline of the aforesaid U.S. Highway 4231; thence South 24 degrees East 1.57.33 feet to the point of beginning, containing 0.619 of an acre, more or less. This ordinance takes effect upon passage.
