LOUIS SEWER DISTRICT January 11, 2018 at 5:00 p.m. The Trustees of the District met in Room 109 at 2350 Market on the above date. Present at the meeting were: Board of Trustees Staff Members J.P. Singer Also present were: Trustee Faul called the closed meeting to order at 4:02 p.m. The motion was approved by Trustee Yates and seconded by Trustee Mandel. Trustee Faul made a motion to come out of closed session at 4:32 p.m. Trustee Faul called open session to order at 5:00p.m. and asked for the approval of the December 14, 2017 Journal of proceeding minutes. The motion to approve the Journal was made by Trustee Yates and seconded by Trustee Mandel. Comments by Board Chair: None ~ ~ ~ ~ ~ Report of Board Committees: Trustee Singer reported that The Finance Committee met on January 3, 2018 with Trustees Faul, Yates, Singer, Mandel and Dunlap in attendance. The minutes from the October 31, 2017 meeting were approved. Trustee Dunlap abstained. The first item discussed on the agenda authorized staff to modify the District’s Customer Assistance Program renewal period from annually to every two (2) years. This is Ordinance #14867 on tonight’s agenda. The next item on the agenda was a staff request to transfer remaining balances from the Operation, Maintenance and Construction Improvement Funds of Fountain Creek, North Affton, North Kinloch, and Shrewsbury Branch of River Des Peres, to the Stormwater Maintenance Fund. This will be Resolution # 3393 on tonight’s agenda. Next on the agenda was a staff review of the District's Operating Fund Portfolio as of December 29, 2017. Staff indicated that the portfolio is in compliance with the District’s Investment Policy. The purpose of this project is to reduce electronic storage of redundant, obsolete, and trivial information and to identify MSD business records that need to be retained. This will be Ordinance #14868 on tonight’s agenda. Next, PFM Group discussed the transaction highlights of the 2017A Senior Revenue Bond issue and stated the sale of series 2017A Bonds was well received by the bond market. The meeting adjourned at 9:35 a.m. The next tentatively scheduled meeting is Tuesday, January 30, 2018. This concludes the Finance Committee Report. ~ ~ ~ ~ ~ Trustee Yates reported that The Program Management Committee met on January 3, 2018 at 8:00 a.m. The meeting was attended by Trustees Yates, Mandel, Singer, Faul and Dunlap. The minutes of the December 5, 2017 meeting were approved. The agenda items to be introduced tonight were presented and discussed, including a detailed discussion regarding the following items: Ordinance No. 14857 – Lackland I/I Reduction – Staff provided details on the request for supplemental construction funds for this project. Staff explained additional permit requirements from St. Louis County regarding asphalt pavement type. The County was requesting “superpave”, a more durable pavement type on certain roadways on the project. Other pavement types were also experienced during construction not identified during the project design. These requirements were not part of the original bid and therefore caused an increase cost not provided for in the original appropriation. Staff discussed the process for which this could be avoided on future projects. Ordinance No. 14865 – Linden Storm Sewer – Staff requested authorization to proceed to condemnation efforts to acquire permanent easements and temporary construction licenses on five properties impacted by this project. This project provides for the construction of approximately 1300 lineal feet of large diameter storm sewers to alleviate building and basement flooding to homes on East Linden and Terrace Drive in the City of Richmond Heights. There are a total of twenty-five easements and temporary construction licenses required; all but five have been acquired. Staff discussed the various stages of contact with the remaining five properties. Staff then answered questions from the Committee regarding stormwater impacts from the adjacent Highway 40/64 and coordination with other agencies such as Missouri Department of Transportation. Resolution No. 3395 - Stipend Payments for Design-Build projects – Staff provided details of the resolution and answered questions from the Committee on benefits to MSD and ratepayers in providing stipends to proposers, and the typical amount of the stipends. There was a discussion on the cost benefits and cost comparison of Design Build procurement to traditional Design-Bid-Build procurement methods. Other Business: Staff gave a brief presentation on radiological contamination on Coldwater Creek, as previously requested by the Trustees. Staff provided a brief history and cause of the issues and explained the Federal Governments role in the clean-up efforts. Staff explained MSD’s specific role in monitoring the area streams only for discharges regulated by the District’s Wastewater and Stormwater Permits issued by the State. This does not include the radiologic discharge. Staff provided the Committee additional reference material available for the U.S. Army Corp of Engineers Formerly Utilized Sites Remedial Action Program (FUSRAP). The meeting was adjourned at 9:00 a.m. The next Committee meeting is tentatively scheduled for Tuesday, January 30, 2018 at 8:00 a.m. ~ ~ ~ ~ ~ Comments by the Executive Director: None Comments from the Public: Edited 4/18/18 Pg. 3 Randy Stroede: Addressed the Board regarding his concern relating to the sanitary storage tanks along the area of Pardee Lane in Crestwood Mo. and passed out documents to the Board. Mr. Pardee outlined his interactions with MSD about the denied buyout of his home and how his home will be affected by the storage tank location. Mr. Pardee asked the Board to consider including his home within the buyout process, as he was out of town during the community talks that detailed the project. Trustee Mandel asked Mr. Stroede if he had obtained an appraisal and if he was trying to sell his property and Mr. Stroede answered Yes. Trustee Faul informed Mr. Stroede that MSD will investigate his situation further and would be in contact soon. More information will be provided at the next Program Management Committee meeting and the item is expected to be placed on February’s agenda for consideration for adoption. The Secretary Treasurer asked if there were any board members who would like to pull any item for a separate vote within the Consent Agenda. Hearing none, there was a motion for adoption. Singer-aye; Edited 4/18/18 Pg. 9 New Business Name ORDINANCES Introduction of Proposed Ordinance 14855, Authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into an agreement with Jubilee Community Church for cost sharing for green infrastructure construction in CSO Volume Reduction Green Infrastructure – Jubilee Community Church (12772) in the City of St. Louis, Missouri. Proposed Ord. No. 14855 was presented and read. This ordinance authorizes the District to enter into an agreement with Jubilee Community Church to provide financial assistance through a Green Infrastructure Grant Program for construction of green infrastructure. The purpose of this project is to reduce combined sewer overflows into the Mississippi River per the Long Term Control Plan. This project will reduce runoff volume with the installation of a rainwater harvesting system. Total cost of the project is estimated at $325,000 and Jubilee Community Church is requesting approximately $325,000 reimbursement for the cost of green infrastructure. This project has been approved by the MDNR/EPA as an early action project under the conditions outlined in the Long Term Control Plan. Singer-aye Introduction of Proposed Ordinance 14856, Authorizing the Executive Director and Secretary- Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into an agreement with Waterway Gas & Wash Company for cost sharing for green infrastructure construction in CSO Volume Reduction Green Infrastructure – Waterway Gas & Wash (12979) in the City of St. Louis, Missouri. Proposed Ord. No. 14856 was presented and read. This ordinance authorizes the District to enter into an agreement with Waterway Gas & Wash Company to provide financial assistance through a Green Infrastructure Grant Program for construction of green infrastructure. The purpose of this project is to reduce combined sewer overflows into the Mississippi River per the Long Term Control Plan. This project will reduce runoff volume with the installation of bioretention basins and underground detention. Total cost of the project is estimated at $150,000, and Waterway Gas & Wash Company is requesting approximately $150,000 reimbursement for the cost of green infrastructure. The work to be done under Contract #20440 consists of the construction of approximately 2,501 lineal feet of storm sewers varying in size from 8-inches to 18-inches in diameter and appurtenances, and the removal of private inflow sources at 28 properties. This construction is the second phase of a multi-phase improvement program. The purpose of this project is to reduce inflow/infiltration (I/I) in the Coldwater Creek watershed, reduce building backups, and relieve overcharged sanitary sewers. Proposed Ord. No. 14858 was presented and read. The work to be done under Contract #21629 consists of the construction of approximately 800 lineal feet of 12-inch diameter storm sewers and appurtenances, and the removal of inflow sources from 113 private properties. The purpose of this project is to reduce inflow/infiltration (I/I) in the Gravois Creek watershed, reduce building backups, and relieve overcharged sanitary sewers. Singer-aye Introduction of Proposed Ordinance 14859, Appropriating Six Million Five Hundred Thousand Dollars ($6,500,000.00) from the Sanitary Replacement Fund to be used for sanitary sewer rehabilitation in Deer Creek Public I/I Reduction (2018) Contract A (12039) in the Cities of Brentwood, Frontenac, Huntleigh, Ladue, Richmond Heights, Rock Hill, Town & Country, University City, Webster Groves, the Village of Westwood, and Unincorporated St. Louis County, Missouri; and authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to enter into Contract No. 21553 with Insituform Technologies USA, LLC for the aforesaid sanitary sewer rehabilitation. Proposed Ord. No. 14859 was presented and read. The work to be done under Contract #21553 consists of the construction of approximately 100,681 lineal feet of sanitary sewers varying in size from 6-inches to 36-inches in diameter utilizing cured-in-place pipe (CIPP) methods, the rehabilitation of approximately 3,834 vertical feet of manhole utilizing cementitious liner methods, the repair of 2,514 sanitary sewer connections, and 26 point repairs. The purpose of this project is to reduce inflow/infiltration (I/I) in the Deer Creek watershed. This project is scheduled to be completed in 1,141 days. Proposed Ord. No. 14860 was presented and read. The work to be done under Contract #21633 consists of the construction of approximately 257 lineal feet of 12-inch to 27-inch diameter storm sewers and appurtenances, and the removal of inflow sources from 56 private properties. The purpose of this project is to reduce inflow/infiltration (I/I) in the Mattese Creek watershed, reduce building backups, and relieve overcharged sanitary sewers.
