The regular meeting of the City Council was called to order by 2. Mayor Merritt at 7:30 P. M. Rev. Kenneth Dunkelberser of the Temple City Baptist Church gave the invocation, followed by the 3. Mayor leading the Pledge of Allegiance to the Flag. 4. APPROVAL OF MINUTES: Regular minutes of January 25, 1965. City Manager'.'oollett made the following corrections to the min- utes: 1- Item 20 line 4 typographical error "working" should rea: "wording ", pace 5 - 4th item second line eliminate word "County' and substitute "City Engineer ", Item 13 -line 17 the Following should be added, "Councilman Nunamaker moved to approve the pro- posal as recommended by the City Manager and instruct the staff to have the assessment engineer design Parking Lots 1, 3 and 4 in conformance with this proposal." COMMUNICATIONS: None 18, TIME FOR THOSE-IN THE AUDIENCE WHO `;J/ I SH TO SPEAK: No one came forward at this time. 19. MATTERS FROM CITY OFFICIALS: Councilman Nunamaker recommended a letter of appreciation be sent . to the Coordinating Council for work done on the beautification of Temple City on the recent installation of 21 trees. Councilman Nunamaker commented on the charitable solicitation per mit recently granted for a shoe sale and felt we should have more information before granting permits. The City Manager advised the primary responsibility lies with the organization bringing in the sale and if conducted for 15% this is their decision and it is not now possible for the Council to say whether too low or too high. He advised the Sheriff's Bunco detail is working on this now. The private organization had a responsibility about who they were going to secure the shoes from. City Managerrrloollett advised regarding the contract for Temple City Park Additions being returned by Brentwood Landscape Co. unsigned. It was decided to hold an executive council session following adjournment of this meeting to discuss this situation. The City Attorney advised that this has become a legal matter which may involve a law suit and should be discussed in private. City Manager !',loollett presented a request from the Temple City High School Ski Club to hold a car wash on Febr. 13, 1965, at Ray's Standard Station, 9237 Las Tunas Dr. Councilman Harker moved to approve, Councilman Dickason seconded, and carried. City Manager Woollett presented a letter from the City Engineer requesting the Council to approve the work and accept for public use the sanitary sewer offered for dedication by Harry Oedekerk on Workman Ave. Councilman Tyrell so moved, Councilman Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford presented Resolution No. 65 -441, urging the Board of Supervisors to lease the El Monte Airport and to instigate a study with the idea of retaining the El Monte Airport as a general aviation facility. He explained in detail the rea- son for this Resolution, and read it in full to the Council. Councilman Dickason moved to adopt Resolution No. 65 -441, Council. man Harker seconded, roll call vote to carry as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None City Attorney Shatford read title to Resolution No. 65 -440 RESO- LUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AFFIRMING SUPPORT OF THE SISTER CITY ORGANIZATION AND DELINEATING CITY'S PARTICIPATION THEREIN. Councilman Nunamaker moved to adopt, Coun- cilman Dickason seconded. There followed considerable discussion and Councilman Dickason moved to send this Resolution back to the Committee for a re -work, Councilman Tyrell seconded, roll call vote to carry, as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 20. ADJOURNMENT: Councilman Dickason moved to adjourn the regular meeting of the City Council until Febr, 22 1965, at 7 :30 P. Mayor Merritt asked if anyone in the audience wished to speak fc or against this installation and no one came forward to speak. APPOINTMENT OF PLANNING COMMISSIONER: The City Manager advised as of the lath of this month there will be a vacancy on the Planning Commission created by Norman Erick- son moving out of the City, and he recommended the Council ap- point to a term of Planning Commissioner beginning when Mr. Eri terminates, Mr. Robert Garvin. Councilman Tyrell moved to approve the recommendqtion of the City Manager, Councilman Nuna- maker seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None Mr. Garvin was in the audience and expressed his appreciation for the appointment stating he would look forward to serving in this capacity. . PRESENTATION OF TENNIS TEAM AND T :10PHY: Mr. Tom 'Lan, Golden ',Jest Ave., and volunteer recreation Dept. tennis coach, presented members of the Tennis team who had won second place in the league of 14 yrs. and under in the San Gabri. el Valley Athletic Assn. and also presented the trophy they had won to the City. Mayor Merritt accepted on behalf of the City and congratulated the team as well as Mr. Quan for his fine work. 10. RESOLUTION N'). 65 -430: City Attorney Shatford read title to Resolution No. 65 -/.33 RESOL' T I ON OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, DETERMINING THAT A PORTION OF THE CDSTS AND EXPEN.ES OF THE PRO- POSED AC(-_U I S I T I UN AND IMPROVEMENT FOR A VEHICLE P. :RKI NG DISTRICT SHALL BE PAID BY THE SAID CITY (Vehicle Parkins District No. 4) City Manager . 'oollett read in full paragraph 4 as follows,: "WHEREAS, the Planning Commission of this city by its Resolution No. 64- ;°PC adopted July 6, 19!;, required as a condition of granting a zoning variance upon property owned by :\merican Sav- ings and Loan Association and located, at 9647 E. Las Tunas Dr., Temple City, California, that if a vehicle parkin: district were thereafter formed which included said propery, said Savings & Loan Assn. should pay upon such format:on a sum of money equal to five times the cost'of each individual parking space as determin- ed by the city's eng;neer, but not to exceed $10,O:.;O, said sum to be paid to the City to defray a portion of the cost and ex- pense pense or the al-oresalid vehicle parkind district "0 He explained 704 Council Minutes, February 8, 1965, page 3 the money paid by American Savings & Loan Assn. to the City should be $10,000. as they agreed to pay for 5 stalls or not more than $10,000. and the estimated cost per stall is in excess of $2,000. so the City should receive $10,000. This resolution allocates the money they pay to the City to go back to the Park- ing District. Councilman Nunamaker moved to adopt Resolution No. 65 -438, Councilman Dickason seconded, carried by the follow- ing called vote: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None II12. RESOLUTION NO. 65 -439: City Attorney Shatford read title to Resolution No. 65- 439.RESOL- UTION OF THE. CITY COUNCIL OF THE CITY OF TEMPLE CITY, CALIFORNIA, ORDERING A REPORT UNDER THE SPECIAL ASSESSMENT, INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 (Vehicle Parking District No 4). The City Manager explained this is to re -do a previous Resolution which is required because of necessity of foregoing Resolution No. 65 -438, and which rescinds Resolution No. 64 -418. Counciiman Nunamaker moved to adopt Resolution No.. 65 -439, Councilman Dickason seconded, carried by roll call vote as follows: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen-None AGREEMENT BETWEEN THIS CITY AND CITY OF ROSEMEAD FOR SERVICES OF PLANNING D.iRECTOR City Manager'Aloollett explained this Agreement would cover the services rendered by the Planning Director, 75% of which is allocated to Temple City and 25% to Rosemead. He explained the Agreement in detail to the Councilmen and advised Rosemead has . executed this Agreement. Councilman Harker moved to approve the Agreement between the City of Rosemead and City of Temple City pertaining to the services of a Planning Director and to instruct the Mayor and City Clerk to sign on behalf of the City, Councilman Nunamaker seconded, carried by the following called vote: AYES: Councilmen - Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Counciimen -None ABSENT: Councilmen -None 14. REQUEST PERMISSION TO CIRCULATE PETITIONS PREPARED BY CITY ENG ft EER: Sewers on Green St. The City Manager advised the citizens requested a petition be prepared to be circulated for installation of sewers on Green Si- which is a private street. Some sewers have been installed on this street where subdivisions have gone in. The request is for Council authorization to circulate the Petition & Waiver of Debt Limit which petition the Council will consider if returned by April 1, 1965, signed by owners of 60% of the assessable area in the proposed district. Councilman Dickason moved to authorize the request as recommended, Councilman Tyrell seconded, roll cal vote to carry as follows: AYES: Councilmen- Dickason, Harker, Nunamaker, Tyrell, Merritt NOES: Councilmen -None ABSENT: Councilmen -None 15. REAPPORTIONMENT OF STATE SENATE: Councilman Harker presented a letter concerning Senatereappor- tionment followed by considerable discussion. There is a meeting in Alhambra on Monday evening, Febr. 15, which Mayor Merritt will attend and report back to the Councilmen. The Council in con - sidering this matter further will have available Supervisor Bonelli's recommendation also. Councilman Harker moved to re- ceive and file the letter, seconded by Councilman Tyrell and carried. 16. RESOLUTION NO. 65 -437: Warrants & Demands Councilman Tyrell moved to adopt Resolution No. 65 -437, Warrants and Demands in the sum of $38,04.6.68, Nos-. 606 4 through 6171, Councilman Harker seconded and carried by the following roll cal'. vote: 705
