BoulevardRESOLUTIONNO.18-117APPROVINGANEXCEPTIONTOTHEAPPLICATIONOFINTERIMURGENCYORDINANCENOANDl8-1805UTOALLOWFILINGANDPROCESSINGOFPLANSANDPERMITSNECESSARYTOOPERATEA800SPACETRUCKANDCONTAINERYARDONA20ACRESITELOCATEDAT2149E.SEPULVEDABOULEVARDWHEREAS,onMarch21,2017,theCityCounciloftheCityofCarsonadoptedInterimUrgencyOrdinanceNo.17-1615Ubya5-0vote,pursuantitsauthorityunderGovernmentCodeSection65858;JandWHEREAS,InterimUrgencyOrdinanceNo.17-1615Uenacteda45-daymoratoriumontheestablishment,expansion,ormodificationoftruckyards,logisticsfacilities,hazardousmaterialsandhazardouswastefacilities,containerstorage,andcontainerparking(collectively,“LogisticsFacilities”)intheCityofCarson;andWHEREAS,onMay2,2017,theCityCounciladoptedInterimUrgencyOrdinanceNo.17-1618Ubya5-0vote,pursuanttoitsauthorityunderGovernmentCodeSection65858;andWHEREAS,InterimUrgencyOrdinanceNo.17-1618Uenacteda10-monthand15-dayextensionofthemoratoriumontheestablishment,expansion,ormodificationofLogisticsFacilities(the“Ordinance”);andWHEREAS,onMarch20,2018,theCityCounciladoptedInterimUrgencyOrdinanceNo.18-1805Ubya5-0vote,pursuanttoitsauthorityunderGovernmentCodeSection65858;andWHEREAS,InterimUrgencyOrdinanceNo.18-1805Uenacteda12-monthextensionofthemoratoriumontheestablishment,expansion,ormodificationofLogisticsFacilities(the“Ordinance”);andWHEREAS,duringtheeffectiveperiodoftheOrdinance,noapplicationforpermitisbeingaccepted,noconsiderationofanyapplicationforpermitisbeingmade,andnopermitisbeingissuedbytheCityfortheestablishment,expansion,ormodificationofLogisticsFacilities;andWHEREAS,theCityCouncilmay,butisnotrequiredto,allowexceptionstotheapplicationoftheOrdinanceif,basedonsubstantialevidencepresented,itdeterminesanyoracombinationofthefollowing:1.TheCity’sapprovalofanapplicationforapermittoestablish,expand,ormodifyaLogisticsFacilitywithintheCity’sjurisdictionwillnothaveamaterialnegativeimpactuponthepublichealth,safety,andwelfare.2.ApplicationoftheOrdinancewouldimposeanunduefinancialhardshiponapropertyorbusinessowner;3.LandcontrolledbytheCityorbyanyofitsagenciesandauthoritiesincluding,transactionsapprovedbytheDepartmentofFinance;4.ThedeveloperortenantagreestoformortoparticipateinaCommunityFinancingDistrict(CEO)topayforongoingCityservices,includingbutnotlimitedto,roadmaintenance,landscapemaintenance,lighting,publicsafety,stormwatermanagement,etc.,tothesatisfactionoftheCityCouncil;RESOLUTIONNO.18-117Page1of601007.0005/395889.1 5.ThedeveloperortenantentersintoanagreementthatguaranteestheCitythesamefinancialassurancesofferedbyaCFD;6.Thefiscalimpactanalysisforthebusinessshowsthatthebusinesswillnot,aftertakingintoconsiderationallfiscalandemploymentbenefitstotheCityanditsresidents,havematerialadversenegativefiscalimpactsontheCity;7.TheLogi5ticsFacilitywillnotgenerateadditionalmateriallyadversetrucktrafficimpactsinexcessofthosegeneratedbytheuseofthepropertyasoftheeffectiveJdateofthisOrdinance;8.ThefacilityentersintoadevelopmentimpactfeesagreementwiththeCity;9.Theuseispermittedorconditionallypermittedinthezone;10.TheuseisconsistentwiththepurposesofthisOrdinanceandtheGeneralPlan;11.Theusewillnotbeinconflictwithanycontemplatedgeneralplan,specificplan,orzoningcodeupdatethattheCityCouncilisconsideringorstudyingorintendstostudy;12.Theuseisnotandwillnotbecomeahazardousmaterialsfacility,atruckyard,oracontainerstoragefacility;13.Theusewillnotabutasensitivelanduse,ortheimpactsonanabuttingsensitivelandusecanbeadequatelymitigatedwithreasonableconditions;14.Theusewillnotconstituteathreattothepublichealth,safety,andwelfare.WHEREAS,onJune27,2018,Mr.KevinBaddeleywithShippersTransportExpressfiledarequesttomakeanexceptiontoInterimUrgencyOrdinanceNo.18-1805U(logisticsmoratorium)toallowfilingandprocessingofallapplicableentitlementapplicationsnecessarytooperatea800spacetruckandcontaineryardona20acresitelocatedat2149E.SepulvedaBoulevard;andWHEREAS,theapplicanthasagreedtoincorporatethefollowingimprovementsintothesitesuchaslandscaping,fencing,resurfacingtheparkingareastoimprovetheappearanceofthesiteandotherrequirementsimposedontheprojectduringtheConditionalusePermitprocess;WHEREAS,theproposedProjectissubjecttotheOrdinancesinceitispropo5ingtobuildanewlogisticsfacility.TheprojectdoesnotqualifyforanyoftheexemptionsarticulatedinSection4ofthePjOrdinance;andWHEREAS,theCityhasjuststartedtheGeneralPlanandZoningCodeupdatesandisconceivablethattheproposedusewillbeconsistentwiththeupdatedGeneralPlanandZoningCode;however,itisessentialforthisprojecttoallowtheGeneralPlanprocesstobecompletedsettingthelanduseexpectationsforthearea;andWHEREAS,theapplicantagreestocooperateingoodfaithwiththeCitytodeterminetheappropriateDJFandCFDfortheproject;andRESOLUTIONNO.18-117Page2of601007.0005/395889.1 WHEREAS,uponapprovaloftheexception,theapplicantwillcooperatewiththeCitytoprovideallstudies,plans,andmaterialsnecessarytocontinueprocessingtheapplicationsfortheDesignOverlayReviewandConditionalUsePermitandotherapplicationsasdeemednecessarybystaff;andWHEREAS,ApplicanthasagreedtocomplywithseveralofthefollowinginexchangeforbeingUgrantedanexceptionunderOrdinanceNo.18-1S0SU:a.TheApplicanthasagreedtoenterintoanInterimDevelopmentImpactFeeAgreement(“IDIFAgreement”).TheIDIFamountshallbebasedonaminimumof$2.00persquarefootofbuildingareaorotheramountasdeterminedbytheCityatthetimeoftheapprovaloftheentitlementswhichmaybehigher.b.TheApplicanthasagreedtonegotiateingoodfaithtoform,fund,and/orparticipateinaCommunityFacilitiesDistrict(CFD)and/oraDevelopmentAgreementtopayforon-goingcostsassociatedwiththeirprojectrelatingtolawenforcement,streetmaintenance,landscapemaintenance,streetsweeping,oranyotherimpacts.TheApplicantwillberequiredtoenterintoaCFDagreement(“CFDAgreement”).c.AttheCity’sdiscretion,theApplicantmayberequiredtoenterintoaDevelopmentAgreementrelatingtotheProject,iftheCitydeemstheIDIFandCEDAgreementsdonotadequatelymitigatetheProject’simpacts.d.ApplicantwillenterintoanagreementtoreimbursetheCityforallitscosts(the“ReimbursementAgreement”),includingbutnotlimitedtoallconsultantcosts(suchastheCFDconsultantworkassociatedwiththeprocessingoftheportionoftheApplicant’sCFDassessment),andattorneyfeesassociatedwiththeApplicant’sexceptionapplicationandfinalizingoftheCR3Agreement,IDIFAgreement,ReimbursementAgreement,andDevelopmentAgreement,ifapplicable,orotheragreementsand/orentitlementprocesses.e.TheIDIF/CFDAgreementand/ortheDevelopmentAgreementshallbedetermined,finalized,agreedupon,andexecutedpriortothePlanningCommissionhearingfortheDesignOverlayReviewandtheConditionalUsePermit,andanyotherapplicationsdeemedappropriatebystaff.f.DevelopmentImpactFees(Dl9:TheApplicantshallpaytheone-timeInterimDevelopmentImpactFee(IDIF)asdeterminedbytheCity.CityiscurrentlyconductingastudytoadoptDIFtopayforimpactsofnewprojectstoCity’sinfrastructure.WeanticipatethisnewDIEtobeadoptedbyendoftheyear.IftheCity’sDIEisadoptedbythetimeyourapplicationisdeemedcomplete,wewouldimposethenewlyadoptedDIFwhichmaybehigherthanthe$2.00persquarefoot.However,iftheDIEisnotadoptedbythetimeyourapplicationisdeemedcomplete,wewouldimposethe$2.00persquarefootDIE.Ineitherscenario,theminimumamountofDIEpaidbytheprojectshallnotbelessthan$2.00persquarefoot.TheApplicantwillberequiredtoenterintoanIDlEAgreementwiththeCity.ItshouldbenotedDIFisaone-timefeeimposedonprojects.g.CommunityFacilitiesDistrict(CFD):TheApplicantshallform,fund,andparticipateinaCommunityFacilitiesDistrict(CED)topayforon-goingcostsassociatedwiththeirprojectrelatingtolawenforcement,streetmaintenance,landscapemaintenance,streetsweeping,andallotherimpactsofitsf)projectonanannualbasis.Currently,theCityhasapolicyofcharging$0.50pertrucktripperdayasCFDfJamountfortruckyardsandcontaineryards.ApplicantshallenterintoaCFDorDevelopmentAgreementwiththeCity.AtthediscretionofCity,ApplicantmayberequiredtoenterintoaDevelopmentAgreement,tomitigateanyimpactsthatarenotmitigatedbytheIDIFortheCFDAgreements.CityisinprocessofformingaCitywideCFDtopayforimpactsofnewprojectsonCity’sserviceswhichmaybehigherthanthecurrent$0.50pertrucktripperdayassessment.WeanticipatethisnewDIFtobeadoptedbyendoftheyear.IftheCitywideCEDisadoptedbythetimeyourapplicationisdeemedcomplete,wewouldimposethenewlyadoptedCitywideCFD.However,iftheCitywideCFDisnotadoptedbythetimeyourapplicationi5deemedcompiete,wewouldimposetheRESOLUTIONNO.18-117Page3of601007.0005/395889.1 $0.50pertrucktripperdayforyourspecificproject.ItshouldbenotedtheCitywideCFDisanannualtaximposedonprojects.NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFCARSONHEREBYMAKESTHEFOLLOWINGFINDING5:g1.Applicantisproposingtooperatea800spacetruckandcontaineryardona20acresitelocatedat2149E.SepulvedaBoulevard(the“Project”).Theapplicanthasagreedtoimprovethesitesuchaslandscaping,fencing,resurfacingtheparkingareastoimprovetheappearanceofthesiteandotherrequirementsimposedontheprojectduringtheConditionalusePermitprocess;2.TheProjectissubjecttothemoratoriumontheestablishment,expansion,ormodificationofLogisticsFacilitiespursuanttoInterimUrgencyOrdinanceNo.18-1805U.3.TheProjectdoesnotqualifyforanyoftheexemptionsarticulatedinSection4oftheOrdinance.4.Section6ofInterimUrgencyOrdinanceNo.17-1805UprovidesthattheCityCouncilmay,butisnotrequiredto,allowexceptionstotheapplicationoftheOrdinance.5.TheApplicantshallpaytheone-timeInterimDevelopmentImpactFee(IDlE)asdeterminedbytheCity.TheApplicantwillberequiredtoenterintoanIDlEAgreementwiththeCity.ThelDlFamountshallbebasedonaminimumof$2.00persquarefootofbuildingareaorotheramountasdeterminedbytheCityatthetimeoftheapprovaloftheentitlementswhichmaybehigher.6.TheApplicantshallform,fund,andparticipateinaCommunityFacilitiesDistrict(CFD)topayforon-goingcostsassociatedwiththeirprojectrelatingtolawenforcementstreetmaintenance,landscapemaintenance,streetsweeping,andallotherimpactsofitsproject.TheCityhasengagedtheservicesofaconsultanttocalculatetheamountofthisassessment,whichamountsApplicantwillnotchallenge.ApplicantshallenterintoaCFDorDevelopmentAgreementwiththeCity.AtthediscretionofCity,ApplicantmayberequiredtoenterintoaDevelopmentAgreementtomitigateanyimpactsthatarenotmitigatedbytheIDIFortheCFDAgreements.7.ApplicantshallenterintoaReimbursementAgreementtoreimbursetheCityforallitsfeesandcosts,includingattorneyandconsultantfees,forallagreementsandentitlementsnecessarypursuanttothisResolutionandtheCity’sZoningOrdinance.8.TheIDlEAgreement,CEOAgreementDevelopmentAgreement(ifapplicable)andReimbursementAgreementareconditionsprecedenttothevalidityofthisexception.9.Ifwithinninety(90)daysofadoptionofthisResolution,theIDIFAgreement,CFDAgreement,DevelopmentAgreement(ifapplicable)andReimbursementAgreementhavenotbeenfinalized,thentheCouncilhastherighttorescindthisResolutioninitssolediscretionandtheApplicantwillbesubjecttotheOrdinance.10.Applicant’sfailuretoenterintotheIDIFAgreement,theCFDAgreement,theReimbursementAgreement,andtheDevelopmentAgreementmaybegroundsfortheCitytodenytheApplicant’spermitstoconstructtheProject,andallofApplicant’slanduseapplicationsandentitlementsbeingnullandvoid.[Ill.TheIDIF/CFDAgreementand/ortheDevelopmentAgreementincludingtheamountsfortheIDIFandCFDshallbedetermined,finalized,agreedupon,andexecutedpriortothePlanningCommissionhearingfortheConditionalUsePermit,andDesignOverlayReview.12.TheCityiscurrentlyconductingstudiestoadoptcitywidestudiesthatmayincreasetheCFDandIDIFamounts.13.DevelopmentImpactFees(DIE):TheApplicantshallpaytheone-timeInterimDevelopmentImpactFee(IDIF)asdeterminedbytheCity.CityiscurrentlyconductingastudytoadoptDIFtopayforimpactsofnewprojectstoCity’sinfrastructure.WeanticipatethisnewDIFtobeadoptedbyendoftheyear.iftheCity’sDIFisadoptedbythetimeyourapplicationisdeemedcomplete,weRESOLUTIONNO.18-117Page4of601007.0005/395889.1 wouldimposethenewlyadoptedDIFwhichmaybehigherthanthe$2.00persquarefoot.However,iftheDIFisnotadoptedbythetimeyourapplicationisdeemedcomplete,wewouldimpo5ethe$2.O0persquarefootDIF.Ineitherscenario,theminimumamountofDIFpaidbytheprojectshallnotbelessthan$2.00persquarefoot.TheApplicantwillberequiredtoenterintoanIDIFAgreementwiththeCity.ItshouldbenotedDIFisaone-timefeeimposedonprojects.14.CommunityFacilitiesDistrict(CFD):TheApplicantshallform,fund,andparticipateina(]CommunityFacilitiesDistrict(CED)topayforon-goingcostsassociatedwiththeirprojectrelatingtolawenforcement,streetmaintenance,landscapemaintenance,streetsweeping,andallotherimpactsofitsprojectonanannualbasis.Currently,theCityhasapolicyofcharging$0.50pertrucktripperdayasCFDamount[ortruckyardsandcontaineryards.ApplicantshallenterintoaCFDorDevelopmentAgreementwiththeCity.AtthediscretionofCity,ApplicantmayberequiredtoenterintoaDevelopmentAgreement,tomitigateanyimpactsthatarenotmitigatedbytheDIPortheCFDAgreements.CityisinprocessofformingaCitywideCFDtopayforimpactsofnewprojectsonCity’sserviceswhichmaybehigherthanthecurrent$0.50pertrucktripperdayassessment.WeanticipatethisnewDIEtobeadoptedbyendoftheyear.IftheCitywideCFDisadoptedbythetimeyourapplicationisdeemedcomplete,wewouldimposethenewlyadoptedCitywideCFD.However,iftheCitywideCFDisnotadoptedbythetimeyourapplicationisdeemedcomplete,wewouldimposethe$0.50pertrucktripperdayforyourspecificproject.ItshouldbenotedtheCitywideCFDisanannualtaximposedonprojects.15.TheCityhasjuststartedtheGeneralPlanandZoningCodeupdatesandisconceivablethattheproposedusewillbeconsistentwiththeupdatedGeneralPlanandZoningCode;however,itisessentialforthisprojecttoallowtheGeneralPlanprocesstobecompletedsettingthelanduseexpectationsforthearea;and16.TheCouncilmakesthefollowingfindingsrelatingtoSection6.A.4,5,and8oftheOrdinance:4.ThedeveloperortenantagreestoformortoparticipateinaCommunityFinancingDistrict(CFD)topayforongoingCityservices,includingbutnotlimitedto,roadmaintenance,landscapemaintenance,lighting,publicsafety,stormwatermanagement,etc.,tothesatisfactionoftheCityCouncil;S.ThedeveloperortenantentersintoanagreementthatguaranteestheCitythesamefinancialassurancesofferedbyaCFD;8.TheIDlEAgreement,CFDAgreement,DevelopmentAgreement(ifapplicable)andReimbursementAgreementareconditionsprecedenttothevalidityofthisexception.PASSED,APPROVEDANDADOPTEDTHIS2lDAYOFAUGUST,2018.APPROVEDASTOFORM:CITYOFCARSON:nnyK.Soltani,CityAttorney5)%rtRobles,MayorRESOLUTIONNO.18-117PageSof601007.0005/395889.1
