HomeMy Public PortalAboutMIN-CC-2001-06-26MOAB CITY COUNCIL REGULAR MEETING June 26, 2001 The Moab City Council held their regular meeting on the above date in the Council Chambers of Moab City Offices, located at 115 West 200 South, Moab, Utah. Mayor Karla Hancock called the Pre -Council Workshop to order at 6:30 PM. Mayor Hancock called the Regular City Council Meeting to order at 7:00 PM; Councilmember Gregg W. Stucki led in the Pledge of Allegiance. Also in attendance were Councilmembers Joseph Lekarczyk, Kirstin Peterson, Rob Sweeten and Kyle Bailey; City Manager Donna Metzler, City Recorder/Assistant City Manager Rachel Ellison, Police Chief Michael NaVarre, Planning and Community Development Director David Olsen and City Planner Robert Hugie. Sixteen (16) members of the audience were present. Councilmember Peterson moved to approve the Regular Council Meeting Minutes of May 22, 2001. Councilmember Stucki seconded the motion. The motion carried 4-0 aye. There were no Citizens to be Heard. Under Planning Update, City Planner Hugie stated that the Planning Commission had conducted a public hearing on the draft General Plan on Thursday, June 14, 2001 at 7:00 PM and that seventeen or eighteen people had attended. City Planner Hugie stated that the General Plan would be on the July 10th City Council Agenda as a request to go to public hearing. City Planner Hugie also stated that he would schedule a Joint City Council/Planning Commission meeting for the first meeting in August. A Public Works Department Update was not given. Under Police Department Update, Police Chief NaVarre distributed a briefing sheet. Police Chief NaVarre stated that the state would be closing a prison and that forty-nine inmates would be returned to our community. Councilmember Bailey moved to approve a Request by the Fourth of July Celebration Committee for a Waiver of the Damage Deposit for Use of Swanny City Park in the amount of $1,000.00. Councilmember Peterson seconded the motion. The motion carried 4-1 aye by a roll -call - vote with Councilmember Lekarczyk voting nay. Councilmember Sweeten moved to approve a Fireworks License for City Market, Located at 425 South Main Street to Conduct Sales of Fireworks. Councilmember Bailey seconded the motion. The motion carried 4-1 aye with Councilmember Peterson voting nay. Councilmember Peterson moved to approve Proposed Ordinance #2001- 08 — An Ordinance Setting the Salaries for the Exempt Positions of the City of Moab. Councilmember Sweeten seconded the motion. The motion carried 4-1 aye with Councilmember Stucki voting nay. Councilmember Sweeten moved to Send Ordinance #2001-09 — An Ordinance Amending Section 17.06.020 (5) of Chapter 17.06, Title 17, of the Moab Municipal Code Regarding the Definition of a Carport to Public Hearing. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. REGULAR MEETING & ATTENDANCE APPROVAL OF MINUTES CITIZENS TO BE HEARD CITY PLANNING PUBLIC WORKS UPDATE POLICE DEPARTMENT UPDATE REQUEST BY THE FOURTH OF JULY CELEBRATION COMMITTEE FOR A WAIVER OF THE DAMAGE DEPOSIT, APPROVED FIREWORKS LICENSE FOR CITY MARKET, APPROVED PROPOSED ORDINANCE #2001- 08, APPROVED ORDINANCE #2001-09 SENT TO PUBLIC HEARING, APPROVED Mayor Hancock opened a public hearing on Proposed Resolution #13- 2001— A Resolution Amending the Fiscal Year 2000/2001 Budget at 7:32 PM. No public comment was given. Mayor Hancock closed the public hearing and opened a public hearing on the Solicitation of Public Input on a Request for Approval of Temporary Class I and II Beer Licenses by Cathy Gardner for Ray's of Moab Located at 53 West 400 North at 7:32 PM. Pastor Joseph S. Rooney of Saint Pius X Catholic Church read the following letter into public record: St. Pius Catholic Church is one of the two churches in the proximity of the above location (53 West 400 North). St. Pius has not objection to the granting of this application for a beer license. "Ray's of Moab" has as its primary business the sale of food, the offering of the opportunity for its customers to purchase beer would appear to be secondary. The owners have run a similar establishment in Green River, Utah for a number of years and have a fine reputation in that community. We expect that the same would also be true here in Moab. Mayor Hancock closed the public hearing at 7:35 PM. Councilmember Peterson moved to approve a Request for Temporary Class I and II Beer Licenses by Cathy Gardner for Ray's of Moab Located at 53 West 400 North stating that the property meets the exceptional and practical difficulties as outlined in Moab City Code 5.20.360 B-1. Councilmember Lekarczyk seconded the motion. The motion carried 3-2 aye with Councilmembers Sweeten and Stucki voting nay. Councilmember Peterson moved to approve Proposed Resolution #13- 2001— A Resolution Amending the Fiscal Year 2000/2001 Budget. Councilmember Stucki seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Sweeten moved to approve Proposed Resolution # 14- 2001— A Resolution Increasing the Monthly Uniform Allowance Rate for Public Safety Employees. Councilmember Peterson seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Bailey moved to approve Proposed Resolution #15- 2001 — A Resolution Approving an Interlocal Agreement for the Coordination of the Moab Area Partnership Senior Service (MAPSS) Planning Project by and Between Grand County and the City of Moab. Councilmember Lekarczyk seconded the motion. The motion carried 5- 0 aye by a roll -call -vote. Councilmember Stucki moved to approve Proposed Resolution # 16- 2001— A Resolution Approving the Solid Waste Collection Contract Amendment Number Two. Councilmember Bailey seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Bailey moved to approve a Request by the Moab Ministerial Association to Host a Concert in Swanny Park on August 3 and August 4 . Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve a Request by First Baptist Church of Moab to Use Swanny City Park on July 22 for a Gospel Music PUBLIC HEARING OPENED PUBLIC HEARING CLOSED AND OPENED PUBLIC COMMENT PUBLIC HEARING CLOSED TEMPORARY CLASS I AND II BEER LICENSES BY CATHY GARDNER FOR RAY'S OF MOAB, APPROVED RESOLUTION #13-2001, APPROVED RESOLUTION #14-2001, APPROVED RESOLUTION #15-2001, APPROVED RESOLUTION #16-2001, APPROVED REQUEST BY THE MOAB MINISTERIAL ASSOCIATION TO HOST A CONCERT IN SWANNY PARK, APPROVED REQ. BY FIRST BAPTIST CHURCH OF MOAB TO USE Concert. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to Send a Request by Lisa and Greg Roman for a Right-of-way Vacation Near the Intersection of Pack Creek Drive and Wagner Avenue to Public Hearing with an unfavorable recommendation from the Planning Commission. Councilmember Stucki seconded the motion. The motion carried 3-2 aye with Councilmembers Bailey and Peterson voting nay. Councilmember Peterson moved to Approve a Request by the Planning Commission for an Amendment to the Ballard Subdivision Addition #1 at the July loth Public Hearing. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Councilmember Sweeten moved to approve a Donation of Toys to the 4th of July Organization Committee with a value of approximately $1,260.00 with the condition that whatever toys are not used are returned to the City. Councilmember Bailey seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Sweeten moved to approve a Waiver of All Moab City Swim Center Fees for July 4, 2001 from 1:30 PM to 5:00 PM. Councilmember Stucki seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Lekarczyk moved to approve a Request for a Special Event Class IV Beer License for Knave of Hearts Bakery Located at 84 West 200 North with the condition that the application coordinate with Police Chief NaVarre to construct adequate security fencing. Councilmember Peterson seconded the motion. The motion carried 4-1 aye with Councilmember Sweeten voting nay. There was no Correspondence to be Read. Under Administrative Reports, City Manager Metzler referred to the written report distributed at the June 12, 2001 meeting. Under Mayor and Council Reports, Mayor Hancock stated that she had attended the Association of Local Governments meeting in Price. Councilmember Sweeten moved to pay the bills against the City of Moab in the amount of $70,688.71. Councilmember Stucki seconded the motion. The motion carried 5-0 aye by a roll -call -vote.
