A RESOLUTION: APPROVING CHANGE ORDER NO. 5 FOR DESIGN OF THE
MORVEN PARK ROAD SIDEWALK CAPITAL
IMPROVEMENTS PROJECT IN THE AMOUNT OF
$106,127.07 AND AUTHORIZING THE TOWN MANAGER TO
EXECUTE CHANGE ORDER NO. 5
WHEREAS, the Morven Park Road Sidewalk Improvements project is a funded capital
project; and
WHEREAS, the original design contract for the Morven Park Road Sidewalk
Improvements project was awarded to Whitman Requardt & Associates, LLP in the amount
of$251,400; and
WHEREAS, the design contract was increased to $332,051.73 with Resolution 2020-
050; and
WHEREAS, a change order has been previously authorized on this project totaling
$32,950.18 which results in a current contract amount of$365,001.91; and
WHEREAS, Change Order No. 5 is necessary to provide additional storm drainage
outfall designs for this project in the amount of$106,127.07, and results in a revised contract
value of$471,128.98; and
WHEREAS, Change Order No. 5 increases the design contract amount by more than
25% or$50,000, whichever is greater; and
WHEREAS, the Virginia Public Procurement Act and the Capital Improvements
Policies and Procedures Manual requires that changes order that cause the contract to be
exceeded by the greater of 25% of$50,000 be approved by Town Council, and

CHANGE ORDER NO. 5
WHEREAS, the Morven Park Road Sidewalk Improvements project has sufficient
funds in the Capital Improvement Program budget to cover the additional expense, and no
additional funding is required; and
WHEREAS, the Director of Public Works and Capital Projects recommends approval
of the contract change order.
THEREFORE, RESOLVED, by the Council of the Town of Leesburg in Virginia as
follows:
1. Change Order No. 5 in the amount of$106,127.07 is hereby approved.
2. The Town Manager is authorized to execute Change Order No. 5 to the design
contract with Whitman Requardt & Associates, LLP for the Morven Park Road
Sidewalk Improvements project.
