Please do not provide any record other than this inventory. I make this request pursuant to Article 1. Section 24 of the Florida Constitution and Chapter 119 of the Florida Statutes. If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or disclosure please cite the specific exemption as required by $ 119.07(1)(e) of the Florida Statutes and state in writing and with particularity the basis for your conclusions as required by § 119.07(1)(8 of the Florida Statutes. Please take note of 4119.070)(c) Florida Statues and your affirmative obligation to (1) promptly acknowledge receipt of this public records request and (2) make a good faith effort which "includes making reasonable efforts to determine from other oJf1cers or employees within the agency whether such a record exists and, ifso, the location at which the record can be accessed." I am, therefore, requesting that you notify every individual in possession of records that may be responsive to this public records request to preserve all such records on an immediate basis. If the public records being sought are maintained by your agency in an electronic format please produce the records in the orieinal electronic format in which they were created or received. See 5119.01(2)(8, Florida Statutes. Please provide only those records for inspection that do not require extensive use of information technologies or extensive staff time or both in excess of 15 minutes. I note that during the commission meeting of February 13, 2015 Town Manager, Mr. Thrasher, read my record request aloud and stated that he was confused by it, unsure as to how to get it, and complained about the extensive work required by staff to produce it. For purposes of clarity and to assist Mr. Thrasher in his efforts I would like to direct your attention to the Town's Comprehensive Land Use Plan submitted by the Town to the Florida Department of Community Affairs and copied in the public records found on the Town's website which are labeled Town of Gulf Stream Comprehensive Plan (2009) (adopted by Ordinance 08/10 and Town of Gulf Stream Comprehensive Plan (2012). Located under the captioned heading Recreation and Open Space Element of both the 2009 and 2012 version is found Policy 7.1.2.1. which states The Town shall maintain an inventory of all parks within the Town and within one mile of the Town. Such inventory shall include the agency owning the park, the agency responsible for operating and maintaining the park, the primary use of the park site, and the active and passive recreational facilities available at the park. The record request that apparently confounded Mr. thrasher was for the Town's inventory of all parks within one mile of the Town including who owns the park, who operates the park, and the parks recreational facilities. As you can see from this email, that particular record already exists as Policy 7.1.2.1.and it should only be a matter of going to whatever file contains this record in order to retrieve it. I hope that this information is sufficient for Mr. Thrasher to identify the record I wish to inspect and for the Custodian of Records to immediately locate this record and notify me as soon as possible when I may inspect it.
