HomeMy Public PortalAboutResolutions-2010-56 (4)RESOLUTION 2010-56 A RESOLUTION VACATING CERTAIN PROPERTY BY DEED PURSUANT TO SECTION 354.23 IOWA CODE WHEREAS, the City of Tiffin, Iowa received, as part of the platting and dedication of Woodfield Ridge Part One, a public area for sidewalk purposes as it runs five feet on each side of -the lot line that is the boundary between Lot 24 and Lot 25, Woodfield Ridge Subdivision, Part One; AND WHEREAS, Section 354.23, Iowa Code, allows the City to vacate part of an official plat that has been conveyed to the city or dedicated to the public which is deemed by the City Council to be of no benefit to the public, after holding a properly noticed public hearing on the issue; AND WHEREAS, Pursuant to Tiffin Zoning Ordinance 2007-287, Section 9.02, states in part: Whenever any... public way is vacated by official action of the City Council the district adjoining each side of such... public way will automatically extend to the center of the vacation, and all areas in the vacation will then and henceforth be subject to all,appropriate regulations of the districts. NOW THEREFORE, IT IS RESOLVED THAT: 1. A Notice of the date, time, and place of the hearing on this issue was properly published. 2. A Hearing was held on the issue. 3. The City Council determined that, in fact, the below described property was of no benefit to the public and approved it for vacation. 4. The Mayor and City Clerk were authorized to execute Quit Claim Deeds to the adjoining lot owners for their respective properties, as legally described below. 5. That the properties described below shall henceforth be zoned R1 -C Residential. To: Matthew D. Carlson and Holly M. Carlson, husband and wife, as joint tenants. with full rights of survivorship and not a s tenants in common, the following described property, to -wit: Lot #24 Woodfield Ridge Part One, City of Tiffin, Iowa, aka Auditor Parcel 2010-068 A part of Lot #24 of Woodfield Ridge Part One and more particularly described as follows: Beginning at the Southwestern most corner of said Lot #24; thence N27012'42"E along the West line of said Lot #24 a distance of 140.0 feet to the Northwest corner of said Lot 24; thence Southeasterly 5.00 feet along a 77.00 foot radius curve concave Northeasterly whose 5.00 foot chord bears S6325"E; thence S27012'42"W a distance of 140.07 feet to a point on the Southerly line of said Lot #24; thence Northwesterly 5.00 feet along said South line along a 217.00 foot radius curve concave Northeasterly whose 5.00 foot chord bears N63°10'45"W to the point of beginning containing 700.9 square feet more or less. AND TO: Andrew T. Rash and Tara J. Rash, husband and wife, as joint tenants with full rights of survivorship and not as tenants in common, the following described property to -wit: Lot #25 Woodfield Ridge Part One, City of Tiffin, Iowa, aka Auditor Parcel 2010-069 A Part of Lot #25 of Woodfield Ridge Part One and more particularly described as follows: Beginning at the Southeastern most corner of said Lot #25; thence N27'1 2'42"E along the East line of said Lot #25 a distance of 140.0 feet to the Northeast corner of said Lot 25; thence Northwesterly 5.00 feet along a 77.00 foot radius curve concave Northeasterly whose 5.00 foot chord bears N60°10'00"W; thence S27012'42"W a distance of 140.15 feet to a point on the Southerly line of said Lot #25; thence Southeasterly 5.00 feet along said South line along a 217.00 foot radius curve concave Northeasterly whose 5.00 foot chord bears S61 °51'32"E to the point of beginning containing 700.30 square feet more or less. On the 22nd day of November, 2010 at a Special City Council meeting of the Tiffin City Council, Tiffin, Iowa, Council person Mike Gericke introduced Resolution 2010-56 A RESOLUTION VACATING CERTAIN PROPERTY BY DEED PUSUANT TO SECTION 354.23 IOWA CODE and seconded by Council person Chris Ball and made motion for approval. Ayes: Chris Ball, Jim Bartels, Mike Gericke, Mark Petersen, Travis Weipert Nay: None Absent: None With five votes for City Council approval, Mayor Phillips declared that the Resolution 2010-56 A RESOLUTION VACATING CERTAIN PROPERTY BY DEED PUSUANT TO SECTION 354.23 IOWA CODE be adopted and signified his approval of the same by affixing his signature thereto.
