HomeMy Public PortalAbout18-085 - Supporting AB 1793 Regarding the Resentencing of those with Previous Cannabis ConvictionsRESOLUTIONNO.18-085RESOLUTIONOFTHECITYCOUNCILOFTHECITYOFCARSONSUPPORTINGAB1793REGARDINGTHERESENTENCINGOFTHOSEWITHPREVIOUSCANNABISCONVICTIONSWHEREAS,Proposition215legalizedthemedicinaluseofcannabisin1996;andWHEREAS,Proposition64legalizedtheadultuseofcannabisin2016;andWHEREAS,theCityofCarsonvotedin2016topassProposition64,theAdultUseofMarijuanaAct,byover58%;andWHEREAS,Proposition64statesintentto;“authorizecourtstoresentencepersonswhoarecurrentlyservingasentenceforoffensesforwhichthepenaltyisreducedbytheActsolongasthepersondoesnotposearisktopublicsafetyandtoredesignateordismisssuchoffensesfromthecriminalrecordsofpersonswhohavecompletedtheirsentencesassetforthinthisAct;”andWHEREAS,thelanguageinProposition64leftthefinancialburdenofhavingpreviousconvictionsexpungedonthepersonconvicted;andWHEREAS,thosewithpreviousconvictionsmaynothavethelegalknowledgeorfinancialresourcestoexpungetheirrecords;andWHEREAS,whilemarijuanauseisnowlegalunderCalifornialaw,hundredsofthousandsofCalifornianshavecriminalrecordsforpossessingorsellingthedrugwhenitwasstillbanned.Furthermore,itiswidelyknownthatsuchcriminalrecordscanmakeitharderforpeopletogetajob,obtainaloan,gotocollege,rentanapartmentorotherwisebecomeproductivemembersoftheircommunityeveniftheirmarijuanaarresthappeneddecadesago;andWHEREAS,accordingtoareportbytheDrugPolicyAlliance,approximately500,000peoplewerearrestedforcannabisfeloniesandmisdemeanorsfrom2006to2015,andasofSeptember2017,only4,885peoplehadsoughttomodifytheirrecords;andWHEREAS,cannabisrelatedconvictionshavedisproportionatelyaffectedpeopleofcolorandcreatedbarriersfortheseindividualstoobtainemploymentandhousing;blackshavebeennearlyfourtimesmorelikelytobearrestedformarijuanapossessionthanwhites,andLatinosweretwo-tothreetimesmorelikelytobearrestedandprosecutedthannon-Latinowhites.Forinstance,areportearlierthisyearfoundthat77percentofpeoplearrestedin2015formarijuana-relatedcrimesinOaklandwereblack,andSanFranciscoreportedthatabout41%ofthosearrestedformarijuanawereblack,eventhoughthecity’sblackpopulationwasunder8%;andWHEREAS,theCityofCarsonnowhasacityordinanceallowingfortheoperationofuptofourcannabiscenterswithintheCity,limitedtocultivation,manufacture,distribution,andtesting;andRESOLUTIONNO.18-085Page1of3 NOW,THEREFORE,BEITRESOLVEDBYTHECITYCOUNCILOFTHECITYOFCARSONASFOLLOWS:Section1.Thattheaboverecitalsaretrue,correct,andincorporatedherein.ThattheCityCounciloftheCityofCarsonsupportsthepassageofAB1793whichwouldrequiretheStateDepartmentofJusticetoreviewitsdatabaseandnotifythecourtsofallcasesthatareeligibleforreducedsentencingorexpungementandallowtheDistrictAttorneytoreviewandchallengetheresentencingorexpungementifthepersonmeetstheeligibilitycriteriaanddoesnotpresentanunreasonablerisktopublicsafety;andSection3.ThattheCityCounciloftheCityofCarsonrequeststhattheDistrictAttorneyofLosAngelesCountyjoinSanDiegoCounty,theCountyofSanFrancisco,theCountyofSonoma,theCountyofAlameda,andYoloCountyinsupportingtheseefforts;andThattheCityManagerisdirectedtosendacopyofthisResolutiontotheofficeofGovernorJerryBrown,theofficeofSenatorStevenBradford,theofficeofAssemblyMemberMikeGipson,theofficeofAssemblyMemberRobBonta(thebill’sauthor),theofficeofCountySupervisorMarkRidley-Thomas,andtheofficeofDistrictAttorneyJackieLacey.PASSED,APPROVED,ANDADOPTEDthis1gthdayofJune,2018.CITYOFCARSON:A3/rtRobles,MayorATTEST:DonesiaGause-Aldana,RESOLUTIONNO.18-085Page2of3MMC,CityClerkSection2.Section4.RM:rney STATEOFCALIFORNIACOUNTYOFLOSANGELES)ss.CITYOFCARSONI,DonesiaGause-Aldana,CityClerkoftheCityofCarson,California,herebyattesttoandcertifythattheforegoingresolution,beingResolutionNo.18-085,adoptedbytheCityofCarsonCityCouncilatitsmeetingheldonJune19,2018,bythefollowingvote:AYES:COUNCILMEMBERS:Robles,Hilton,Santarina,Davis—Holmes,HicksNOES:COUNCILMEMBERS:NoneABSTAIN:COUNCILMEMBERS:NoneABSENT:COUNCILMEMBERS:NoneDonesiaGause-Aldana,MMC,CityClerRESOLUTIONNO.18-085Page3of3
