HomeMy Public PortalAbout18-08 - Approving a Purchase and Sale Agreement by and Between the Carson Successor Agency and the Carson Housing AuthorityRESOLUTION NO. 18 -08 -CSA A RESOLUTION OF THE CARSON SUCCESSOR AGENCY APPROVING A PURCHASE AND SALE AGREEMENT BY AND BETWEEN THE CARSON SUCCESSOR AGENCY AND THE CARSON HOUSING AUTHORITY FOR THE SALE OF TWO AGENCY -OWNED PARCELS LOCATED AT S26 W. CARSON STREET AND 21704 S. FIGUEROA (SUCCESSOR AGENCY) WHEREAS, as a result of the passage of Assembly Bill 26 from the 2011-12 First Extraordinary Session of the California Legislature (ABx1 26), the Carson Redevelopment Agency (RDA) was dissolved on February 1, 2012; and WHEREAS, pursuant to Assembly Bill 1484 of the 2011-12 Legislative Session (AB 1484) which amended ABx1 26 (ABx1 26 and AB 1484, collectively, the "Dissolution Act"), the Successor Agency for the former RDA (Successor Agency) is a separate public agency charged with winding down the RDA's affairs, including making payments due for enforceable obligations (as defined in the Dissolution Act), and performing obligations required pursuant to enforceable obligations; and WHEREAS, pursuant to Health and Safety Code section 34179.5 within six months after receiving a Finding of Completion from the Department of Finance (Finance), the Successor Agency was required to submit for approval to the Oversight Board and Finance a Long -Range Property Management Plan that addresses the disposition and use of the real properties of the former RDA; and WHEREAS, Finance approved the Successor Agency's Long Range Property Management Plan (Plan) on October 23, 2013; and WHEREAS, Finance has informed the Successor Agency that if properties are sold pursuant to the Plan the Successor Agency does not need to submit the sale to the local Oversight Board or Finance for approval; and WHEREAS, under Health and Safety Code section 34179, all local Oversight Boards are dissolved as of June 30, 2018, shifting the responsibility to countywide oversight boards and out of control of local officials; and WHEREAS, the Plan indicates the best disposition of the Successor Agency -owned parcels located at 21704 South Figueroa Street and 526 West Carson Street (Property) is to hold for a land assembly with the adjacent parcels for future mixed-use development consistent with the Carson Street Master Plan; and WHEREAS, the Successor Agency wishes to sell and the Carson Housing Authority (Buyer) wishes to purchase these parcels for such purpose, and therefore the sale of the Property is in accordance with the approved Plan; and WHEREAS, the sale price of the parcels is $33.16 per square foot and the total price of $571,938.04, based on the per -square -foot price the property across street sold to Thomas Safran & Associates for $628,000; and RESOLUTION NO. 18 -08 -CSA Page 1 of 4 WHEREAS, the publication of the notice of public hearing describing the proposed sale of the Property was made pursuant to Government Code §§ 37422 and 37423 by circulation in a daily newspaper published and circulated in the City; and WHEREAS, pursuant to Government Code §37421, persons wishing to protest the sale of the Sale Property must present testimony at the time and place designated herein for the hearing to consider the sale of the Property or submit written statements protesting the sale with the Agency Secretary prior to such hearing; and NOW, THEREFORE, BE IT RESOLVED BY THE SUCCESSOR AGENCY AS FOLLOWS: Section 1. That the above recitals are true, correct, and incorporated herein. Section 2. Notice of the public hearing to consider the sale of the Property was published twice in a daily newspaper published and circulated in the City. Section 3. The Successor Agency approves the Purchase and Sale Agreement with the Carson Housing Authority for the sale of the Property, in accordance with the Finance -approved Plan and MSC section 34181 (f), in a form acceptable to the Agency Counsel. Section 4. The Successor Agency hereby directs that the proceeds of sale of the Property, pursuant to the Plan, be distributed in accordance with the Plan. Section S.
