HomeMy Public PortalAbout17-138 - Amend Responsibilities of UUTCBOC to include Carson Oil Industry Business License Tax RevenuesRESOLUTION NO. 17-138 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARSON, CALIFORNIA, AMENDING THE RESPONSIBILITIES OF THE CARSON UTILITY USERS' TAX CITIZENS BUDGET OVERSIGHT COMMITTEE TO INCLUDE OVERSIGHT OF THE CARSON OIL INDUSTRY BUSINESS LICENSE TAX REVENUES WHEREAS, on March 3, 2009, the voters of the City of Carson approved a measure establishing a temporary Utility Users' Tax, and the measure, among other things, established Carson Municipal Code section 61119; and WHEREAS, Carson Municipal Code section 61119 requires that the City Council appoint a citizens oversight committee to "receive reports from the Tax Administrator at least annually on the implementation of [the Utility Users' Tax], the funds collected, and how funds collected are spent", and also requires that the meetings of the oversight committee be held in compliance with the Ralph M. Brown Act (Cal. Gov. Code§ 54950, et seq.); and WHEREAS, on May 5, 2009 the City Council established the Carson Utility Users' Tax Citizens Budget Review Oversight Committee and this committee meets monthly to review the City Budget; and WHEREAS, there will be a special election held on November 7, 2017 for the purpose of submitting to the voters of the City a measure to establish a business license tax of one-quarter of one percent (0.25%) of gross receipts on persons engaged in the business of operating an oil refinery or facility that stores petroleum products; and WHEREAS, the above-described measure has been labeled "Measure C" for the November 7, 2017 ballot; and WHEREAS, the City Council now desires to include oversight of the Measure C funds in the responsibilities of the Committee, such that the Committee shall perform the same oversight and recommendation functions related Measure C as for the City's Utility Users Tax; and WHEREAS, the City Council now desires to amend the current committee membership to eleven (11) regular members and two (2) alternates. NOW, THEREFORE, the City Council of the City of Carson, California, does hereby RESOLVE, as follows: 1. The City Council intends for this Resolution to describe the responsibilities, functions, and composition of the Carson Utility Users' Tax Citizens Oversight Committee from the effective date of this Resolution. 3. The Carson Utility Users' Tax Citizens Budget Oversight Committee was created effective April 17, 2009, by Resolution No. 09-052, as required by Municipal Code section 61119. 4. The Carson Utility Users' Tax Citizens Budget Oversight Committee shall be deemed a standing committee, subject to the requirements of the "Ralph M. Brown Act". 5. The Carson Utility Users' Tax Citizens Budget Oversight Committee shall also perform oversight and recommendation functions for the Carson Oil Industry Business License Tax (Carson Municipal Code section 63501, et seq.), should such tax measure be adopted by Carson Voters on November 7, 2017 as Measure C, in the same manner and subject to the same requirements as described in Carson Municipal Code section 61119 related to the Utility Users' Tax . Such oversight and recommendation functions shall be in addition to the requirements of Carson Municipal Code section 61119. 6. The Carson Utility Users' Tax Citizens Budget Oversight Committee's membership shall be eleven (11) regular members and two (2) alternates. Except as provided in this Section 6, all other membership requirements shall remain the same and in full force and effect. PASSED, APPROVED, and ADOPTED this 3rd day of October, 2017.
