PUBLIC HEARING

CITY OF TEMPLE CITY, CALIF.
DECEMBER 17, 1964
Mayor Merritt called the meeting to order and led the Pledge
of Allegiance to the Flag, followed by the roll call as follows:
PRESENT: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt
ABSENT: Councilmen -None
ALSO PRESENT: City Attorney Shatford, Assessment Engineer Krelle,
Attorney Hodgman of O'Melveny & Myers, ..& City Manager

Mayor Merritt announced the hour of 7:30 o'clock P. M. haw;:
arrived, this is the time and place fixed for the hearing on the asses;_
ment filed in the matter of Vehicle Parking District No. 2 of the City
of Temple City.
City Clerk Woollett presented to the Council the affidavits
of mailing and publication of notice of filing the assessment, follow-
ing which he presented the assessment roll to the Council.
Mr. Hodgman of O'Melveny & Myers, Special Attorneys for the
Parking District, then explained fully the procedure to be followed at
this Hearing.
City Clerk Woollett advised the assessment was prepared by
the Assessment Engineer, ',4illiam Krelle, under his direction as Supt.,.
of Streets. At this time Mr. Krelle, the Assessment Engineer, was
sworn in by the City Clerk.
The Engineer recited his background in preparing assessments
of this nature and stated he prepared the assessment as presented to
the City Council and explained the method and procedure• of so sing,
in answer to questions made to him by Mr. Hodgman, Attorney.
The Engineer further testified that in his opinion the
assessment had been spread upon the lands in the district subject to
assessment in proportion to the benefits to be derived from the pro-
posed acquisition and improvement.
City Clerk Woollett read in full the written protests receiv
ed from the following: 1- Bradner Peterson & Mabel G. Petersen, 1/3
owners of Lots 232, 233 and 248, and owners of Lots 236 and 237, all
of Tract #6561, 2- Pauline Stephanie Riley, Ex. of the Estate of
Pauline Powers Coughran, Deceased, 1/6 of Lots 232, 233 and 248, and
1/2 of Lots 234 and 235, Tract #6561, 3- Harmony Enterprises, J. M.
Musick, Lot 243 and 9 ft. of Lot 242, Tract #6561, 4- Lulu B. Clewett
owner of 1/2 of lots 234 and 235, Tract #6561, 5- Lee R. & Thelma G.
Hill, Lots 278 and 279, Tract #6561.
The Mayor then asked if anyone who had filed a written pro-
test wished to protest orally and the following spoke: Bradner Petersc
Lulu B. Clewett, Lee R. Hill, Mrs. J. M. Musick, all in support of
written protests. Attorney Parrington also spoke concerning the prote
in the Estate of Pauline Powers Coughran,
Mayor Merritt asked if anyone else wished to be heard.
Mrs. James Caringella, joint owner with James Caringella,
of Lots 229, 230 and 231 also spoke protesting the assessment.
Vern Newton, owner of Lots 284 and 285 asked for information
concerning the parking requirements in relation to the development of
his lots in relation to the Parking District. Mr. Krelle, Assessment
Engineer, advised he received credit for his share provided in the.
District toward required parking for his property. No one else wished
to speak.
Attorney Hodgman advised th-e Council since hearing all pro-
tests that they had the power to order changes in assessment if they
so desired, otherwise it is the Council's duty to confirm the assess -
ment as filed, that it is necessary under the committment they have to
purchase the lots and to levy the assessment.

Councilman Nunamaker moved that a l l protests and objections
both written and oral, made or filed in connection with the assessment
filed in the matter of Vehicle Parking District No.. 2 be and the same
hereby are over -ruled and denied, Councilman Dicfasor seconded. There
followed a lengthy discussion by the Councilmen concerning the protest
IIand suggested alternate plans. The roll call vote to carry the motion
was as follows:
AYES: Councilmen - Dickason, Harker, Nunamaker,_ Tyrell, Merritt
NOES: Councilmen -None
ABSENT: Councilmen -None
Attorney Hodgman read title to Resolutton No. 64 -425
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE MY', CALIFORNIA,
MAKING DETERMINATIONS AND CONFIRMING ASSESSMENT i;N MATTER' OF VEHICLE
PARKING DISTRICT NO. 2 OF SAID CITY. Councilman `Nun-maker moved to
adopt Resolution No. 64 -425, Councilman Harker seconded, carried by
the following roll call vote:
AYES: Councilmen - Dickason, Harker, Nunama'ker, Tyrell, Merritt
NOES: Councilmen -None
ABSENT: Councilmen -None
Councilman Nunamaker moved to adjourn, Councilman Tyrell
seconded and carried. Council 4 gj.ourned at 9 :00 P. M.
