RESOLUTION NO. 01-160
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARSON, CALIFORNIA CALLING A
CLOSED SESSION TO CONFER WITH LEGAL
COUNSEL REGARDING THREE MATTERS OF EXISTING LITIGATION,
CITY OF CARSON V. SENECA 37 ET AL, GOMEZ V. CITY OF CARSON, AND
MATTHEWS V. CITY OF CARSON, AND TWO MATTERS OF POTENTIAL LITIGTION
The City Council of the City of Carson, California hereby finds and resolves:
Section 1. Pursuant to Government Code § 54956.9 (a) and based on advice
from the City Attorney, the City Council determines that a closed session should be held to
confer with or receive advice from the City Attorney regarding two matters of existing litigation,
discussion of which in open session would prejudice the position of the City. The existing
litigation is City of Carson v. Seneca 37 Associates, Inc., et al. , Gomez v. City of Carson, and
Matthews v. City of Carson.
Section 2. Pursuant to Government Code § 54956.9 (b) and based on advice
from the City Attorney, the City Council determines that a closed session should be held to
confer with or receive advice from the City Attorney regarding two matters of potential litigation
involving the City, the discussion of which in open session would prejudice the position of the
City. A point has been reached where, in the opinion of the legislative body of the local agency
on the advice of its legal counsel, based on existing facts and circumstances, there is a potential
for litigation by a third party.
Section 3. A closed session of the City Council of the City of Carson,
California shall be held forthwith, in recess from this regular meeting, pursuant to Government
Code § 54956.9, regarding the matters referred to in Section 1 hereof.
