HomeMy Public PortalAboutMIN-CC-2001-08-14MOAB CITY COUNCIL REGULAR MEETING August 14, 2001 The Moab City Council held their regular meeting on the above date in the Council Chambers of Moab City Offices, located at 115 West 200 South, Moab, Utah. Mayor Karla Hancock called the Pre -Council Workshop to order at 6:30 PM. Mayor Hancock called the Regular City Council Meeting to order at 7:00 PM; City Manager Metzler led in the Pledge of Allegiance. Also in attendance were Councilmembers Joseph Lekarczyk, Rob Sweeten, Kirstin Peterson, Gregg W. Stucki and Kyle Bailey; City Recorder/Assistant City Manager Rachel Ellison, Public Works Director Brent Williams, Planning and Community Development Director David Olsen, Police Chief Michael NaVarre, and City Planner Robert Hugie. Nineteen (19) members of the audience were present. Councilmember Stucki moved to approve the Regular Meeting Minutes of July 10 and July 31 and the Special Meeting Minutes of July 17, 2001. Councilmember Sweeten seconded the motion. The motion carried 5-0 ayes. Under Citizens to be Heard, Saina from the Moab Area Chamber of Commerce introduced Randy Martin, the new Administrator for the Chamber of Commerce. Jolene Welch and Reva Webber spoke regarding a weed control problem on Bowen Circle. Ms. Welch stated that she had spoken to Planning and Community Development Director Olsen and Temporary Planning Assistant Roberts and that they had stated that it was hard to interpret the weed ordinance. Ms. Welch and Ms. Webber then distributed color photographs of the problem yards. Ms. Welch stated that she would like something done and that she has to pay for yard maintenance and that because of this problem, she is losing the value of her home. City Manager Metzler stated that staff would schedule a meeting with the complainants to resolve the issue. Under Planning Update, City Planner Hugie distributed a written report. Under Public Works Department Update, Public Works Director Williams stated that the recent flooding on Cermak was due to a ditch that had been filled in that needed to be reopened. Public Works Director Williams also stated that Stewart Canyon was in the County not in the City and that he had met with the Utah Department of Transportation to establish a larger ditch along the highway to aid with storm drainage. Public Works Director Williams also stated that the easements for the Tusher outflow were almost secured as were the easements for Walker dam. Public Works Director Williams stated that the 500 West Underbridge was progressing as was the 300 South project which is really a storm drainage project. Public Works Director Williams stated that turn lanes had been eliminated on the 500 West project and would be changed to two twelve foot travel lanes and a twelve foot median. Under Police Department Update, Police Chief NaVarre stated that the Police Department had been busy with flooding issues and were receiving eighteen to twenty-two Animal Control calls per shift. Councilmember Lekarczyk moved to move the Agenda to a Request for a Permanent Class III Beer License for Howard Kent, d.b.a. Moab REGULAR MEETING & ATTENDANCE APPROVAL OF MINUTES CITIZENS TO BE HEARD PLANNING UPDATE PUBLIC WORKS UPDATE POLICE DEPARTMENT UPDATE AGENDA MOVED Chevron. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve a Request for a Permanent Class III Beer License for Howard Kent, d.b.a. Moab Chevron, located at 817 South Main Street. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Permanent Class II Beer License for Paul McCarroll, d.b.a. Center Cafe, located at 60 North 100 West. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve a Special Events License for Ron Lindley, d.b.a. Fat Tire Festival to conduct a Bike Event October 17 through 21, 2001. Councilmember Peterson seconded the motion. The motion carried 5-0 aye. Councilmember Peterson moved to approve a Request by Ron Lindley for Use of a City Right-of-way Located at 100 West and 54 North to Conduct the Canyonlands Fat Tire Festival October 17 through 21, 2001. Councilmember Bailey seconded the motion. The motion carried 5-0 aye. Mayor Hancock recessed the Regular Council Meeting at 7:30 PM in order for the Environmental Protection Agency to conduct a Public Hearing regarding a petition for Sole Source Aquifer Designation. Mayor Hancock reconvened the Regular Council Meeting at 8:52 PM. Mayor Hancock opened a Public Hearing on Public Input on a Temporary Class II Beer License Application for Michelle Kelley, d.b.a. Desert Bistro Located at 92 East Center Street at 8:52 PM. No Public Comment was given. Mayor Hancock closed the Public Hearing at 8:53 PM. Councilmember Bailey moved to approve a Temporary Class II Beer License for Michelle Kelley, d.b.a. Desert Bistro Located at 92 East Center Street. Councilmember Lekarczyk seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve to a Local Consent of a Restaurant Liquor License for Michelle Kelley, d.b.a. Desert Bistro Located at 92 East Center Street. Councilmember Peterson seconded the motion. The motion carried 5-0. Councilmember Sweeten moved to approve a Request by Jon Olschewski to hold an Amplified Music Event at Old City Park on August 31, 2001. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve a Request by the Moab Citizens Alliance to hold an Amplified Music Event at Old City Park on September 2, 2001. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. Councilmember Bailey moved to approve a Proposed City Right-of-way Vacation near the intersection of Pack Creek Drive and Wagner Avenue. Councilmember Sweeten seconded the motion. The motion failed 0-5 nay. REQUEST FOR A PERMANENT CLASS III BEER LICENSE FOR HOWARD KENT, D.B.A. MOAB CHEVRON, APPROVED PERMANENT CLASS II BEER LICENSE FOR PAUL MCCARROLL, D.B.A. CENTER CAFE, APPROVED SPECIAL EVENTS LICENSE FOR RON LINDLEY, D.B.A. FAT TIRE FESTIVAL TO CONDUCT A BIKE EVENT OCTOBER 17 THROUGH 21, 2001, APPROVED REQUEST BY RON LINDLEY FOR USE OF A CITY RIGHT-OF- WAY LOCATED AT 100 WEST AND 54 NORTH, APPROVED MEETING RECESSED MEETING RECONVENED PUBLIC HEARING OPENED PUBLIC HEARING CLOSED TEMPORARY CLASS II BEER LICENSE FOR MICHELLE KELLEY, D.B.A. DESERT BISTRO, APPROVED LOCAL CONSENT OF A RESTAURANT LIQUOR LICENSE FOR MICHELLE KELLEY, D.B.A. DESERT BISTRO, APPROVED REQUEST BY JON OLSCHEWSKI TO HOLD AN AMPLIFIED MUSIC EVENT AT OLD CITY PARK ON AUGUST 31, 2001, APPROVED REQUEST BY THE MOAB CITIZENS ALLIANCE TO HOLD AN AMPLIFIED MUSIC EVENT AT OLD CITY PARK ON SEPTEMBER 2, 2001, APPROVED PROPOSED CITY RIGHT-OF- WAY VACATION NEAR THE INTERSECTION OF PACK CREEK DRIVE AND WAGNER AVENUE, FAILED Under Reading of Correspondence, Mayor Hancock read a letter from Myke Hughes expressing appreciation for Moab's law enforcement. Councilmember Sweeten thanked the Recreation Department for their help with soccer. Councilmember Lekarczyk stated that he had been speaking to citizens interested in covering the City Pool and that they would be researching possible Recreation District funding. Under Administrative Reports, City Manager Metzler distributed a written report. Under Mayor and Council Reports, Mayor Hancock stated that the acoustics at the Moab Arts and Recreation Center needed improvement and that she had attended a meeting there with the Utah Department of Transportation (UDOT). Councilmember Sweeten stated that he had attended the same meeting and that he found it very interesting. Councilmember Bailey stated that there would be a meeting with the North End landowners and the Agency at the Civic Center on August 15, 2001 at 7:00 PM. Councilmember Sweeten moved to pay the bills against the City of Moab in the amount of $329,381.37. Councilmember Peterson seconded the motion. The motion carried 5-0 aye by a roll -call -vote.
