Present: Mayor, Thomas Anderson; Ccuncilmembers Wilfred Scherer, Stephen Schmit, Anne Thies, Robert Mitchell; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Hurr; Public Works Director, James Dillman; Engineer, Glenn Cook; Attorney, ron Batty 1. ADDITIONAL AGENDA ITEMS Moved by Scherer, seconded by Theis to discuss the following additional items: Permit for Minnegasco to install gas lines along Lakeshore Ave. Permit for U.S. Sprint to install fiber-optic cable along the Soo Line Railroad Motion declared carried 2. MINUTES OF MAY 5, 1987 Moved by Scherer, seconded by Schmit to approve minutes of May 5, 1987, as presented. Motion declared carried 3. POLICE UNION CONTRACT Thomas Anderson stated that the contract that the Council is being asked to approve is similar to the earlier version, except that there is now a section regarding maternity leave. Moved by Scherer, seconded by Theis to approve the 1987-89 police contract, as presented, including the amendment. Motion declared carried 4. ELM CREEK ADDITION Jim LUtz, developer of Elm Creek Addition, discussed his concerns regarding the speed of traffic through the subdivision, along with the need for a stop sign at the intersection of Elm Creek Dr. and Hamel Rd. He also asked if Council would consider authorizing a street light at the intersection. Terry Bender, Peter Falkum, and Lee Phillippe, residents of the subdivision also spoke of their concerns regarding speed and the need for police patrol to enforce the speed limits. Moved by Scherer, seconded by Theis to install 20 mph speed signs on Elm Creek Dr. plus a stop sign and street light at the intersection of Hamel Rd. and Elm Creek Dr. Motion declared carried Donna Roehl stated that she would send a letter to each of the residents asking for their cooperation. 5. PUBLIC WORKS DEPARTMENT Minnegasco Moved by Theis, seconded by Schmit to adopt Resolution 87-36, allowing Minnegasco to install gas lines along Lakeshore Ave. at Independence Beach. Motion declared carried U.S. Sprint Moved by Theis, seconded by Schmit to adopt resolution 87-37, allowing U.S. :Sprint to install fiber-optic cable along the Soo Line Railroad tracks. Motion declared carried * CONSENT AGENDA 6. PLANNING AND ZONING DEPARTMENT * Irene Leuer, Subdivision Moved by Schmit, seconded by Theis to adopt Resolution 87-38, granting preliminary subdivision approval to Irene Leuer to subdivide property on Medina Rd. Motion declared carried * Metropolitan Waste Control Commission Moved by Schmit, seconded by Theis to adopt Resolution 87-39, granting a Gon1litional Use Permit to the Metropolitan Waste Control Commission to construct a building at the Hamel Lift Station. Motion declared carried * United Sprinkler,Conditional Use Permit Moved by Schmit, seconded by Theis to adopt Resolution 87-40, granting a Conditional Use Permit to United Sprinkler to construct an addition to their building at 172 Hamel Rd. Motion declared carried * Temroc, Conditional Use Permit Moved by Schmit, seconded by Theis to adopt Resolution 87-41, granting a Conditional Use Permit to Temroc to construct a manufacturing/office/warehouse at Willow Dr. and Hwy. 55. Motion declared carried Peterson/Johnson, Subdivision JoEllen Hurr stated that items 3 and 8 of the preliminary resolution have been complied with. Moved by Scherer, seconded by Schmit to authorize preparation of a resolution granting final subdivisionapproval to the Peterson/Johnson subdivision on Tamarack dr. Motion declared carried B and D Machine JoEllen Hurr recommended that $15,000 of the funds posted by B pletion of their project, be released, with the city retaining final approval is given. Moved by Theis, seconded by Schmit to release funds to B and D by the Zoning Administrator. Motion declared carried and D Machine, for com- $4025 of the funds until Machine, as recommended Load Limits on City Streets Jim Dillman stated that Ebert Construction wishes to haul 20 loads of fill to a site, to be leveled for building purposes. He stated that the cities policy will only allow 2 loads of fill to be hauled on a city street. He believed that a hauler should have the ability to haul:_ 300 cubic yards of fill, before a permit was needed. Anne Theis stated that Mr. Ebert had told her that constructing a long driveway would take more than 2 loads of fill. Robert Mitchell asked if the policy should be revised to allow for hauling of small amounts of material for such construction jobs. Wilfred Scherer stated that a hauler would need to be able to control the dust if a number of loads of material were hauled. Moved by Mitchell, seconded by Scherer to allow Ebert Construction to haul 20 loads of dirt on city streets, provided that dust be controlled, if it becomes a problem. Motion declared carried Robert Mitchell asked that an overall change in policy be postponed until the policy is reviewed by staff and Council. 7. TAX INCREMENT DISTRICT 1-5, PUBLIC HEARING, 8:00 P.M. Jeanne Frederick suggested that the Public Hearing on the establishment of District 1-5 be continued until such time as the property involved is subdivided and values could be placed on individual parcels. Thomas Anderson asked if Council wished to discuss tax increment assistance to Temroc Metals, which will be built on one of the parcels. Robert Mitchell stated that although the city is approving the Conditional Use Permit for Temroc Metals there is no guarantee that Tax increment financing assistance will be granted. Moved by Mitchell, seconded by Theis to continue the Public Hearing regarding Tax Increment District 1-5, until June 2, 1987. Motion declared carried '131 62 8. COUNTY ROAD 116 EXTENSION Thomas Anderson explained that he would allow 15 minutes for each group to present information on either extension of Co. Rd. 116; an alternate paving program or allowing roads to remain unpaved. Jeanne Frederick presented information, prepared by staff, on the financial impact of the Capital Improvement program, along with the tax impact on properties of various value. Glenn Cook presented information on the various street projects that would be completed under the program and assessment information for individual property owners directly affected by the projects. Robert Mitchell thanked staff for all of the work they had done and explained that the program had been prepared because there was a strong push for some sort of north/south road. Nancy Olkon stated that she had spoken to County staff and Commissioners and had been told that there was no interest, on their part, in constructing a road. Thomas Anderson explained that such a road had been in the cities Comprehensive Plan and on the books for a long time and that the only way the County would address the road was to approve it to Hwy. 12. Robert Mitchell explained that the Council had not asked that they consider the project. Wilfred Scherer stated that a letter had been sent to the County in July of 1986, with a request for consideration of a north/south road. Robert Franklin explained that an extension of Co. Rd. 116 had been discussed long before any of the present Council had been elected. Anne Theis stated that the County had discussed the road in 1960 and several years ago the City Council had approved the road as far as Co. rd. 24. Joanne Higgins asked what input the citizens had when the road was approved to Co. Rd. 24. Robert Anderson stated that it appeared that only the council was in favor of the road. Thomas Anderson stated that the Comprehensive Plan projected a north/south road and that it needed approval to Hwy.12 if State Aid was to be secured. Mrs. Malikowski stated that she and talked with several Council members and staff at Orono and they were not interested in the road. Tom Ely stated that he has resided in Medina for two years and had been told by the realtor that there would not be a paved road. He expaliend that he wanted peace and quiet and if the road were widened and straightened his property value would decrease. Thomas Anderson asked for comments from those in favor of Co. Rd. 116. William Reid stated that residents of Medina Morningside had paid for streets, sewer and water and that if Willow were paved by the city they would have to pay for some of that work, so he was in favor of having the county do the construction. Emil Jubert stated that the County had talked about the road for 15 years and cars would no longer get muddy if it was built. Jerry Roehl gave background information of the planning, dating back to 1959 and with the Council adopting a resolution in 1977 urging construction of the road and again in 1982 the Council approved the alignment to Co. Rd. 24. He stated that 235 new resident- ial permits had been issued since 1978, which would bring 500-600 additional cars onto city roads. He listed a number of reasons for approving the project: mobility between north and south; safer road than if built by city; more durable and built to 9 ton standards; save $800,000 of city funds plus 3-4 miles of road taken off of the city system which will save $25,000 per year maintenance. He stated that the rural atmosphere of the city is being dimished by people, not roads and the soil conditions and lack of sewer will control development. He stated that he believed that the alternate capital improvement program is too costly and would add an additional mill to the taxes along with assessments to individual property owners. He reported that the City Engineer, three police chiefs of the city, the Chamber of Coulmerce and past city councils of Medina had approved of the extension. He urged Council to approve the project. Orlo Eisinger stated that if the county road was not constructed, traffic would flow into a 30 mph speed zone, whereas with a county road, traffic would flow into Hwy. 55. Robert Franklin stated that some years ago the city got Hennepin County to take over Homestead Tr. which resulted in several less miles for the city to maintain. Thomas Anderson asked for comments in favor of the city paving its own roads. Lyman Wakefiled stated that Hwy. 101 and Co. Rd. 19 are available for north/south traffic and that Co. Rd. 116 would bring traffic from Interstate 494 to 394, with the rural at- mosphere of Medina being ruined. Joanne Higgins stated that the speed would be faster and she did not want to live on a major blacktopped road. She explained that they had paid a lot for their property and pay a lot of taxes to schools even though they have no children in the schools. Martha Van de Ven stated that 300 people had signed a petition against Co. Rd. 116 in only 10 days, so the sentiment of the people must be evident. Madyln Linck stated that emergency response has been rapid as in the case of a fire at their home. Dick Olson stated that he would have 503 ft. of property on a new road that will serve northern Hennepin and Wright County, and that he moved to Medina for the semi -rural atmosphere. Cindy Piper stated that the city will still have to maintain these roads, as a new road will not be built for 10 years. Dawn Lundgren stated that city roads are safer. Joanne Ferris stated that traffic is east and west, not north and south. She stated that Medina also pays the county bills and would be apying for this road. She asked Council to reject the project to maintain the rural atmosphere. Thomas Anderson asked how the cities bond rating would be affected by the Capital Impro- vement project. Jeanne Frederick stated that the city would need to be careful so as not be over bond. Wilfred Scherer asked what would happen to the plan if a well needed to be installed at Independence beach. Jeanne Frederick stated that a well should be added to the program. Thomas Anderson stated that the plan includes a lot of information for future planning. Robert Mitchell stated that he would like to keep Co. Rd. 116 from happening as along as possible and with the city adopting a paving policy for upgrading roads when traffic reaches 600 cars per day the city could control its own roads. He recommended the program to the rest of the Council. Wilfred Scherer stated that when everyone built they took out a little portion of of city and to tell people to use Hwy. 101 or 19 would not make sense as they are 7 miles apart. He asked why those living along the route should be assess when those living on county roads would not be assessed. Anne Theis state that Medina will never develop like Plymouth,because of Medina's soil and lack of sewer. Thomas Anderson stated that the majority of comments against the county road were traffic related, particularly, truck traffic. Doug Olson stated that the 300 voters that signed the petition were a majority of the cities registered voters versus a handful of citizens wanting the road. Anne Theis stated that there are 1688 registered voters in the city. Ron Rogers asked if the tax increment plan would be put aside if the city road paving plan was adopted. Jeanne Frederick staed that up until now tax increment has been used for public improv- ments and that the Temroc Application is the first request for direct funding. Ron Batty asked if the city could maintain its bond rating with the entire program. Jeanne Frederick stated that $100,000 to $200,000 could be used each year for tax increment along with the road paving program. Moved by Mitchell to adopt the prepared Capital Improvement Program. Motion not seconded. Moved by Scherer, seconded by Schmit to request that Hennepin County extend Co. Rd. 116 from Hwy. 55 to the cities southern boundary according to plans submitted. Robert Mitchell stated that the county road would not save the city as much money as believed would be saved and that Council would need to rework the Capital Improvement Budget. Clerk polled the Council. Voting Yes, Anderson, Schmit, Theis, Scherer; Voting No, Mitchell. Motion declared carried Moved by Scherer, seconded by Theis to send letters to Orono, Long Lake and Hennepin County informing them of the cities action. Motion declared carried Voting No, Mitchell Thomas Anderson asked that a new Capital Improvement plan be prepared. 9. WOODLAKE LANDFILL AND ART PEABODY SUBDIVISION Moved by Theis, seconded by Scherer to table the Woodlake landfill report and Peabody subdivdision expense discussion until June 2, 1987. Motion declared carried 10. BILLS Moved by Scherer, seconded by Theis to pay the bills; Order Checks # 5786-5789 in the amount of $1930.09 and Payroll checks # 9789-9806 and 8766-8767 in the amount of $11,766.34.
