HomeMy Public PortalAboutMIN-CC-2002-09-03MOAB CITY COUNCIL REGULAR MEETING September 3, 2002 The Moab City Council held their Regular Meeting on the above date in the Council Chambers of Moab City Offices, located at 115 West 200 South, Moab, Utah. Mayor David L. Sakrison called the Pre -Council Workshop to order at 6:30 PM. Mayor David L. Sakrison called the Regular City Council Meeting to order at 7:00 PM and Police Chief Mike Navarre led in the Pledge of Allegiance. Also in attendance were Councilmembers Gregg Stucki, Kirstin Peterson, Kyle Bailey, Jeffrey Davis and Rob Sweeten; City Manager Donna Metzler, City Recorder/Assistant City Manager Rachel Ellison, City Planner Robert Hugie, City Treasurer Jennie Ross, and Planning and Community Development Director David Olsen. Thirty- six (36) members of the audience and media were present. Councilmember Sweeten moved to approve the Regular Council Meeting Minutes of July 23, 2002. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. There were no Citizens to be Heard. Under City Planning, City Planner Hugie distributed a written report and stated that there would be a South Corridor Planning Meeting the next Wednesday. A Public Works Department Update was not given. A Police Department Update was not given. Mayor Sakrison presented Leticia Bentley with the Adult Lifelong Literacy Award. Mayor Sakrison and Citizen Terry Tempest Williams presented Virginia Fossey with the Utah Humanities Council Mayor's Award. Reva Webber made a presentation regarding a year-round swimming pool. Discussion followed. Mayor Sakrison opened a Public Hearing on the following: 1) Proposed Ordinance #2002-05 — An Ordinance Creating Section 15.40.305 of Chapter 15.40, Title 15, of the Moab Municipal Code Regarding Permission to Create Crawlspaces within the Flood Zone; 2) Solicit Public Input on the Proposed Ballard Subdivision Located at approximately 400 East between Mulberry and Raspberry Lanes; 3) Proposed Ordinance #2002-07 — An Ordinance Amending Section 17.09.530 and 17.09.540 of Chapter 17.09, Title 17, of the Moab Municipal Code Regarding Conditions in General and Conditions for the Approval of Home Occupations at 7:42 PM. Sarah Heffron stated that she is a neighbor to the proposed subdivision and would like to see the community preserved and especially agricultural areas. Ms. Heffron stated that she would urge consideration of a clustered development to leave some of the agricultural land intact. Ms. Heffron stated that Kelly Green had mentioned development of a wildlife corridor along the creeks and she supports that idea. Ms. Heffron stated that she would like the conditions for approval include saving some of the fruit trees and consolidated housing. September 3, 2002 Page 1 of 4 REGULAR MEETING & ATTENDANCE APPROVAL OF MINUTES CITIZENS TO BE HEARD PLANNING UPDATE PUBLIC WORKS UPDATE POLICE DEPARTMENT UPDATE PRESENTATIONS PUBLIC HEARING OPENED ON PROPOSED ORDINANCE #2002- 05, PROPOSED BALLARD SUBDIVISION, PROPOSED ORDINANCE #2002-07 PUBLIC COMMENT Jamie Ballard stated that she is an adjacent land owner and is opposed to losing one of the few remaining agricultural areas and that the community had already lost the Clark Orchard. Ms. Ballard stated that the orchard was a place for animals and that the neighbors like the peace and quiet of the orchard. Ms. Ballard said that she would hate to see the hard work of the Millcreek Pathway Project to be destroyed by a subdivision. Ms. Ballard stated that she thought the housing would be too dense and would add at least 50 cars into the school zone. Ms. Ballard inquired if 25 homes could be supported with water and utilities and stated that there could be an archeological site in that area. Ms. Ballard inquired if there was a green space requirement for the subdivision. Ms. Ballard stated that Earthwalk is adjacent to the proposed subdivision and is a good program and she feels that the proposed subdivision would destroy that program. Ms. Ballard stated that she feels it is ludicrous to put a subdivision at that location. Drew Solmonson stated that he is new to the area and is for the proposed subdivision and thinks it is a great place to raise a family. Mr. Solmonson said that he feels the restrictive covenants will be beneficial to the City and that the home will be beautiful. David Svendson stated that he is concerned about open space and animal corridors and he thinks they should be left intact. Mr. Svendson thinks that there should be more open space and trees. Michelle Wurth stated that she walks on the pathway and loves the fresh peaches. Ms. Wurth stated that there are not many orchards left in Moab and she thinks that public and private funds should go towards preserving this property. Ms. Wurth stated that food is very fuel dependent and local food production should be encouraged. Amber Solmonson stated that she has picked some of the fruit at the orchard and that the majority of the fruit is rotting. Ms. Solmonson stated that the pathway is already eased to the City. Sarah Heffron stated that the development could be designed to preserve agriculture, trees and an animal corridor. Ms. Heffron inquired if the development is paying for itself. Councilmember Bailey stated that the City tries to work with developers to encourage the things Ms. Heffron mentioned and to allow for higher densities. Brian Ballard stated that there are a lot of trees and that he knew he would subdivide the property when he purchased it and that he wants to preserve as many trees as possible. Mr. Ballard stated that he will try to transplant some of the trees and that he has tried to sell the fruit and sells less than 5%. David Engleman stated that he is an adjacent property owner and that he thinks drainage will be a problem and that the proposed subdivision's neighbors will be cows. Jamie Ballard stated that when she was a part owner in the orchard they had contracted to sell most all of the fruit to grocery stores. Ms. Ballard stated that the subdivision is too dense and she would like to see fewer homes and larger lots. Sarah Heffron inquired what the long term plan was to preserve agriculture. PUBLIC COMMENT September 3, 2002 Page 2 of 4 Mayor Sakrison stated that he had conversations with a land trust in Park City and needed more information and would let Ms. Heffron know when he received it. Amber Solmonson stated that she likes the look of the property and thinks that it is beautiful. Mayor Sakrison closed the public hearing at 8:14 PM. Councilmember Bailey moved to approve a refund of a Special Events License Fee to Moab Music Festival in the amount of $80.00. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Bailey moved to approve a Moved -on Structure Permit for Marjorie Wagner and Patrick Rippee Located at 400 North 50 West to Conduct a Temporary Greenhouse. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Davis moved to approve a Moved -on Structure Permit for Highpoint Hummer and ATV Tours Located at 281 North Main Street to Conduct a Vehicle Rental Business. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. City Manager Metzler made a presentation regarding Proposed Ordinance #2002-08 — An Ordinance Amending Certain Provisions of the City of Moab Business Licensing Code. Discussion followed. Councilmember Bailey moved to approve a refund of the Park Reservation fee to Moab Music Festival in the amount of $50.00. Councilmember Davis seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Under Reading of Correspondence, Mayor Sakrison stated that he had a copy of the Economic News of Utah that had a 1,000 day economic plan done by Governor Leavitt. Mayor Sakrison stated that he had received a letter from the Utah State Auditor and that the City had been in substantial compliance with the budget and that the budget had not been adopted by June 22, 2002. Under Administrative Reports, City Manager Metzler stated that she had met with Grand County Water Agency regarding well monitoring and had discussed a compromise regarding which wells were to be monitored. City Manager Metzler also stated that she had been working on higher education issues as well as employee issues. Under Goal Update, Mayor Sakrison read a higher education proposal and discussion followed. Under Mayor and Council Reports, Councilmember Peterson stated that the Water Conservation Committee had contacted her and was frustrated by the lack of community awareness regarding water conservation. City Manager Metzler stated that she had met with representatives from the Sportsmen's Club and had asked for more information. City Manager Metzler stated that she would be working with the club to develop a business plan. Councilmember Davis moved to pay the bills against the City of Moab in the amount of $118,594.52. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. MOTION TO ADJOURN, APPROVED Mayor Sakrison adjourned the Regular Council Meeting at 9:20 PM.
