PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR QUINN President Wissel presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Kelley Cruse - Nicholson, Bruce Wissel, Clay Miller, Bing Welch, Larry Parker, Robert Goodwin, Diana Pappin and Phil Quinn. APPROVAL OF MINUTES Councilor Miller moved to amend the Memorandum of Proceedings of March 9, 2009 to reflect Mr. Miller as Vice President presiding over the meeting, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. Councilor Welch moved to approve the Memorandum of Proceedings of a Committee of the Whole on March 9, 2009 and the Minutes of the regular meeting of March 16, 2009, supported by Councilor Quinn. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS ■ TBK PRESENTATION —JUN SUGIBUCHI, PLANT MANAGER & MICHELE LINDSEY — TBK is very appreciative of the cooperation with the City of Richmond. Seven new projects are planned to begin in the next year with 30 employees being added. ■ REVISED RESOLUTION NO. 3 -2009 —A RESOLUTION ALLOWING A LATE FILED STATEMENT OF BENEFITS FORM FOR A TAX ABATEMENT FOR INNATECH, LLC. Presented by Tony Foster, Director of Metropolitan Development, this revision is to correct a typographical error in the original Resolution. Resolution No. 3 -2009 is amended to reflect Ordinance No. 22 -2008 in lieu of Ordinance No. 23 -2008. Councilor Miller moved to approve Resolution No. 3 -2009, supported by Councilor Parker. Upon a vote viva voce, the motion passed. ■ RESOLUTION NO. 4 -2009 — A RESOLUTION OF RICHMOND COMMON COUNCIL SUPPORTING ARTS PLACE, INC.'S MULTI - COUNTY ARTS COUNCIL Presented by Kim Vessels, Assistant City Attorney, this Resolution would allow Arts Place to serve as a "pass through" agency for funds to be received from a grant to support local arts organizations. Councilor Pappin moved to approve Resolution No. 4 -2009, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Common Council Minutes April 6, 2009 Page 2 of 4 COMMUNICATION FROM THE MAYOR ■ PROCLAMATION FOR ALCOHOL AWARENESS MONTH — Mayor Hutton presented a Proclamation to be signed by members of the Common Council to the Peer Helpers of Richmond High School. Members of the group made a presentation of the many activities of their organization. There will be a public blood drive on April 10. The public is invited and encouraged to make an appointment to donate blood. ■ Mayor Hutton distributed maps for the Spring Clean Up which begins April 18. The schedule is: Week of April 18: Elizabeth Starr, Starr Parkside, Vaile and Olde Richmond Week of April 27: Southside Neighborhood and South Richmond Week of May 4: Fairview and North Richmond Week of May 11: Reeveston Week of May 18: Joseph Moore, Parkview, Westview, Baxter, Rose Hamilton and JFK • The Street Tree Commission was established 20 years ago • Richmond is an All American City finalist • The Fireworks will be on July 4 with a rain date of July 5 • According to the Economic Advisory Commission, 500 jobs have been saved in our area since December 2008 REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the March 13, 20 & 27, 2009 meetings were accepted as presented. Councilor Quinn commended the Richmond Police Department for purchasing seven police cars locally. REPORTS FROM DEPARTMENT HEADS, STANDING COMMITTEES, SPECIAL COMMITTEES and /or ORGANIZATIONS None MISCELLANEOUS BUSINESS None ORDINANCES ON FIRST READING None ORDINANCES ON SECOND READING ORDINANCE NO. 1 -2009 — A GENERAL ORDINANCE AMENDING CHAPTER 74 OF RICHMOND CODE REGARDING PARKING FACILITIES The Clerk read Ordinance No. 1 -2009 on second reading by title only. The Board of Public Works and Safety approved the elimination of hourly fees associated with parking in the Parking Garage and deletion of reference to Parking Lot J because it is no longer owned by the City. This Ordinance would amend Chapter 74.47 of the Richmond Code to reflect the changes. Common Council Minutes April 6, 2009 Page 3 of 4 Council President Wissel declared Ordinance No. 1 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 1 -2009, supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 1 -2009 to third and final reading and suspend the rules and read by title only, supported by Councilor Welch. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 1 -2009 on third reading by title only. Ordinance No. 1 -2009 was adopted with a 7 -2 roll call vote. Dissenting were Councilors Pappin and Quinn. ORDINANCE NO. 4 -2009 — A GENERAL ORDINANCE AMENDING CHAPTER 91: ANIMALS OF THE CITY OF RICHMOND CODE The Clerk read Ordinance No. 4 -2009 on second reading by title only. This Ordinance would amend Chapter 91 of the Municipal Code. Chapter 91 contains provisions regarding animals and animal control. Councilor Pappin moved to amend Section 91.01(k) by deleting ...more than three (3) dogs or three (3) cats... from the first sentence, supported by Councilor Goodwin. This amendment was approved with an 8 -1 roll call vote. Dissenting was Councilor Welch. Councilor Miller moved to amend Section 91.02(b) as follows: The last sentence should read The humane society shall keep a percentage of any proceeds collected as reflected in Section 91.13 to assist the humane society with any administrative costs and costs associated with its sterilization program, supported by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Quinn pointed out the paragraph lettering in Section 91.02(b) -(g) were incorrect and moved to re- letter them (c) -(h), supported by Councilor Welch. Upon a vote viva voce, the motion passed. Councilor Quinn moved to amend Section 91.04(b) to read either continuously for 15 minutes . . supported by Councilor Cruse - Nicholson. Upon a vote viva voce, the motion passed. Councilor Quinn moved to delete Section 91.17 in its entirety, supported by Councilor Miller. This amendment was approved with a 5 -4 roll call vote. Dissenting were Councilors Elstro, Cruse Nicholson, Welch and Goodwin. Council President Wissel declared Ordinance No. 4 -2009 as amended on second reading and public hearing. Speaking to the Ordinance were Chris Hemphill, Tim Gillian, Angela Yukon, Melody Truitt, Joyce Luckett, Linda Miller, Tim Dale, Michelle Freeland and Robert Yukon. Councilor Elstro moved for engrossment of Ordinance No. 4 -2009 as amended, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Pappin moved to advance Ordinance No. 4 -2009 as amended to third and final reading and suspend the rules and read by title only, supported by Councilor Miller. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 4 -2009 as amended on third reading by title only. Ordinance No. 4 -2009 as amended was adopted with a 6 -3 roll call vote. Dissenting were Councilors Cruse - Nicholson, Miller and Welch. Common Council Minutes April 6, 2009 Page 4 of 4 ORDINANCE NO. 12 -2009 — AN ORDINANCE RE- ESTABLISHING THE CITY OF RICHMOND CUMULATIVE CAPITAL DEVELOPMENT FUND The Clerk read Ordinance No. 12 -2009 on second reading by title only. This Ordinance would re- establish the Cumulative Capital Development Fund beginning in the year 2010. Council President Wissel declared Ordinance No. 12 -2009 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 12 -2009, supported by Councilor Parker. Upon a vote viva voce, the motion passed. Councilor Elstro moved to advance Ordinance No. 12 -2009 to third and final reading and suspend the rules and read by title only, supported by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 12 -2009 on third reading by title only. Ordinance No. 12 -2009 was adopted with a 7 -2 roll call vote. Dissenting were Councilors Miller and Pappin. ORDINANCES ON THIRD READING None CALL FOR ADJOURNMENT There being no further business, on a motion duly made, seconded and passed, the meeting was adjourned.
