Please call the Planning Department if you cannot attend. 732-2104 or 406-8393 (voice mail, anytime, local call) MINUTES PLANNING BOARD Tuesday, June 7, 1994 PRESENT: Bill Crowther, Wayne Tilley, Louise Long, Pat Shannon, Wendy Olson, Kendall Abernathy, Stuart Munson, Sam Jones, and Quanda Turner PUBLIC: J.C. Edwards, four citizens, and Margaret Hauth Crowther called the meeting to order at 6:32 p.m. ITEM #1: J.C. Edwards, an Engineer representing a land owner, requested permission to speak briefly on an upcoming rezoning request. The members agreed. Edwards described the Latta property and their intent to build a subdivision at R-15 with municipal services. Hauth briefly described the surrounding uses and zoning. Edwards thanked the members for their time. ITEM #2: Hauth reported that the Transportation Plan Task Force will have their first meeting on June 21st. DOT has completed the model and the County will be working very closely with the Town on this project. There is an ambitious schedule set. Hauth reported that Town Board will be looking at the recommended design for the Entranceway Sign at their next meeting. The hope is to complete this project this summer and this will complete the work of the Entranceway Committee. Olson reported that the Occoneechee Park Committee has met several times. The Committee has prepared a Proposed Parking Area Plan and it has been given to a representative of Piedmont Minerals. Negotiations are on-going. ITEM #3: There were no amendments to the minutes of February 1 and March 1. MOTION: Jones moved to approve the minutes. Seconded by Tilley. VOTE: Unanimous. ITEM #4: Hauth noted that the Town Board actions on the public hearing items was in the agenda packet for information. ITEM #5: Hauth stated that there are 15 property owners representing almost 30 properties which have requested HIC zoning. They have been grouped by neighborhoods. Hauth explained that sending neighborhoods to the same hearing makes sense because residents can receive one notice of multiple rezonings they may be interested in. Hauth said she had divided the properties into neighborhoods called North, I-85, S. Churton, and East. She stated that her recommendation is to handle the East and I-85 neighborhoods as a high priority. Members agreed with the proposal. ITEM #6: Hauth presented a chart showing what Hillsborough, Cary, Chatham County, Durham City/County, and Orange County are using or considering for Planned Unit developments. Hauth asked the board to create a list of goals, to help guide the attorney draft a new ordinance. She added that he needs to know what the intents are so he can draft the appropriate language. Crowther described a rough draft he prepared as an alternative. Members agreed that Crowther draft was headed in the correct direction. After much discussion, they added the following as necessary components for an acceptable PUD ordinance: * Limit to parcels of 20 acres or more * Require the use of municipal water and sewer PB 6/7/94 page 2 * Take out density references; the limits established on buildable and non-residential achieve the same purpose * Make a 4th option which does not include HIC uses * Add landowners association or some method of maintenance for open space * Make Open Space flexible: fill primary requirement first; include storm water controls in secondary open space; move historical/cultural/archeological sites to primary open space; * Primary open space to be preserved, secondary open space must be accessible, 25% shall be preserved in (or created to mimic) its natural state. If there is an excess of primary open space, preserve all up to 50% * Require interior access to Non -Residential areas * Integrate all uses into one viable community * Interior land use buffers and setbacks are questionable ITEM #7: Hauth described a proposal to reduce the setback requirements for accessory structures. Members asked if there was a limit in terms of the use of the structure. Hauth said there was not one proposed. She added that such a limit would be extremely difficult to enforce, especially when a property changed ownership. Members asked if there is a size limit imposed for the setback reduction. Hauth said there was not. She added that a standard 2 car garage is 25' X 25' and suggested that this might be a reasonable limit. Members agreed and asked Hauth to make the changes. Hauth described a proposal to reduce setback requirements for legal non -conforming lots which are too small for their zoning district. She explained that by applying a standard requirement to a small lot in terms of a percentage leveled the playing field for small lot owners. She added that it did not reward small lot owners by arbitrarily reducing setbacks. The members discussed the idea and asked Hauth to provide a drawing as to the impact the change would have on a hypothetical lot. ITEM #8: Hauth described a proposal to add text to the Ordinance to address temporary uses. She noted that there had been a number of requests for short term sales in parking lots and similar events. She added that the Board of Adjustment had interpreted the ordinance did not exclude temporary uses, so long at it is a permitted use in the district. Members asked how this would apply to church and school functions, which do not take place in commercial districts. Hauth said that, as written, those activities would not be allowed. Members asked how this would apply to the seasonal outside storage/display of goods that many retailers do now. Members also asked that the use of temporary dwellings be included. More clearly, the permission for someone building a house to live in a mobile home or other temporary dwelling on the same lot during construction. Hauth said she and Chavious would work on the suggest changes. MOTION: Abernathy moved to reschedule the July meeting to Tuesday, June 28. Shannon seconded. VOTE: Unanimous.
