Box 429 * Hillsborough, North Carolina 27278 919-732-2104 • Fax: 919-644-2390 MINUTES PLANNING BOARD December 5, 1995, PRESENT: Wendy Olson (chair), Richard Bradford, Ed Gill, Jack Hughes, Louise Long, Chris Quinn, George Sagar, John Taylor, Doreen Tuell PUBLIC: Margaret Hauth Olson called the meeting to order at 6:30 pm. ITEM #2: Olson reported from the Occoneechee Park Committee that a soils engineer has visited the site to provide assistance in the design of an observation platform. Hauth said she would have a draft of the lighting ordinance for the January meeting. She noted that the Board of Adjustment did not meet in November. Gill expressed an interest in representing the Planning Board on the Parks and Recreation Board. Hauth introduced Jack Hughes, newly appointed Planning Board member. ITEM #3: Taylor moved to approve the minutes as written Hughes seconded. VOTE: Unanimous. ITEM #4a: Hauth introduced draft text amendments to regulate. telecommunication towers. She said the draft is the one currently under consideration by Orange County. Hughes asked if requirement "1" could be made more specific in terms of what qualifies as a historic site, scenic road, or major view corridor and what would constitute unreasonable interference. Hauth said she would consult with Durham staff since the language was drawn from their ordinance. The members discussed the other proposed requirements. Hauth was asked to report on the availability of the existing towers for further use. Taylor asked whether the building could be required to be removed as well as the tower. He explained his recent experience of being approached by a company to locate on his property and what the conditions of the proposed lease were. Hauth said that the town would not review the lease of property, since it is a private agreement. Taylor asked if a bond could be required and then who would post it and be responsible for removal. Hauth said if that were part of the CUP approval, the company would be responsible. She said requiring a bond could present enforcement or administrative issues given the probable long term nature and likelihood of staff turn -overs in the town and with the company. She said she would check with the town attorney. Quinn asked how staff would determine whether the tower is in use. Hauth suggested requesting copies of the renewable license for the frequency. He asked about requiring maintenance. The members agreed that the tower would be considered a capital investment of the company and would likely be issued so that a copy of the insurance policy could also be requested. The members discussed just how far they could go in requiring information from the companies and asked Hauth to get a clear read from the attorney. ITEM #4b: Hauth introduced draft text eliminating the contradiction in Section 9 about non -conforming characteristics. Hughes suggested that the first sentence be separated from the new text to create two sections since they speak to different circumstances. Examples of when compliance would not be required should also be clearly indicated as examples. Hauth said she would prepare new text for the next meeting. ITEM #4c: Hauth introduced the possible need for text amendments relating to the recently expanded park definitions. She noted that since 5 levels of park are defined and allowed in different 12/5/95, page 2 districts and some of them are conditional uses; the conditional use permit standards must be written before someone requests a conditional use permit. She said she included the existing park requirements as reference and asked if these requirements are "sufficient or if others are needed. The members discussed whether separate requirements for each type of park are needed. They agreed the requirements should be separated and be specified to the expected activities in each type of park. Hauth said she would prepare a draft for next time. Members asked if the January 2 meeting is necessary. Hauth said text amendments need to be sent to public hearing, but the date could be changed. Members agreed to delay the January meeting to January 9. Olson adjourned the meeting at 7:52 pm. Respectfully submitted, garet A.
