AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, TRANSFERRING LAND FOR
RIGHT-OF-WAY TO THE MISSOURI HIGHWAYS AND TRANSPORTATIN COMMISSION,
DEPARTMENT OF TRANSPORTATION (MODOT).
BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The Council transfers by deed 88.1 square feet of property and 578.4 square
feet for a temporary construction easement specifically described on Exhibit A, attached herewith,
to the Missouri Highways and Transportation Commission, Department of Transportation (MoDOT)
for the Missouri Boulevard Sidewalk Project.
Section 2. This Ordinance shall be in full force and effect from and after the date of its
passage and approval.

through the MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION,

Grantor, in consideration of the sum of One Dollar and Other Valuable
Consideration, to be paid by the Grantee, the receipt of which is hereby
acknowledged, does hereby grant, bargain and sell, convey and confirm fee simple title
in the property described in this deed.
Grantor conveys to the Grantee the real estate and interests in real estate in the
County of Cole, State of Missouri, and described as follows:
A tract of land located in the Northwest Quarter of the Southeast Quarter of Section 12,
Township 44 North, Range 12 West, in the County of Cole, State of Missouri, more
particularly described in Exhibit A.
All the land of said grantors to be used for a temporary construction easement lying
within the following described tract:

Beginning at a point 47.00 feet left of the hereinafter described Business Route 50
Centerline Station 34+44.86 on the new southerly boundary line of Business Route 50,
also being a point on the existing westerly right of way line of Kansas Street; thence
southerly along the existing westerly right of way line of Kansas Street to a point 70.00
feet left of Business Route 50 Centerline Station 34+44.83; thence northwesterly to a
point 70.00 feet left of Business Route 50 Centerline Station 34+65.00; thence northerly
to a point 45.00 feet left of Business Route 50 Centerline Station 34+65.00; thence
northwesterly to a point 45.00 feet left of Business Route 50 Centerline Station
34+76.00; thence northerly to a point 40.00 feet left of Business Route 50 Centerline
Station 34+76.00 on the existing southerly right of way line of Business Route 50;
thence southeasterly along the existing southerly right of way line of Business Route 50
to a point 40.00 feet left of Business Route 50 Centerline Station 34+59.87 on the new
southerly boundary line of Business Route 50; thence southerly along the new southerly
boundary line of Business Route 50 to a point 43.00 feet left of Business Route 50
Centerline Station 34+59.87; thence southeasterly along the new southerly boundary
line of Business Route 50 to a point 43.00 feet left of Business Route 50 Centerline
Station 34+53.87; thence southerly along the new southerly boundary line of Business
Route 50 to a point 47.00 feet left of Business Route 50 Centerline Station 34+53.87;
thence southeasterly along the new southerly boundary line of Business Route 50 to the
point of beginning.
The above temporary construction easement contains 578.4 square feet, more or less.
Upon completion and acceptance of the project, the temporary easement rights in the
last-described tract shall cease and be no longer in effect.

Grantee shall obtain all rights, privileges, appurtenances and immunities
belonging to Grantor, its successors and assigns forever.
Grantor hereby covenants that it is lawfully seized of an indefeasible estate in fee
in the premises herein conveyed. Grantor covenants that it has good right to convey
the property. Grantor covenants that the said premises are free and clear of any
encumbrances done or suffered by it or those under whom it claims; and that it will
warrant and defend the title to said premises unto the Grantee and unto its successors
and assigns, forever, against the lawful claims and demands of all persons
whomsoever.
IN WITNESS WHEREOF, the said Grantor executed the above the day and year
first above written.

Dear Mayor Tergin:
The Missouri Department of Transportation is pleased to inform you of an improvement planned for your
area. Engineering drawings which describe the proposed project are attached.
We do want to inform you of your right to receive compensation for the land and/or property rights in
question, as determined by an appraisal of the rights to be acquired from your property.
We are hopeful that, because of the benefits to be derived from the project, we can reach an agreement with
you to donate the required land and/or property rights to accomplish the proposed construction. Should you
choose to donate, we would appreciate your signing this letter, waiving your right to compensation and pro
rata tax adjustment and returning it to us. To comply with regulations,we will also need your signature later
on a formal conveyance document.
An acquisition brochure is furnished with this letter. It's purpose is to explain the process which must be
followed to acquire right of way.
We look forward to the completion of this improvement project and appreciate your cooperation.
