ITEM #2: Comments from the Chair. *Committee Reports ITEM #3: Recommendation regarding Woods of Oakdale rezoning (attachment). 101 E. Orange Street P.O. Box 429 (919) 732-2104 ITEM #4: Recommendation regarding of proposed text amendments: a) To allow non -conforming uses to be replaced by other non -conforming uses. b) To clarify the status of driveways in regard to setbacks and being a structure. c) To reduce setbacks for accessory buildings. d) To clarify the need for Certificate of Appropriateness and reference HDC Rules of Procedure (attachments). ITEM #5: Recommendation regarding Minimum Housing Code. ITEM #6: Continued discussion of commercial zoning categories (attachment). ITEM #7: Adjournment. Please call the Planning Department if you cannot attend. 732-2104 or 406-8393 (voice mail, anytime, local call) MINUTES PLANNING BOARD May 4, 1993 PRESENT: Bill Crowther (Chair), Wayne Tilley (Vice -Chair), Cheshire Cole, Kendall Abernathy, Quanda Turner, Leif Deetjen, Louise Evans, Ken McLeroy ABSENT: Wendy Olson, Sam Jones, Robert Murphy (Alternate), Pat Shannon (Alternate) OTHERS: Ray Gronberg, Margaret Hauth Crowther called the meeting to order at 6:32 pm ITEM #2: Crowther called for committee reports. Abernathy provided information concerning the appeal of Western Sizzlin regarding their sign. The appeal was denied. She added that the Board of Adjustment also considered an appeal of a permit denied by the Historic District Commission. She said the appeal had been continued so that both sides could prepare more complete arguments.. ITEM #3: There was no discussion on the Woods of Oakdale Rezoning. MOTION: Deetjen moved to recommend approval of the rezoning. McLeroy seconded. VOTE: Unanimous. ITEM #4a: Text amendment allowing non -conforming uses to be replaced by other non -conforming uses. Hauth explained what this amendment would allow. McLeroy asked if the standard shouldn't be . "equal to or less that" because its difficult to compare uses that may be dissimilar. Crowther and Deetjen concurred. MOTION: McLeroy moved to recommend approval with the amendment to add "equal to or less than" and Deetjen seconded. VOTE: Unanimous ITEM #4b: Text amendment to clarify the status of driveways as non -structures. Hauth briefly described that amendment, saying that the scope had expanded to include fences, walkways, and patios. She noted the intent is to not treat these items as structures. MOTION: Abernathy moved and Turner seconded to recommend approval to Town Board. VOTE: Unanimous. ITEM #4c: Hauth described the amendment to reduce the setbacks for accessory buildings. She noted the current allowance of 8' X 10' buildings 10' from side and rear lines and the public comment received at the public hearing. MOTION: .trowther moved to table it until further input, Tilley seconded VOTE: Unanimous ITEM #4d: Text amendment to introduce a list of minor works to be approved to clarify the use of the Historic District. Hauth said this amendment would refer people to the HDCs Rules of Procedure for exempt and minor works. She added that the HDC is in favor of these amendments. Planning Board May 4, 1993 Page 2 MOTION: Deetjen moved to recommend approval to Town Board and Abernathy seconded VOTE: Unanimous ITEM #5: Hauth explained there was no public comment on the Minimum Housing Code. She also noted that everyone had received a copy in the public hearing packet. McLeroy said that the section requiring basements to be secure of openings animals can get in through might be interpreted to include pet doors. The idea of amending the section was discussed. MOTION: McLeroy moved to amend the section to specifically exempt pet doors and Evans seconded. VOTE: Unanimous MOTION: Deetjen moved to recommend approval as amended and Tilley seconded VOTE: Unanimous ITEM #6: Continued the discussion on commercial zoning. Crowther suggested sending the lists of uses to public hearing in July. He also wanted to solicit input from select members of the community who might have helpful suggestions. He suggested the following people: Mayor and Town Board, former Mayors Cates and Sheffield, developers Horton and Freeland. Hauth suggested sending it to the Historic District Commission and Board of Adjustment for more input. Evans suggested that Elaine Parker and Jack Payne may also be interested. Crowther said that since NB was slated for removal, all owners of NB land should also receive copies. It was agreed that letters should go out as soon as possible so that people could respond before the June meeting so comments could be incorporated before the July hearing. Hauth said Olson had talked about looking at the intent statements. She said that they should be more accurate, less generic, and talk about the relation of the district to others. She also said this is something she could have for the June meeting. Abernathy asked if sales shouldn't"be necessary in the proposed use called "appliance & trade sales & service". She gave the example of a contractor's office and whether that is different that Hillsborough Plumbing. Hauth suggested taking out the word "may" and "accessory use" because it will be difficult to tell which is the accessory and which is the Crowther meeting adjourned at 7:40 pm Respectfully submitted, Veronica Holman, Sec tary
