HomeMy Public PortalAboutMIN-CC-2001-05-22MOAB CITY COUNCIL REGULAR MEETING May 22, 2001 The Moab City Council held their regular meeting on the above date in the Council Chambers of Moab City Offices, located at 115 West 200 South, Moab, Utah. Mayor Karla Hancock called the Pre -Council Workshop to order at 6:30 PM. Mayor Hancock called the Regular City Council Meeting to order at 7:00 PM; Citizen T.R. Ritchie led in the Pledge of Allegiance. Also in attendance were Councilmembers Gregg W. Stucki, Joseph Lekarczyk, Kirstin Peterson, Rob Sweeten and Kyle Bailey; City Manager Donna Metzler, City Recorder/Assistant City Manager Rachel Ellison, Public Works Director Brent Williams, Police Chief Michael NaVarre, Planning and Community Development Director David Olsen and City Planner Robert Hugie. Ten (10) members of the audience were present. Councilmember Stucki moved to approve the Regular Meeting Minutes of April 10, April 25 and May 8, 2001 and the Special Meeting Minutes of April 19, April 26, May 3, and May 15, 2001 with the additions of the direction given to the Chamber of Commerce during their presentation at the April 24, 2001 meeting and the addition of the direction given to the Arts Festival for their Special Event License at the May 8, 2001 meeting. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Under Citizen to be Heard, T.R. Ritchie who lives on Locust Lane stated that traffic is bad on Locust Lane and requires some traffic calming. Mr. Ritchie stated that Public Works Director Williams and Police Chief NaVarre had come out to examine the problem and would be placing some signs on the street. Mr. Ritchie also suggested using speed bumps, traffic islands or curb extensions. Mr. Ritchie stated that Locust Lane has become a main artery for traffic and that he would like to see something that slows down traffic twenty-four hours per day. Mr. Ritchie then submitted a petition from citizens along Locust Lane requesting that traffic be controlled. Mr. Ritchie stated that the radar trailer has been very helpful. Councilmember Sweeten stated that he had received a speeding ticket on 200 South and that it had raised his insurance premium by a total of $800.00 and that has kept him from speeding. Councilmember Sweeten stated that he thinks the culprits are locals and not tourists and he suggested lowering the speed limit from 25 to 20 miles per hour. Councilmember Peterson inquired of Police Chief NaVarre if the Police Department had focused on controlling speed or considered a slow down in Moab campaign, perhaps a week of warnings followed by a week of tickets. Police Chief NaVarre stated that the department already does but they don't advertise which area and they move from one problem area to another. Police Chief NaVarre stated that the radar trailer helps Under Planning Update, City Planner Hugie stated that the Planning Commission would be conducting a public hearing on the draft general plan on Thursday, June 14, 2001 at 7:00 PM. Under Public Works Department Update, Public Works Director Williams stated that his departments were gearing up for the Arts Festival and that the blocked streets seemed to work well the previous year and the street plan was reviewed by the Grand County Sheriff's REGULAR MEETING & ATTENDANCE APPROVAL OF MINUTES CITIZENS TO BE HEARD CITY PLANNING PUBLIC WORKS UPDATE Office and the Fire Department. Councilmember Peterson inquired if the pile of blocks on the pathway could be removed. Public Works Director Williams stated that they would be moved. Councilmember Lekarczyk inquired about the rubble next to Star Hall. Public Works Director Williams stated that it would be taken to the Landfill but would cost $2,000. Councilmember Sweeten stated that a bench at Rotary Park was unbolted and dangerous. Public Works Director Williams stated he would inform Parks Superintendent Marshall of the problem. Under Police Department Update, Police Chief NaVarre distributed a written report. Mayor Hancock stated that she had received a copy of a certificate of appreciation for DARE from the First Assembly of God Church and that the Rod Benders had thanked the DARE program and made a contribution to the program. Councilmember Bailey stated that there would be an all night party for the high school graduates at Rotary Park and that the Police Department was invited. Councilmember Sweeten moved to Approve a Request to Send Proposed Ordinance #2001-08 — An Ordinance Setting the Salaries for the Exempt Positions of the City of Moab to Public Hearing. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to Approve a Request by the Canyonlands Rodeo Association for Shower and Swim Fees Waiver on June 9, 2001 from 11:00 to 2:30 PM, for Approximately 55 Students and 2 Adults from the Richfield High School Band Performing in the Butch Cassidy Days Parade with the condition that the group be split in half Councilmember Bailey seconded the motion. The motion carried 5-0 aye by a roll -call -vote. For the Millcreek — 500 West Under Bridge Improvement Project, bids were received as follows: KSUE Corporation $83,700 Mays Concrete $140,700 Councilmember Peterson moved to Award the Millcreek — 500 West Under Bridge Improvement Project to KSUE Corporation in the amount of $83,700. Councilmember Stucki seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Bailey moved to Approve of the Millcreek — 500 West Under Bridge Project Contract. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Bailey moved to Approve of a Home Occupation License for Bob Walker, d.b.a. Bob Walker Art & Design Located at 268 East 100 South to Conduct a Graphic Design Business. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. POLICE DEPARTMENT UPDATE REQUEST TO SEND PROPOSED ORDINANCE #2001-08 TO PUBLIC HEARING, APPROVED REQUEST BY THE CANYONLANDS RODEO ASSOCIATION FOR SHOWER AND SWIM FEES WAIVER, APPROVED 500 WEST UNDERBRIDGE IMPROVEMENT PROJECT BID 500 WEST UNDERBRIDGE IMPROVEMENT PROJECT BID AWARDED TO KSUE CORPORATION 500 WEST UNDERBRIDGE IMPROVEMENT PROJECT CONTRACT APPROVED HOME OCCUPATION LICENSE FOR BOB WALKER Councilmember Bailey moved to Approve a Request for Use of Swanny City Park by Moab Rod Benders Car Club on April 26 and 27, 2002 to Conduct a Classic Car Show. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to Approve a Request by Jon Olschewski to Hold an Amplified Music Event at Old City Park on June 8 and June 9, 2001. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to Approve Proposed Ordinance #2001-09 — An Ordinance Amending Section 13.24.030 of the Moab Municipal Code and Allowing for the City Treasurer Upon Approval by the City Manager to Give Rebates for Excessive Water Leaks. Councilmember Peterson seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Mayor Hancock opened a Public Hearing on Proposed Resolution #06- 2001 — a Resolution Adopting the Fiscal Year 2001-2002 Budget; Community Development Block Grant 2001-2002 Sun Court Project; and Community Development Block Grant 2002-2003 Star Hall Project. For Proposed Resolution #06-2001 - Judy Powers and Sharon Brussel of the Moab Valley Humane Society thanked the City Council for their contribution and stated that it really made a difference. Ms. Brussel stated that they hoped to have the County match part or all of the contribution. No public comment was made on the Community Development Block Grant public hearings. Mayor Hancock closed the Public Hearings at 7:32 PM. Councilmember Peterson moved to Approve Proposed Resolution #10- 2001— A Resolution Amending the City of Moab Personnel Polices and Procedures Manual with additions of paying only a single premium for health and dental insurance. Councilmember Bailey seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Bailey moved to Approve Proposed Resolution #11- 2001 — A Resolution Approving A Right -Of -Way Vacation Adjacent to The Rio Colorado Cafe And Bar at 2 South 100 West. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye by a roll -call - vote. Under Reading of Correspondence, Councilmember Peterson stated that she had spoken to Myron Lee at UDOT and that he stated that they had made more changes to the lights to accommodate pedestrian traffic. Councilmember Peterson stated that UDOT was receptive to comments and was trying to meet our needs. Under Administrative Reports, City Manager Metzler City Manager Metzler distributed a written report. Under Mayor and Council Reports, Mayor Hancock stated that she had attended the Legislative Policy Committee meeting and that it had been interesting. Councilmember Sweeten moved to pay the bills against the City of Moab in the amount of $83,880.84. Councilmember Peterson seconded the motion. The motion carried 5-0 aye by a roll -call -vote. REQ FOR USE OF SWANNY CITY PARK BY MOAB ROD BENDERS CAR CLUB ON APRIL 26 AND 27, 2002, APPROVED REQBY JON OLSCHEWSKI TO HOLD AN AMPLIFIED MUSIC EVENT AT OLD CITY PARK, APPROVED PROPOSED ORDINANCE #2001-09, APPROVED PUBLIC HEARING OPENED PUBLIC COMMENT PUBLIC HEARING CLOSED PROPOSED RESOLUTION #10-2001, APPROVED PROPOSED RESOLUTION #11-2001, APPROVED READING OF CORRESPONDENCE ADMINISTRATIVE REPORTS MAYOR AND COUNCIL REPORTS APPROVAL OF BILLS Councilmember Bailey moved to enter an Executive Session for a Strategy Session to Discuss the Purchase, Exchange or Lease of Real Property. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. An Executive Session was entered at 8:25 PM. Councilmember Lekarczyk moved to close the Executive Session. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. The Executive Session was closed at 8:45 PM. Mayor Hancock adjourned the meeting at 8:45 PM.
