A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF TEMPLE CITY CON-
FIRMING RESOLUTION NO. 66 -203PC
OF THE PLANNING COMMISSION AND
DENYING A VARIANCE.
THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES
RESOLVE:
SECTION 1. The City Council finds and determines that
there has heretofore been filed Application No. 66 -186; that
after a public hearing thereon the Planning Commission denied
such variance by Resolution No. 66- 203PC; that such decision
of the Planning Commission was appealed to the City Council,
and that a public hearing has been held on such appeal.
SECTION 2. That based upon such hearing and the record
the City Council does hereby confirm Planning Commission
Resolution No. 66 -203PC and does hereby deny said variance
application No. 66 -186 for the following reasons:
1. that the City presently has an ordinance pro-
viding that all lots front upon a public street;
2. that applicant proposes to create lots which do
not front upon a public street;
3. that applicant's property is not unique, but is
similar in material respects to other properties
in the area and in the City generally;
4. that there are no topographical nor other
special circumstances relating to such property
which would justify a deviation from the ordi-
nance;
S. that the ordinance requiring frontage is
reasonable and consistent with good planning
to provide for proper development of the
community;
6. that the grant of such variance would be the
dispensing of a special privilege to the
applicant not available to other property
owners in the area;
7. that the existence of prior non - conforming
uses granted prior to incorporation or by
previous city councils does not justify the
continuation of improper policy;
8. that the approval of the neighborhood by
petition is not justification for the grant
of this variance;
9. that there would be no special hardship upon
the applicant by the denial of the applica-
tion in that they may continue to use the
property for reasonable purposes or may
subdivide consistent with the existing
ordinances of the City; and

10. that a deviation from the established
policy of frontage lots would be detri-
mental to the general plan of the
community and would not be consistent
with the highest and best use of the
property.
SECTION 3. The City Clerk shall certify to the
adoption of this Resolution.
