The minutes of the August 5, 2014 meeting were approved. The agenda items to be introduced tonight were presented and discussed, including a detailed discussion regarding the following items: Items 27 through 33 – CSO Volume Reduction Green Infrastructure – Staff briefed the Committee on the overall Green Infrastructure program and appropriations and projects executed over the past several years. Staff then provided details for the fiscal year 2015 appropriation and six project agreements on tonight’s agenda as part of the early action green infrastructure program. Staff answered questions on the relative size and the maintenance of the green infrastructure facilities. The Committee inquired as to whether MSD would be capturing the construction of the St. Louis Food Roof Farm on video. Staff indicated that MSD would provide information on the program through Project Clear. Staff committed to the Committee to document this project and others and update the Committee at a later meeting. Item 34 – Forest Brook Sanitary Relief – Staff discussed the evaluation of the single bid received on this project. Staff indicated that there were a total of four contractors interested in the project. Staff inquiries to the other bidders revealed extensive management requirements for the numerous sites, and current workload as the reasons for not submitting bids for the work. Staff recommended proceeding with the single bid from Fred M. Luth and Sons that was slightly above the design estimate and within budget for the project. Items 39 through 41 – RDP Tributaries CSO Controls and Lower Meramec System Improvements – Staff provided appropriation and project details associated with the final Watershed Engineering Design contract for delivering the District’s CIRP and Consent Decree program. Staff detailed the selection process and the selection of HDR Engineering for the project. Staff provided details of the required 20% MWBE participation for the project in light of the fact there were no MWBE subcontracting goals for the project. The Committee asked if the District still tracked MWBE participation on projects with no specific goals. Staff confirmed that participation on all projects was tracked regardless of required goals. The meeting was adjourned at 8:30 a.m. - - - - Mr. Berry reported that the Stakeholder Relations Committee met on Thursday, August 21, 2014 at 8:30 a.m. The meeting was attended by Trustees Berry, Bonner, Faul and Mandel. The first agenda item was a discussion by Mr. Hoelscher regarding presentations by organizations for the Rate Commission. There are six positions open and invitations have been sent to various organizations soliciting interest in a seat on the Commission. The Mound City Bar Association has expressed an interest in joining the Commission. Two of the Association's members, Annette Slack and Kendra Howard, gave a presentation providing information on the Association and submitted their formal request to join the Commission. There is no Board action required at this time. The next item on the agenda was a quarterly update from Ms. Paredes on the District's Diversity Initiatives, the status of the Disparity Recommendations and District projects involving MWBE goals. Quarterly updates will continue to be forthcoming. There is no Board action required at this time. Next on the agenda was a presentation by Ms. Edwards regarding Job Training Program Services and Third Party Monitoring Consulting Services. In accordance with Sections IV and IX.C of the Community Benefits Agreement, these services will provide occupational training programs and independent third party monitoring services to assist in meeting vendor and workforce diversity goals. Staff requested approval to place two ordinances authorizing contracts to provide these services on the September Board agenda. They are Items Nos. 43 and 44 on tonight's agenda. There were no other items for discussion. The meeting was adjourned at 9:45a.m. - - - - Ms. Bonner reported that the Finance Committee met on September 9, 2014, with Trustee Faul in attendance. The minutes from the August 12, 2014 meeting were approved. Item 49: Pavilion Resolution. This resolution authorizes the staff to exercise an additional one-year contract option with Pavilion Advisory Group, Inc. to provide investment consulting services through the quarter ending September 30, 2015. Portfolio Update. Mr. Tim Snoke reported on the District’s Operating Fund Portfolio as of August 31, 2014. Items 45-47: Collection Litigation Firm Contracts. These ordinances authorize the District to exercise an emergency clause to provide a contract for collection litigation services with Kramer & Frank, PC, The Law Offices of John G. Heimos, PC, and Gusdorf Law Firm, LLC. These contracts will provide continuity of legal services through the implementation process to upgrade the District’s Billing System September 1, 2014 – June 30, 2016. The staff requested and the Committee recommended these contracts be brought forward as an introduction and adoption to achieve the needed continuity. The meeting adjourned at 8:18 a.m. The next regularly scheduled meeting is Tuesday, October 7, 2014 at 8:00 a.m. - - - - The Executive Director reported that Item No. 48 on tonight’s agenda consists of the appointment of 6 organizations to fill the vacancies in MSD’s Rate Commission. MSD’s Board of Trustees is tasked with selecting Rate Commission Representative Organizations as to insure a fair representation of all users of the District’s services. Once selected, these organizations will appoint Rate Commission delegates to represent them at the Rate Commission proceedings. The Rate Commission consists of 15 representative organizations. 9 organizations currently hold unexpired terms on the Rate Commission and will participate in the Rate Commission proceedings scheduled to start in the last half of September. 5 of these organizations are in the Class of 2015 and include the Associated General Contractors, the St. Louis Regional Chamber, the West County Chamber of Commerce, the Greater St. Louis Labor Council, and the Engineer’s Club of St. Louis. 4 of these organizations are in the Class of 2017 and consist of the Cooperating School Districts, The League of Women Voters of Saint Louis, the Missouri Botanical Garden, and the St. Louis Council of Construction Consumers. This leaves 6 expired or vacant positions on the Rate Commission. 5 new organizations are needed to fill the new Class of 2019 and one new organization is needed to fill a vacant position in the Class of 2017. MSD advertised for these vacancies in March of 2013 and again in May of 2014. Advertisements were placed in the Post-Dispatch and Suburban Journals, the St. Louis American, the St. Louis Countian and Daily Record, the Webster-Kirkwood Times, the St. Louis Business Journal, the Call Newspapers, the St. Louis Chinese American, the St. Louis Sentinel, the Red Latina, the Arch City Chronicles, and the Limelight. Positive responses were eventually received from 4 previous Rate Commission Organizations. These include the Home Builders Association of Greater St. Louis, the Missouri Industrial Energy Consumers, the Missouri Coalition for the Environment, and the St. Louis Municipal League. Positive responses were also received from four other organizations. These include North County Incorporated, Lutheran Senior Services, RISE, and the Mound City Bar Association. The agenda to be considered by the Board this evening indicates the appointment of the Missouri Coalition for the Environment, the Missouri Industrial Energy Consumers, North County Incorporated, the Mound City Bar Association, and the St. Louis Municipal League to the Class of 2019. It also identifies the Lutheran Senior Services as filling the vacant position in the Class of 2017. In order to have a fully staffed Rate Commission at the start of Rate Commission proceedings later this month, staff is requesting that the Board of Trustees consider introduction and adoption of Item No. 49 on tonight’s agenda. - - - - Ms. Gloria Nickerson of University City addressed the board and stated this is not her first time speaking to the Board. She is very agitated with flooding issues that started in 2008. MSD did an S & P Program in her front yard but she commented it did not work as she flooded six months later in 2009 and again in 2011, 2013 and on September 9 & 10, 2014. Ms. Nickerson continued explaining that the District installed a pump in her front yard in April 2014. She noted the yard has not been restored properly as it has not been sodded. She said that the flooding in her basement on September 9 & 10 came through the glass block basement window instead of the floor drain and happened due to the front yard not being restored. She asked what can be done about her situation. Mr. Hoelscher stated this is the first MSD has heard that the work in her yard caused flooding. Ms. Nickerson said she called on Tuesday and has not heard back. She further spoke with the engineering department earlier in the summer about the sodding and now understands it will be sodded at the end of the month. She stated her backyard flooded this time and she does live near the southwest branch of River Des Peres. Mr. Hoelscher commented the rainfall of September 9 was a 25 year event as 1.9 inches fell in 30 minutes and on September 10, 1.1 inches fell in 30 minutes for a two year event but the ground was already saturated and water was in the channel. He said University City is trying to work with the residents located in the flood plain to create a program to resolve the issue. Mr. Hoelscher explained MSD is working on returning all the calls from the recent rain event. MSD received over 150 calls. He commented that overland flooding of homes located in a floodplain is an issue that needs to be resolved by those who control the floodplain and in this instance that is University City. MSD will cooperate with them as much as possible but it is a difficult situation for homes built and remaining in a floodplain when there are extensive rains. The Board asked if the specific complaint regarding grading of the yard had been addressed. Ms. Nickerson said the contractor told her it was best to lay sod in the fall and that the sod will be installed by the end of the month. She wants it to be on record that it is unfair and unprofessional to work in someone’s yard and leave it for months without restoring. She also said the initial contractor was rude, tied up traffic on her street, and did not use proper signage. The Board stated they feel badly for her frustration and directed Staff to follow up with her. Mr. Hoelscher said Staff will take up each issue still outstanding to give what MSD feels is the correct and best resolution for her. He believes sodding in September is typical due to summer heat and told the Board he will have answers for them at the next regularly scheduled meeting. Ms. Nickerson stated for the record she is not saying MSD has done nothing because that is not true. She just wants the problem to be solved. Mr. Hoelscher asked Mr. Jonathon Sprague, Director of Operations, to meet with Ms. Nickerson after the Board meeting. - - - - CONSENT AGENDA ADOPTION OF PROPOSED ORD. The work to be done under Contract #20196 consists of an equipment supply contract to be turned over to a contractor for installation. The equipment to be procured is seven incinerator scrubber units and appurtenances. The purpose of this project is to construct incinerator scrubber improvements to meet new regulatory emission standards. This project is scheduled to be completed in 510 days.
