Box 429 • Hillsborough, North Carolina 27278 919-732-2104 0 Fax: 919-644-2390 MINUTES PLANNING BOARD April 4, 1995 PRESENT: Wendy Olson (chair), Richard Bradford, Louise Long, George Sagar, Pat Shannon, Jim Speed, John Taylor, Earl Thomas, Doreen Tuell, Quanda Turner PUBLIC: Jack Smyre, Margaret Hauth Olson called the meeting to order at 6:32 pm. ITEM #2: Olson provided an update from Occoneechee Park Committee. Hauth described recent activities of Transportation Task Force and Board of Adjustment. Olson introduced Sagar, newly appointed in town member and asked the members to introduce themselves around the table. ITEM #3: Hauth opened the floor for nominations for the positions of Chair and Vice -chair. She noted that Olson and Taylor were currently holding those positions. Turner nominated Olson to remain as chair. Speed moved and Taylor seconded to close the nominations. Unanimous. Olson nominated Taylor to remain as vice -chair. Speed moved and Thomas seconded to close the nominations. Unanimous. ITEM #4: Olson asked to be excused from the vote on the Old Mill Final Plat since she has done some design work for the applicant. Everyone agreed. Hauth noted that the Plat encompasses only phase la, those lots facing on the main road. She added that the applicant has provided documents for a business owners association and escrow agreements to guarantee the construction of the road and water line. MOTION: Taylor moved to approve the Final Plat as shown. Speed seconded. VOTE: Unanimous. ITEM #5: Hauth introduced Smyre, the representative of a property owner who is impacted by a 1988 amendment to the ordinance limiting building heights within 1250 feet of interstate rights-of-way. Smyre gave some background on why the limit was added to the Hillsborough ordinance, what the Triangle J Council of Governments had recommended, and what other jurisdictions in the region are requiring. Smyre noted that Hillsborough's ordinance is the only one without some provision to exceed the height limit in cases were the property is at a higher elevation than the roadway. He asked the members to consider sponsoring a text amendment to either remove the height restriction or provide a setback ratio by which additional height could be built in return for additional setback from the right-of-way. The members discussed the request. Speed asked Hauth her opinion. Hauth said that the most permissive height limit in the ordinance is 65 feet. She added that the required buffer along the right-of-way combined with the additional elevation of the site in question makes the elimination of the requirement reasonable. She added that few sites exist that are higher than the road right- of-way and those that are not would not be affected by the removal of the restriction. The members agreed that some type of amendment is desirable. MOTION: Taylor moved to send the deletion of the overlay height restriction to public hearing. Speed seconded. 4/4/95, page 2 VOTE: Unanimous. ITEM #6: Hauth described the most recent changes to the Temporary Use Permit amendment. Tuell asked if lighting requirements are included in what the temporary use must meet. Hauth said it was not specifically listed, but could be added. Tuell asked how the limitations in the ordinance are worded. Hauth said there are minimum limits set and vague language that allows staff to determine how much light is too much. Tuell asked if the lighting limits could be studied by the Board. She added that she is aware of situations where not enough protection is being given to residential properties. Olson suggested the item be discussed in May. Shannon suggested alternate wording for circus requirements to confer with animal control personnel MOTION: Tuell moved to send the amended text to public hearing. Speed seconded. VOTE: Unanimous. ITEM #7: Hauth described the Construction Permit text. Tuell asked if this includes timbering. Olson said timbering is a by -right use anywhere, similar to farming. Tuell asked if there was a way to add a timbering dis-incentive. The members could not think of one. Hauth said the intent of the text is to give the planning and engineering departments an intermediate set after general approval of a project, but before construction permits are approved to review and approve public improvements. She gave the example of major subdivisions where it is costly to design water and sewer lines before preliminary approval is given, but the lines must be approved before construction begins. MOTION: Taylor moved to send the text to public hearing. Tuell seconded. VOTE: Unanimous. ITEM #8: Hauth described the changes to the Planned Unit Development text. She added that since this general topic has been to hearing numerous times in the last year, Town Board voted to send this to hearing. ITEM #9: Hauth described the one change she is proposing to the design manual, relating to landscaping ratios. She noted that there are numerous sites within the town's portion of the district that are not heavily forested, as the county sites are. The members discussed the change briefly. Lighting and buffers were discussed. Hauth said that if changes are made to the town's ordinance, the design manual can be amended to reflect them. Olson suggested that the topic of stream buffers be added to an agenda soon. She said that a set width is not always the most desirable. Hauth said she proposed the entire district as primary 1 because there are not existing residential uses directly adjacent to the town's portion of the district. She added that perimeter buffers are based on adjacent zoning and subject to change. She also added that the areas in the town's jurisdiction are more easily developed and not as encumbered with steep slopes and other unique features as the county's portion of the district. The members agreed that since the guidelines and map could be amended in the future, the existing format is sufficient to send to hearing now. F9.9 4/4/95, page 3 MOTION: Turner moved to send the Economic Development District text and map to public hearing. Tuell seconded. VOTE: Unanimous. ITEM #10: Hauth described the Town Board's directive to create a new zoning district or amend an existing one to allow convenience uses adjacent to residential districts. Olson asked what was meant by "convenience uses." Hauth said she was unsure. She added that she would prepare more details for the May meeting. Olson adjourned the meeting at 8:35 pm.
