RE: Special Public Hearing
The Mayor has called a special public hearing to discuss the text amendment below. The hearing will be
Monday, December 13 at 7:30 pm. This is a simple text amendment and the hearing is really just a formality.
The affected parties (Jack Jordan and John Shoneman) are also expecting approval of the amendment on that
evening. A Quorum Is Absolutely Necessary! I will be asking at the December 7 meeting for volunteers. This
memo will be the only written notice of the meeting.
9.4.1 Use of Single Non -Conforming Lots for One -Family Detached Dwellings
A one -family detached dwelling and customary accessory structures may be erected, occupied, and used
on a separate non -conforming lot of record, not in eontinuous fir ontage with other lots in the same
eA subject to subsection 9.4.2, and in accord with requirements applying in the district.
9.4.2 Rules Concerning Combination of Contiguous Non -Conforming Lots in Single Ownership and with
Contiguous Frontage; Exception
It is the intent of this subsection to require undeveloped non -conforming lots (those having separate,
individual deeds) held in single ownership to be combined with other non -conforming lots to create less
non -conforming lots under the circumstances below, but not to require such combination when it would
be out of character with the way the neighborhood has previously been developed.
a) Where 2 or more undeveloped non -conforming lots in single ownership adjoin and have
continuous frontage, such lots shall be combined to create less non -conforming lots with respect
to minimum lot size, frontage, and setback requirements.
b) Combination of non -conforming, continuous frontage lots in single ownership shall not be
required when all of the following conditions occur. -
I) One or more of the lots contains a principal structure built before February 17, 1986,
2) The existing structure does not cross the property line connecting the two non -conforming
lots,
3) The vacant lot(s) are not less than 50' wide,
4) The lots will be used for one family detached dwellings and customary accessory
structures,
5) A majority of the developed residential lots within 500' of such lots are also non-
conforming with regard to minimum lot size or frontage, and
6) Adequate water and sewer facilities exist or will be installed. to accomodate the small lot
size.
C) Combination is also not required when the non -conforming lot was created by public taking
action or as a result of a court order.

Members Present: Bill Crowther, Pat Shannon, Stuart Munson, Wendy Olson, Sam Jones,
and Ken McLeroy
Staff Present: Margaret Hauth, Planning Director
Chair Crowther called to order a special meeting of the Hillsborough Planning
Board to consider a zoning ordinance text amendment heard at the special public
hearing earlier in the evening.
ITEM #1: Crowther asked the members to formulate a recommendation to the Town Board
regarding the text amendment to no require adjoining non -conforming lots to be
combined in certain circumstances and allow the construction of dwellings on
those previously platted lots. Olson suggested that the amendment would be more
clear if the following was added at the end of paragraph 9.4.2: "The conditions
that determine whether combination of non -conforming lots is required are the
following:"
MOTION: Olson moved to recommend approval of the amendment. Munson seconded.
VOTE: Unanimous
ITEM #9: The meeting was adjourned before 8:00 PM.
