AN ORDINANCE APPROVING THE PETITION OF
DEPAUW UNIVERSITY TO VACATE PUBLIC
RIGHTS -OF -WAY LOCATED IN THE CITY OF GREENCASTLE,
PUTNAM COUNTY INDIANA
WHEREAS, the Plan Commission of the City of Greencastle, Indiana, did at
its regular meeting held on April 23, 1990, approve the Petition of DePauw
University, for the vacation of certain public rights -of -way located in the
City of Greencastle; and
WHERF,AS, the Common Counci. 1, of the City of Greencastle, Indiana,
pursuant to law, published notice that this matter would come before the
Common Council for public hearing at the regular meeting of the Common
Council to be held on Tuesday, July 10, 1990 at 7:30 o'clock, p.m. at the
Greencastle Middle School, Greencastle, Indiana; and
WHEREAS, the adjoining property owners have consented or have been
notified pursuant to statute as to the vacation of the public rights -of. -way;
and
WHEREAS, the Common Council of the City of Greencastle, Indiana, has
after public hearing determined the relief prayed for in said Petition should
be granted and those portions of the public rights -of -way Located in the City
of Greencastle, Indiana, should be vacated.
NOW, THEREFORE, be it ORDAINED by the Common Council of the City of
Greencastle, Indiana, that the following public rights -of -way located in the
City of Greencastle, Putnam County, Indiana, and more particularly described
as follows:
a. 16 foot alley
located
between Lots 1,
2,
3, and 4
in Hanna
Heights Subdivision
and Lots 3,
4,
and 5
in Voss
Subdivision.
b. 10 foot alley
located
between Lots 9,
10,
11 and 12
in Voss
Subdivision and
Lots
5, 6, 7, 8 and
9
in Hanna
Heights
Subdivision.
c. 16 foot alloy
located
between Lots 1
and
8 and Lots
9, 10,
11, 12, 13,
14, 15,
16, 17, and
18
in Hanna
Heights
Subdivision.
d. Manna Heights Drive (Hanna Court) .
are hereby vacated as public rights -of -way of the City of Greencastle, Putnam
County, Indiana.
This Ordinance shall. have the full force and effect of law immediately
upon its passage by the Common Council of the City of Greencastle, Indiana.
