HomeMy Public PortalAboutMIN-CC-2001-09-25MOAB CITY COUNCIL REGULAR MEETING September 25, 2001 The Moab City Council held their Regular Meeting on the above date in the Council Chambers of Moab City Offices, located at 115 West 200 South, Moab, Utah. Mayor Karla Hancock called the Pre -Council Workshop to order at 6:30 PM. Mayor Pro-Tem Kyle Bailey called the Regular City Council Meeting to order at 7:00 PM; Mayor Pro-Tem Bailey led in the Pledge of Allegiance. Also in attendance were Councilmembers Joseph Lekarczyk, Kirstin Peterson, Rob Sweeten and Gregg W. Stucki; City Recorder/Assistant City Manager Rachel Ellison, Public Works Director Brent Williams, Planning and Community Development Director David Olsen, Recreation Coordinator Marcy Clokey-Till, City Attorney Chris McAnany and City Planner Robert Hugie. Twenty-five (25) members of the audience and media were present. There were no minutes to approve. Under Citizens to be Heard, Becky Stengel read a letter requesting that the City Council reconsider closing the Swim Center on October 1, 2001 and distributed a petition in support of the letter. Sue Phillips stated that she represented a group that was willing to help to keep the Swim Center open. Recreation Coordinator Clokey-Till explained that the solar panels would help reduce the costs of utilities; however, other costs associated with keeping the Swim Center open for an additional month were not budgeted for, including the cost of chemicals and staff time. Howard Trenholme commended the City on the efficiency of the newly installed solar panels which were made possible by a large contribution from the community. Mr. Trenholme stated that the Swim Center was a vital asset to the community and stated that the lap swimmers would be willing to forego hot showers and heated locker rooms to extend the season through the end of October. The City Council reached a consensus that the Swim Center would remain open an additional two weeks on reduced utilities including no hot showers or heat in the locker rooms to test the efficiency of the solar panels. Under Planning Update, City Planner Hugie distributed a written report. Under Public Works Department Update, Public Works Director Williams stated that the 500 West Underbridge was finished. Public Works Director Williams also stated that the process would begin next month to relocate utilities on 500 West and that the street should be started by next spring. Mayor Pro-Tem Bailey opened a Public Hearing on Proposed Ordinance #2001-10 — an Ordinance Establishing Drinking Water Source Protection Zones Surrounding all City Wells and Springs at 7:32 PM. No public comment was made. Mayor Pro-Tem Bailey closed the public hearing at 7:32 PM and opened a public hearing on Proposed Ordinance #2001-11 — an Ordinance Amending Section 17.06.020 (5), of Chapter 17.06, Title 17, of the REGULAR MEETING & ATTENDANCE APPROVAL OF MINUTES CITIZENS TO BE HEARD PLANNING UPDATE PUBLIC WORKS UPDATE PUBLIC HEARING OPENED PROP ORD #2001-10 PUBLIC HEARING OPENED PROP ORD #2001-11 Moab Municipal Code Regarding the Definition of a Carport at 7:33 PM. Jolene Welch stated that she would like to see the definition to be within two feet of the property line and open on three sides. Reva Webber inquired how tall the fire wall needs to be. Councilmember Peterson stated that the wall was part of the structure and could be a maximum of twelve feet. Tom Shellenberger stated that he would like to see the definition to be within three feet of the property line. Mayor Pro-Tem Bailey closed the public hearing at 7:43 PM and opened a public hearing on Proposed Ordinance #2001-12 — an Ordinance Amending the City of Moab Official Zoning Map (Rezone Request from R-2 to C-1 for Lots 9 — 13 of the Utex Subdivision) at 7:43 PM. City Planner Hugie presented the proposed zoning map. June Davis stated that she lives on MiVida and that the lots to be rezoned were suitable for businesses but not for residences and that it posed a potential flooding problem. Bill Birsfield (property owner) stated that the intent of the rezone request was to develop and straighten out the drainage and flooding problems. Jack Winn stated that he was the owner of lot 11 and that he would hate to see a business go in and to see the property changed. Mr. Winn stated that he was against the rezone for lot 11. Rick York stated that he lives adjacent to the rezone and was concerned about flooding potential and that if development was not done properly it would divert water to the houses below the development. Mr. York read a section from the Moab Draft General Plan regarding rezoning requests. Mr. York stated that his concern was the impact on the residences behind the rezoned lot. Councilmember Sweeten inquired if commercial drainage standards would have to be met. City Planner Hugie stated that a commercial site review would be done. Janine Torres stated that she lives behind Randy Day's development and hadn't been flooded until this year. Ms. Torres stated that she is against the rezone because no one will take responsibility for the flooding. Robert Doherty stated that he lives on MiVida and that when other lots were zoned C-3 it aggravated the flooding problem. Rick Lamb stated that he is a part owner of the property requesting the rezone and that he didn't think that commercial development would exacerbate the problem, that it would be a potential for more city control and mitigation. Mr. Lamb stated that he thought the original residential zoning was a mistake and it was not fair to deny the zone change based on drainage. Bebe Doherty stated that she lives on North MiVida and that water sits on the property of the proposed zone change. Ms. Doherty stated that PUBLIC HEARING OPENED PROP ORD #2001-12 Randy Day's development made the drainage problem worse and that she was shy of development. Janine Torres stated that the earth beneath Mr. Day's development must be resettling because trucks on the highway rattle her house and they didn't before the development went in. Mayor Pro-Tem Bailey closed the public hearing at 8:06 PM. Councilmember Peterson moved to approve Proposed Resolution #20- 2001 — A Resolution Approving an Agreement with the Bureau of Land Management (BLM) to Install a National Oceanic and Atmospheric Administration (NOAA) Weather Station on Bald Mesa contingent on the City's participation being funded by grant monies. Councilmember Stucki seconded the motion. Councilmember Sweeten stated that he was employed by the BLM. The motion carried 5-0 aye by a roll -call -vote. There was no Correspondence to be read. Under Administrative Reports, City Recorder/Assistant City Manager Ellison distributed City Manager Metzler's written report. City Recorder/Assistant City Manager Ellison stated that the Primary Municipal Election would be held on October 2, 2001 and that the Election Canvas would need to be held later that week. Under Mayor and Council Reports, Councilmember Sweeten stated that he would be in Washington D.C. during the month of October. Councilmember Lekarczyk stated that a resident of Locust Lane had spoken to him regarding the speeding problem and that another dog had been killed the previous weekend. Councilmember Sweeten stated that loose dogs and cats were also a problem in that area and that the Police Department had increased their enforcement efforts in that neighborhood. Councilmember Sweeten moved to pay the bills against the City of Moab in the amount of $209,963.22. Councilmember Stucki seconded the motion. The motion carried 5-0 aye by a roll -call -vote. Councilmember Stucki moved to enter an Executive Session for a to Discuss Pending or Reasonably Imminent Litigation and a Strategy Session to Discuss the Purchase, Exchange or Lease of Real Property. Councilmember Sweeten seconded the motion. The motion carried 5-0 aye. An Executive Session was entered at 8:40 PM. Councilmember Lekarczyk moved to close the Executive Session. Councilmember Stucki seconded the motion. The motion carried 5-0 aye. The Executive Session was closed at 9:16 PM. Mayor Pro-Tem Bailey adjourned the Regular Council Meeting at 9:16 PM.
