REGULAR MEETING
July 31, 2001
The Moab City Council held their regular meeting on the above date in
the Council Chambers of Moab City Offices, located at 115 West 200
South, Moab, Utah. Mayor Karla Hancock called the Pre -Council
Workshop to order at 6:30 PM.
Mayor Hancock called the Regular City Council Meeting to order at 7:00
PM; Councilmember Sweeten led in the Pledge of Allegiance. Also in
attendance were Councilmembers Joseph Lekarczyk, Gregg W. Stucki
and Kyle Bailey; City Recorder/Assistant City Manager Rachel Ellison,
Planning and Community Development Director David Olsen, Police
Chief Michael NaVarre, and City Planner Robert Hugie. Seventeen (17)
members of the audience were present.
There were no minutes to approve.
Under Citizens to be Heard, Jeff Davis inquired about the progress
towards solving storm drainage problems in the Stewart Canyon Area.
City Recorder/Assistant City Manager Ellison stated that prior to City
Manager Metzler's vacation, she and Public Works Director Williams
had been negotiating with the Utah Department of Transportation and
private property owners to resolve the issues.
Under Planning Update, City Planner Hugie distributed a written report.
A Public Works Department Update was not given.
Under Police Department Update, Police Chief NaVarre distributed a
written report.
Councilmember Bailey moved to approve the Proposed Ballard
Subdivision. Councilmember Sweeten seconded the motion. The
motion carried 4-0 aye.
Councilmember Sweeten moved to Send a Temporary Class II Beer
License for Michelle Kelley, d.b.a. Desert Bistro Located at 92 East
Center Street to Public Hearing. Councilmember Lekarczyk seconded
the motion. The motion carried 4-0 aye.
Councilmember Sweeten moved to approve a Home Occupation License
for Nathan Haag, d.b.a. Dog -Gone Fashions.com Located at 109 West
Kane Creek Boulevard #22 to Conduct a Pet Apparel Business with the
following conditions:
1) There be no employees who are not residents of the apartment.
2) All sales and deliveries are to be by mail, internet or phone.
There shall be no person -to -person sales or deliveries on or from
the site.
3) No commercial type sewing machines are to be used on site.
Only sewing machines typically used in the home are permitted.
Councilmember Stucki seconded the motion. The motion carried 4-0
aye.
Councilmember Sweeten moved to approve the Concept of an Extension
to the Pack Creek Parkway Project Located at Approximately 817 South
Main Street with the condition that the easement property be cleared of
encumbrances. Councilmember Stucki seconded the motion. The
motion carried 4-0 aye.

Councilmember Sweeten moved to approve a Temporary Class III Beer
License for Howard Kent, d.b.a. Moab Chevron Located at 817 South
Main Street. Councilmember Lekarczyk seconded the motion. The
motion carried 4-0 aye.
Councilmember Sweeten moved to approve a Temporary Class II Beer
License for Paul McCarroll, d.b.a. Center Cafe Located at 60 North 100
West. Councilmember Bailey seconded the motion. The motion carried
4-0 aye.
Councilmember Sweeten moved to approve the Job Description for the
Moab Arts and Recreation Center Administrative Assistant.
Councilmember Lekarczyk seconded the motion. The motion carried 3-
1 aye with Councilmember Stucki voting nay.
Councilmember Lekarczyk moved to Send Proposed Resolution #17-
2001 — A Resolution Adopting the Moab City General Plan to Public
Hearing. Councilmember Sweeten seconded the motion. The motion
carried 4-0 aye.
Mayor Hancock opened a public hearing on Public Input on a Proposed
City Right -of -Way Vacation Near the Intersection of Pack Creek Drive
and Wagner Avenue at 7:30 PM.
Lisa Roman spoke representing the requesters. Ms. Roman stated that
she would like assurance that they can continue to use the property as a
garden and that they would like to plant some fruit trees. Ms. Roman
stated that she had purchased the property in good faith from Grand
County and then found out it was City property.
Councilmember Sweeten inquired if City Recorder/Assistant City
Manager Ellison could research long-term use agreements for City
rights -of -ways.
Mayor Hancock closed the public hearing at 7:42 PM.
Mayor Hancock opened a public hearing on Public Input on Proposed
Ordinance #2001-11 — an Ordinance Amending Section 17.06.020 (5),
of Chapter 17.06, Title 17, of the Moab Municipal Code Regarding the
Definition of a Carport at 7:42 PM.
City Planner Hugie stated that the current ordinance reflected the
changes discussed previously by the Council with the exception of the
side setback, which had been changed from one foot to three feet due to
fire code.
Grand County Building Inspector Jeff Whitney stated that due to
Uniform Building Code, in order to build within less than three feet of a
property line there needed to be a one hour fire -rated wall on the
property line side and that the current ordinance defined a carport to be
open on three sides which would not meet that requirement. Building
Inspector Whitney stated that the options were to change the definition
of a carport to open on two sides, which would allow building within
one foot of the property line, or changing the ordinance to restrict
building to within three feet of the property line.
Mayor Hancock closed the public hearing at 7:52 PM.

Under Mayor and Council Reports, Mayor Hancock stated that she had
attended the Moab Utah 2002 meeting and that the committee was
working on the Gold Medal Mile.
Councilmember Bailey stated that the Grand Valley Water Agency had
sold SITLA 270 ERUs (Equivalent Residential Units) and would be
drilling another well. Councilmember also stated that George White's
property sale was pending. Councilmember Bailey stated that there
would be a Grand Water and Sewer Service Agency meeting on August
15, 2001 with North End property owners to determine how to pay for
improvements.
Councilmember Sweeten moved to pay the bills against the City of
Moab in the amount of $150,664.95. Councilmember Bailey seconded
the motion. The motion carried 4-0 aye by a roll -call -vote.
