A RESOLUTION: PRESENTED August 13 ~ 1986 86-163 ADOPTED Ausust 13~ 1987 APPROVING REVISED TERMS OF AGREEMENT FOR THE OPERATION OF A LEESBURG FARMERS' MARKET WHEREAS, this Council authorized an agreement with Market Square Associates, Inc., to manage the Leesburg farmers' market and adopted, rules and regulations for the operation of the market by Resolution No. 86-23; and WHEREAS, this Council adopted revised farmers' market regulations and a revised management agreement by Resolution No. 86-42; and WHEREAS, certain farmers' market producers requested revisions to the farmers' market regulations for the current season; and WHEREAS, these revisions have been endorsed by Market Square Associates, Inc., and the farmers' market representatives: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The revised terms of agreement, dated August 8, 198.6, are approved and shall represent the terms and producers' agreement for the rental of stalls at the Leesburg farmers' market for the producers' season. Sevila, Mayor Town of Leesburg August 8, 1986 REVISED TERMS OF AGREEMF/~ 1. ~.~i~ lu a pr=luaaru-znlymarhat~ For the 1986 season only, qualified producers may supplement their home-grown produce with produce that_they have purchased. All producers must have their applications signed by their local County Extension Agents verifying production capability of the products listed by the applicant. Previous participants who qualify under the Terms of Agreement will be given first priority for stall space. Products to be sold include vegetables, fruits, plants, herbs, flowers, baked goods, honey, cider, preserves, eggs, and wool. No crafts will be sold. 2. The Market will operate on Fridays from 12 noo.. ~%til S p.m .... d a ..... a--~ -- 9 a.m. until 8 p.m. Saturdays from 9 a.m. until 6 p.m. and on Sundays from 12 noon until 6 p.m. No mandatory participation is required. 3. Producers should be set up each day 15 minutes before Market opening time and should have their stalls and adjoining area completely cleaned up within 30 minutes after Market closing. Producers must keep their stalls filled by replenishing their supplies from trucks, etc. Any stall not occupied within 30 minutes after Market opening may be assigned to another registered producer. 4. All product~ ~old mu;t bam ....... ~ ......... ~ ...c cc..ar~ Products must comply with Virginia Food Laws and must be fresh and attractive as determined by the Market Manager. 5. Each producer will pay a seasonal fee of $25.00 for one interior stall or $15.00 for a small end stall. The fee for additional stalls is $10 each up to a maximum of three stalls. If the Market Manager determines that any stalls are vacant due to the lack of qualified producers, he may assign more than three stalls to a single qualified producer. (a) The general objective of the Market is to provide stalls for as many different qualified producers as possible. Up to three producers may share a stall for a single fee, but each must submit an application and one of the three shall be assigned responsibility for the rules and regulations of the Market. If the permit of the responsible producer is terminated, participation of producers sharing the stall may also be terminated. (b) No refund will be made if a producer's permit is revoked for noncompliance with Market Terms of Agreement or if the producer chooses to withdraw from participating in the Market. Fees for stalls rented in mid-season will be prorated. The fee shall entitle the liscensee to the stall area and that area extending east and west of the stall to the drip line of the Market structure. The use of the area on the sidewalk side of the stall shall allow for pedestrian circulation under cover. 6. Market Square Associates is the designated Market Manager and agent for the Town of Leesburg and has the responsibility and authority to approve or deny applications, to manage daily Market operations, and to revoke any producer's permit for violation of the Market Terms of Agreement. The Market Manager may impose additional regulations for efficient operation of the Market so long as they do not conflict with these Terms of Agreement. 7. No personal equipment may be used at the Market, including counters, refrigerators, radios, etc., unless approved by the Market Manager. 8. Signs may be attached to the Market structure when approved by the Market Manager. 9. The Market Manager has the authority to certify the accuracy of weighing and measuring devices. 10. Producers are responsible for keeping their stalls neat and clean. Trash must be placed in designated receptacles. No perishables may be stored under counters. Stalls, adjacent area and storage below stalls must be empty and clean within 30 minutes after closing on each Market day. 11. Proper dress including shoes and shirts is required for producers and their representatives at the Market. 12. Each producer must have available her or his signed permit each day of Market participation. 13. Each producer must adhere to the State Code as it applies to the collection of sales tax.
