Home My Public Portal About18-106 - Providing for Filing of Rebuttal Arguments Regarding Measure to Adopt City CharterRESOLUTION18-106ARESOLUTIONOFTHECITYCOUNCILOFTHECITYOFCARSON,CALIFORNIA,PROVIDINGFORTHEFILINGOFREBUUALARGUMENTSElREGARDINGTHEMEASURETOADOPTACITYCHARTERFORTHECITYOFCARSONWHEREAS,aGeneralMunicipalElectionistobeheldintheCityofCar5on,California,onNovember6,2018,atwhichtherewillbesubmittedtothevotersaballotmeasuretoconsideradoptingaproposedCityCharterfortheCityofCarson;and,WHEREAS,CaliforniaElectionsCode§9285authorizestheCityCouncil,bymajorityvote,toadoptprovisionstoprovideforthefilingofrebuttalargumentsregardingcitymeasuressubmittedatmunicipalelection.NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFCARSON,CALIFORNIA,DOESRESOLVE,DECLARE,DETERMINEANDORDERASFOLLOWS:Section1.ThatpursuanttoElectionsCode§9285,whentheCity’sdesignatedelectionsofficialhasselectedtheargumentsforandagainsttheforegoingmeasurewhichwillbeprintedanddistributedtothevoters,theCity’sdesignatedelectionsofficialshallsendcopiesoftheargumentinfavorofthemeasuretotheauthorsoftheargumentagainst,andcopiesoftheargumentagainsttotheauthorsoftheargumentinfavor.Theauthororamajorityoftheauthorsofanargumentrelatingtotheforegoingcitymeasuremayprepareandsubmitarebuttalargumentnottoexceedtwohundredandfifty(250)wordsinlength.Arebuttalargumentmaynotbesignedbymorethanfive(5)authors.TherebuttalargumentsshallbefiledwiththeCityClerknotmorethanten(10)daysafterthefinaldateforfilingdirectarguments.TherebuttalargumentsshallbeaccompaniedbytheFormofStatementtobeFiledbyAuthor(s)ofArgumentasprovidedforinCaliforniaElectionsCode§9600.Rebuttalargumentsshallbeprintedinthesamemannerasthedirectarguments.Eachrebuttalargumentshallimmediatelyfollowthedirectargumentwhichitseekstorebut.Section2.Thatallpreviousresolutionsprovidingforthefilingofrebuttalargumentsforcitymeasuresarerepealed.Section3.ThattheprovisionsofSection1ofthisResolutionshallapplyonlytotheGeneralMunicipalElectiontobeheldonNovember6,2018andshallthenberepealed.Section4.ThattheCityClerkshallcertifytothepassageandadoptionofthisResolutionandenteritintothebookoforiginalResolutions.ThisResolutionshallbeeffectiveimmediatelyuponpassageandadoption.PASSED,APPROVEDANDADOPTEDbytheCityCounciloftheCityofCarson,California,ataregularmeetingheldonthe7thdayofAugust,2018.RESOLUTIONNO.18-106Pagelof201007.0001/494896.1 APPROVEDASTOFORM:CITYOFCARSON:STATEOFCALIFORNIACOUNTYOFLOSANGELESCITYOFCARSON)55.AtiZU,)ØrtRcbIes,MayorATTEST:I.--—--——DonesiaGause-Aldana,MMC,CityClerkUI,DonesiaGause-Aldana,CityClerkoftheCityofCarson,California,herebyattesttoandcertifythattheforegoingresolution,beingResolutionNo.18-105,adoptedbytheCityofCarsonCityCouncilatitsmeetingheldonAugust7,2018,bythefollowingvote:AYES:NOES:COUNCILMEMBERS:Robles,Hilton,SantarinaCOUNCILMEMBERS:Davis—Holmes,HicksRESOLUTIONNO.18-106Page2of2ABSTAIN:COUNCILMEMBERS:NoneABSENT:COUNCILMEMBERS:NoneDonesiaMMC,CityClerk01007.0001/494896.1
