Hillsborough Town Board and Planning Board
July 26, 1994
Members Present: Mayor Pro Tem Evelyn Lloyd, Allen Lloyd, Remus Smith, Richard Simpson,
and Catherine Martin; Planning Board Chair Bill Crowther, Stuart Munson,
Wendy Olson, Louise Long, Quanda Turner, Kendall Abernathy, Pat Shannon,
and Wayne Tilley
Staff Present: Margaret Hauth, Planning Director
Mayor Pro Tem Evelyn Lloyd called the hearing to order at 7:05 PM. She passed the gavel to Planning
Board Chair Crowther who briefly described the public hearing process.
ITEM #2: Hauth introduced Charles Burger, Hillsborough resident who chaired the recent activity
by the Parks and Recreation Task Force to draft a Master Parks and Recreation Plan for
Hillsborough. She recognized other members of the public and planning board who
participated. Hauth provided an overview of the information included in the draft plan,
noting that it provided an inventory of existing facilities, used national standards to
determine deficiencies and had detailed maps for the various neighborhoods in town that
created the basis for park planning. Burger stated his appreciation for the town taking on
this important topic and asked for adopting of the plan. Crowther, Olson, and Shannon
echoed those feelings.
ITEM #3 a: Hauth introduced the rezoning request involving 71 acres on the east side of NC 57 from
R-40 to R-15. She introduced J.C. Edwards, applicant on behalf of the property owner.
Mr. Edwards stated he was appearing on behalf of the owner, Harold Latta. He said it
was his intent to develop the property as a residential subdivision. The following
individuals spoke regarding the request: Earl Thomas, Albert Shambley, Betsey Tilley,
and Chandler Cates. Mr. Thomas noted that the surrounding property was not in the city
limits.
ITEM #3b: Hauth introduced the rezoning request involving 1.42 acres on the west side of NC 57
from R-10 to Neighborhood Business. Carl Moraven appeared as applicant/owner. The
following individuals spoke regarding the request: Natalie Ray (opposed, concerned
about uses and property suitability, and impact to her parcel), Wilma Shook (traffic),
Elaine Parker (use of chemicals), and Robert Ceamal (opposed).
ITEM #3c: Hauth introduced the rezoning request involving 7.36 acres on the north side of US 70
Bypass from R-40 to Office Institutional. Dr. Joseph Gatewood appeared as the
owner/applicant. There were no public comments.
ITEM #3d: Hauth introduced the rezoning request involving 67 acres known as Cornerstone Park
from General Commercial to High Intensity Commercial. Jim Anthony spoke as the
owner/applicant. Hauth noted this request was a follow-up to the recent commercial re-
write where the uses in the GC district were limited. There were no public comments.
ITEM #3e: Hauth introduced the rezoning request involving 50 acres known as the Meadowlands
from General Commercial to High Intensity Commercial. Todd Zopolski spoke as the
owner's representative. Hauth noted this request was a follow-up to the recent
commercial re -write where the uses in the GC district were limited. There were no public
comments.
ITEM #3£ Hauth introduced the rezoning request involving 16.7 acres on the south side of
Meadowlands Drive from General Commercial to High Intensity Commercial. No owner
representative was present. Hauth noted this request was a follow-up to the recent
commercial re -write where the uses in the GC district were limited. There were no public
comments.
ITEM #3g: Hauth introduced the rezoning request involving .93 acres occupied by the Pantry on S
Churton Street from General Commercial to High Intensity Commercial. Linda
Turbeville spoke as the owner representative. Hauth noted this request was a follow-up
to the recent commercial re -write where the uses in the GC district were limited. There
were no public comments.
ITEM #3h: Hauth introduced the rezoning request involving 15.3 acres on Cardinal Drive from
General Commercial to High Intensity Commercial. Elizabeth Moose spoke as the owner
representative. Hauth noted this request was a follow-up to the recent commercial re-
write where the uses in the GC district were limited. There were no public comments.
ITEM #3i: Hauth introduced the rezoning request involving .92 acres on South Churton Street
(Hardees) from General Commercial to High Intensity Commercial. Greg Shepard spoke
as the owner representative. Hauth noted this request was a follow-up to the recent
commercial re -write where the uses in the GC district were limited. Evelyn Poole -Kober
spoke regarding this request.
ITEM #3j: Hauth introduced the rezoning request involving .79 acres on South Churton Street
(Quality Oil Company) from General Commercial to High Intensity Commercial. No
one appeared as the owner representative. Hauth noted this request was a follow-up to
the recent commercial re -write where the uses in the GC district were limited. There
were no public comments.
ITEM #3k: Hauth introduced the rezoning request involving 4.27 acres on South Churton Street
(Delmar Brown property) from General Commercial to High Intensity Commercial. No
one appeared as the owner representative. Hauth noted this request was a follow-up to
the recent commercial re -write where the uses in the GC district were limited. There
were no public comments.
ITEM #31: Hauth introduced the rezoning request involving .73 acres on South Churton Street
(Turner property) from General Commercial to High Intensity Commercial. No one
appeared as the owner representative. Hauth noted this request was a follow-up to the
recent commercial re -write where the uses in the GC district were limited. Evelyn Poole -
Kober spoke regarding this request, expressing her concern about the driveways on site.
ITEM #3m: Hauth introduced the rezoning request involving 3.3 acres on South Churton Street
(Food Lion Plaza) from General Commercial to High Intensity Commercial. No one
appeared as the owner representative. Hauth noted this request was a follow-up to the
recent commercial re -write where the uses in the GC district were limited. Remus Smith
and Cy Hogue spoke regarding this request.
ITEM #4a: Hauth introduced the zoning ordinance text amendment to amend Section 5 to reduce the
setback requirements for accessory structures in residential districts with specific
conditions. Jerry Stone spoke on this request. Evelyn Poole -Kober spoke in favor of this
request. Cy Hogue spoke on this request. Jerry Stone noted his opposition to outside
rooms.
ITEM #4b: Hauth introduced the zoning ordinance text amendment to amend Section 3 to reduce
setback requirements for lots that are non -conforming due to not meeting the minimum
lot size for their zoning district. Hauth noted this amendment was offered instead of
creating a district that would allow smaller lots. Remus Smith, Evelyn Lloyd, Richard
Simpson, and Jerry Stone spoke regarding this request.
Bill Crowther asked if anyone else wished to address the agenda items. He closed the public hearing and
passed the gavel back to Mayor Pro Tem Evelyn Lloyd, who adjourned the meeting at 8:20 PM.
