The regular meeting of the City Council was called to order by 2. Mayor Merritt at 7 :30 P. M. Rec. R. E. Schulz of the Lutheran Church, 9123 Broadway, Temple City, gave the invocation followed 3. by the Pledge of Allegiance to the Flag led by Mayor Merritt. 4. APPROVAL OF MINUTES: Regular meeting of Jan. 11, 1965. Councilman Dickason corrected the typographical error page 2 paragraph 8 written "ease" which should have been "east ". City Manager 'Aloollett made the following corrections: Page 2 paragraph one the motion should have added "and authorize the Mayor and City Clerk to sign the necessary Agreements: page 3 item 15 on the appeal on the Zone Variance No. 64 -140 should read "new zoning ordinance and the Council must render a decision based upon the. record. Councilman Nunamaker moved to approve the min- utes of Jan. 11, 1965, as corrected,. ORDINANCE NO. 65 -145: 2nd read. City Manager Woollett read title to Ordinance No. 65 -145 AN ORDI- NANCE OF THE CITY OF TEMPLE CITY, CALIFORNIA, DECLARING THE INTER! Moore Planning Director Cushman presented the request to create a se- cond parcel with less than required area for a second house and lacking street frontage. The area in front would consist of 7200 sq. ft. with the rear area approximately 6300 sq. ft. inclu ing a wide driveway leading in from the street to the rear parce' He reported the Planning Commission findings that contiguous par cels to north and south of this property are not so developed, and the area across the street could not be considered for secon, houses. For these reasons the Planning Commission denied the request at a Public Hearing held Dec. 7, 1964. Following considerable discussion Councilman Nunamaker moved to uphold the decision of the Planning Commission, Councilman Harke, seconded, and carried by the following roll call vote: AYES: Councilmen.Harker, Nunamaker, Merritt NOES: Councilmen -None ABSTAINING: Councilman - Dickason ABSENT: Councilman - Tyrell 9. REQUEST FOR EXCUSE FROM BID, BRENT:''OOD LANDSCAPE CO: Temple City Park improvements. Asst. City Manager Koski presented a written request for excuse from bid from Brentwood Landscape Co. He advised bid opening for this project #15, Temple City Park Additions, was held in the City Hall on January 11, and four bids were received as follows: 1. Low Bid, Brentwood Landscaping Co. base bid $35,069. Alt. #1 134. 2. Joe Delgado Co. Total bid $35,203. #i d $42150. Total bid $43,022. 3. Geisler Constr. Co. base bid $43,446. alt. #1 180. Total bid $43,626. 4. Valley Crest Constr. Co. base bid $45,000. alt. #1 219. Total bid $45,219. Mr. Koski advised the 5% bid bond had been posted with the bid. The Council awarded the bid as low bidder to Brentwood Landscap- ing Co. on January 11, 1965, and the Following day they verbally requested to be excused due to their statement that an error had been made as the concrete work had been figured at $4,314. and it should have been $14,314. There followed a lengthy discussion by the Councilmen with the City Attorney explaining the legal obligations and aspects of the situation. The Mayor asked if anyone from the Brentwood Landscaping Co. was present and wished to speak in their behalf but no one came forward to do so. Councilman Dickason moved to award the bid to Brentwood Landscap- ing Co., Councilman Harker seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilmen - Tyrell 10. PARKS & RECREATION COMMISSION RECOMMENDATIONS: a. ORDINANCE NO. 65 -146: amending Municipal Code to permit Coun- cil to grant permission to advertise for charitable purposes in the public parks. Asst. City Manager Koski advised under present Code this is not permissible. Following discussion it was decided the staff would draw up a proposed application to be submitted to the Council for their consideration prior to any per mit of this nature being granted. Councilman Dickason moved to waive further reading of Ordinance No. 65 -146, Councilman Nuna- maker seconded, and carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilmen - Tyrell , As this was the first reading of the ordinance no further action was taken. 696 Council Minutes, January 25, 1965, page 3 b. Recommend expenditure of $216. to assist American Little League in improvement of surface condition of ball diamonds at Live Oak Park. The Asst. City Manager advised the Coun- cil the Little League offered to furnish all the labor and one - half of the material necessary for this improvement which in total would amount to some $1200. Following discussion regarding availability of funds Councilman Nunamaker moved to approve this expenditure of $216. as recommended by the Commission, Councilman Dickason seconded, carried by the following roll call vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell 11. PLANNING COMMISSION RECOMMENDATIONS: a. approval of Tentative Tract #30243 Planning Director Cushman presented the proposed development of a condominium of 44 apartments proposed to be built on the north- west corner of Temple City Blvd. and Broadway, and advised the Planning Commission approved the Tentative Tract with conditions which he outlined to the Council. Councilman Nunamaker moved to approve the recommendation of the Planning Commission, Council- man Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell 12. ORDINANCE NO. 65 -147: Amending Municipal Code Zoning Map. The City Attorney read in full Ordinance No. 65-147 which incor- porates into the Zoning Map the final zoning approved by the Council recently. Councilman Dickason moved to introduce Ordi- nance No. 65 -147 as read by the City Attorney, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell Followina discussion the City Attorney will add the urgency clause to this Ordinance and present it at the next Council meet- ing whereby it will become effective immediately, rather than waiting an additional 30 days following second reading. 13. PROPOSED MALL TYPE DEVELOPMENT ON ALLEYS JUST NORTH AND SOUTH OF LAS TUNAS DR. The City Manager presented a proposed map and plan where by giv- ing up the east -west alleys just north and south of Las Tunas Dr, a mall could be created with sidewalks, plantings and additional parking places. The plan included the merchants developing rear entrances to their stores and could possibly be developed for approximately 10 blocks eventually but could also be developed a-section at a time. If developed in this manner it was Felt the owners of the buildings should be allowed to extend their build- ing the full length of the lot without furnishing additional parking which is now required inasmuch as they were participating in the mall parking. Also the possibility of putting the utility poles was discussed. The City Manager recommended the Council approve the proposal and instruct the staff to have the assess- ment engineer to design for Parking Lots 1, 3 and 4 should be made in conformance with this proposal, Councilman Harker second- ed, roll call vote to carry as follows: AYES: Councilmen- Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman Tyrell Councilman Harker moved to instruct the Planning Director, staff and City Attorney to prepare the necessary changes to the ordi- nance which would permit owners of buildings, backs of which face on this Mall to build out to the property line if they so desire, Councilman Nunamaker seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell The City Manager requested the Council to indicate their willing- ness to pay en ?ineers costs, design, inspection, preparation of plans and specifications, going to bid and supervising the con- struction for all of these developments proposed north of Las 697 Council Minutes, January 25, 1965, page 4 Tunas Dr. Oak Ave. to Kauffman and south of Las Tunas from Cloverly to Golden ^lest. RESOLUTION NO. 65 -433: authorization to go to bond on Parking District No. 2 City Manager Woollett advised the unpaid assessments in Parking District 2 amounted to $52,809.79 which will have to go to bond and explained this Resolution gives the legal authority to do so, He read title to Resolution No. 64 -433 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, CALLING FOR SEALED BIDS ON BONDS TO BE ISSUED TO REPRESENT UNPAID ASSESSMENT; UPON LANDS IN VEHICLE PARKING DISTRICT NO. 2 OF SAID CITY. Coun- cilman Harker moved to adopt Resolution No. 65 -433, Councilman Nunamaker seconded, carried by the following roll call vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell 15. RESOLUTION NO. 65 -432: authorizing temporary employees in Re- creation Dept. The City Manager advised these were replacements and read title to Resolution No. 65 -432 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY APPOINTING PART -TIME AND TEMPORARY EMPLOYEES. Councilman Dickason moved to adopt Resolu- tion No. 65 -432, Councilman Harker seconded, carried by the following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell 16. SET PUBLIC HEARING: CURB & GUTTER: south side Broadway 9700 bloc!' Asst. City Manager Koski advised the petition was signed by property owners representing 72.3% of the lineal footage, and recommended a public hearing be set for February 8 at 7:30 P. M. Councilman Nunamaker so moved, Councilman Harker seconded, carried by following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell 17. RESOLUTION NO. 65 -431: Warrants & Demands City Manager',!oollett presented Resolution No. 65 -431, warrants and Demands #6040 through #6063, in the sum of $44,521.44 Councilman Harker moved to adopt Resolution No. 65 -431, Council- man Dickason seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell 18. COMMUNICATIONS: City Manager Woollett presented a letter from the L. A. County Boundary Commission re proposed annexations 342A and 352, City of El Monte. Councilman Dickason moved to receive and file, Councilman Harker seconded, and carried. 19. TIME FOR THOSE IN THE AUDIENCE WHO :t!ISH TO SPEAK: Dick Stearns, 5539 Loma, asked for information concerning the proposed Mall and its effect on the local businessman and if it was being coordinated with all other plans of this type with reference to new businesses, etc. and was advised by Councilman Nunamaker that this was being done also. 20. MATTERS FROM CITY OFFICIALS: Councilman Nunamaker asked about parking on lawns, easements, etc. and the City Manager advised there was no question that it is not allowed on the road ease- ments but that a legal interpretation of the working and use of the word "storage" would have to be made before enforcement or prohibition could be accomplished. The Council also discussed the Juvenile crime problem and the 698 Council Minutes, January 25, 1965, page 5 recommendation of Supervisor Bonelli that for major crimes the names of the juvenile and the parents be exposed and published rather than protect them from publicity. Councilman Harker requested instructions from the Council for their position on a tax to be imposed for the Transit authority which is to be acted on at the next League of Calif. Cities meet- ing. The Councilmen felt it should not be a property tax but preferably an "in lieu" tax. They also were not in favor of peace officers carrying weapons. City Attorney Shatford read title to Resolution No. 65 -434 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHOR- IZING THE ADVANCE OF FUNDS FOR THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC PARKING PURPOSES IN CONNECTION '.JITH PARKING DISTRICT NO. 2 PURSUANT TO THE PROVISIONS OF VEHICLE PARKING DISTRICT LAW OF 1943. He explained this pertained to the escrow agreement with Dillman A. Hill and Rosella M. Bradley entered into last Sept. and which title must be acquired before the contracts can be let and this advances the money to close the escrow in the sum of $36,000 which amount will be repaid back to the City as soon as the funds are availabe in the Parking District through the sale of the bonds and the funds already advanced on assessments. Councilman Nunamaker moved to adopt Resolution No. 65 -434, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell City Attorney Shatford read title to Resolution No. 35 -435 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHOR- IZING THE ADVANCE OF FUNDS FOR THE ACQUISITION OF CERTAIN REAL PROPERTY FOR PUBLIC PARKING PURPOSES IN CONNECTION 'JITH PARKING DISTRICT NO. 2 PURSUANT TO THE PROVISIONS OF VEHICLE PARKING DISTRICT LA',/ OF 1943. The City Attorney explained this was a similar situation as the one above and this property by Agreement between owners Waiva Wells and Maude Kemp is to be purchased for the sum of $29,000. and this resolution authorizes the advance- ment of funds in this amount by the City until such time as the money is available from the sale of bonds in the Parking District Councilman Harker moved to adopt Resolution No. 35 -435, Council- man Dickason seconded, carried by the following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell City Manager Woollett presented a letter from the office of the County recommending the City accept the Masonry 'Wall in Tract #28317, Community Disposal Co., and also that you authorize the cancellation of the Faithful Performance Bond #01 -B-97679 in that connection with the Surety the Pacific Employers Insurance Company, 1033 S. Hope St., Los Angeles, Calif. Councilman Harker so moved, Councilman Nunamaker seconded, roll call vote to carry as follows: AYES: Councilmen- Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell The City Manager presented a letter requesting a charitable soli- citation permit for the Lincoln Training! Center for a shoe sale at the Legion Hall on Las Tunas Dr. on Jan. 28 -29, 10:30 A. M. to 8 :30 P. M. Councilman Nunamaker moved to approve, Councilman Harker seconded, carried by the following called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Merritt NOES: Councilmen -None ABSENT: Councilman - Tyrell Mr. Woollett presented a letter from the Camellia Festival giving a list of vendors for the parade and Festival.
