AUTHORIZING CONTRACT FOR REPAIR SERVICE
WHEREAS, On or about November l 5, 1997 it was discovered that the Etheridge
Drive Force Main (The "Force Main") was leaking; and
WHEREAS, upon inspection it was determined that the leak was causing affluent to
seep out of the ground and into the storm sewer causing potential harm to the health,
safety and welfare of residents; and
WHEREAS, in order to maintain service to the residents in the area it was necessary
to continue to operate the Force Main; and
WHEREAS, permitting the Force Main to continue to operate without immediate
repair would have placed it in jeopardy of bursting thereby causing a serious risk to
the health, safety and welfare of the Borough; and
WHEREAS, The Borough Engineer has certified that an emergency repair was
needed; and
WHEREAS, B & W Contracting Co. performed emergency repairs.
NOW, THEREFORE, BE IT RESOLVED that subject to the certification of funds
by the Borough's Chief Financial Officer, a contract is hereby awarded to B 8: W
Contracting Co., Matawan, New Jersey, in an amount not to exceed $16,896.00.
BE IT FURTHER RESOLVED, that this award is made without competitive
bidding pursuant to NJSA 40A:l 1-6 in that an emergency which threatened the
health, safety and welfare of the Borough existed on November 15, 1997, thus
necessitating the emergent repairs.
BE IT FURTHER RESOLVED, that notice of this action shall be published as
required by law within ten (10) days from the date of adoption.
BE IT FURTHER RESOLVED, that the Borough Clerk is hereby authorized to
forward a true copy of this resolution to B & W Contracting Co., Matawan, New
Jersey.
Adopted this 18th day of December, 1997
and certified as a true copy of the original
on December 19, 1997.
