HomeMy Public PortalAboutMinutes - 11/3/2008 The Wellsburg City Council met in regular session November 3,2008 with Mayor Fox presiding and Council Members Buseman, Van Hauen, Nielsen and Van Heiden present. Absent Lindaman. Motion by Nielsen second by Buseman to approve the October 6, 2008 regular meeting and the October 1, 2008 and October 14, 2008special meetings. All ayes, carried. Motion by Van Hauen second by Buseman to approve the Treasurer’s Report for October. All ayes, carried. Motion by Van Heiden second by Van Hauen to approve the following bills for payment. Being there were no written or oral objections to the proposed action the Mayor closed the hearing at 7:15 p.m. Motion by Buseman second by Van Hauen to approve Resolution 11-2008-1 vacating property currently used as an alley and the sale of said property for business expansion purposes to Terry Town. Roll call of votes. All ayes, carried. Motion by Nielsen second by Buseman to approve Resolution 11-2008-2 authorizing the Mayor and City Clerk to execute whatever deeds are necessary so as to convey title to the real estate. Roll call of votes. All ayes, carried. Karen Mennenga, Library Director, presented the library report. At 7:25 p.m. the Mayor declared that this was the time and the place for the Public Hearing on the proposed drawings and specifications, as well as proposed form of contract for, or cost of such improvements. Being there were no oral or written objections the Mayor declared the public hearing closed at 7:30 p.m. Motion by Van Heiden second by Van Hauen to approve Resolution 11-2008-3 a resolution making award of construction contract to Huff Contracting at a cost of 724,692.00. Roll call of Votes. All ayes, carried. Motion by Nielsen second by Van Heiden to approve Resolution 11-2008-4 awarding a contract to Embury, Ltd in the amount of 20,081.33 for library furnishings. Roll call of votes. All ayes carried. Matt Garber, Clapsaddle Garber, presented information about change orders for the housing development project. A decision will be made at a later meeting. Motion by Nielsen second by Van Hauen to approve the purchase of a cover for the chemical building at the swimming pool and CPO training for Merrill Lindaman. All ayes, carried. Motion by Van Heiden second by Buseman approving Ordinance 11-2008, an ordinance establishing Chapter 93 of the Code of Ordinances. Ordinance 11-2008 establishes rules and regulation for private wells and water systems. With exceptions private wells and water systems shall not be maintained by any individual or property owner, nor shall any new wells be established with the City Limits. Roll call of votes. All ayes, carried. Motion by Nielsen second by Van Hauen to waive the second and third reading of Ordinance 11-2008 and pass upon the first reading. Roll call of votes. All ayes, carried. Motion by Van Heiden second by Buseman to approve quote from TEC/Brightway Electric for upgrading the electric panel in the Memorial Building and connecting the building to the generator located at the Fire Station. Cost to be $4200.00. All ayes, carried. Motion by Nielsen second by Buseman to approve Building permit for Harold Aukes. All ayes, carried. Motion by Van Heiden second by Buseman to adjourn.
