ac). Action requested: make recommendation to Town Board (attachment).
ITEM #4: Further discussion and recommendations regarding amendment to historic house
Conditional Use Permit (attachment).
ITEM #5: Continue work on new commercial district (attachment).
ITEM #6: Review of draft text amendment to separate different types of parks and allow
them in different zoning districts. Action requested: vote to send to public
hearing (attachment).
ITEM #7: Review of draft text amendments to fill gaps in Section 8. Action requested: vote
to send to public hearing (attachment).

PLANNING BOARD
June 27, 1995
PRESENT: Wendy Olson (chair), John Taylor (vice -chair), Richard Bradford, Louise Long, Chris Quinn,
George Sagar, Jim Speed, Doreen Tuell
PUBLIC: Jack Snipes and members of the Winecoff family, J.C. Edwards, Susan Waldrop, Delmar and
Dale Brown, Margaret Hauth
Olson called the meeting to order at 6:30 pm.
ITEM #2: Olson passed around flyers announcing that one day of the Festival for the Eno would be held
in Hillsborough on the River and Occoneechee Mountain. Speed reported on Board of
Adjustment activities, including site plan approval for Holiday Inn Express, Conditional use
permit approval for Piedmont's substation, and continued two other items. Hauth noted that
the Town Board has rescheduled the transportation plan public hearing to Tuesday, September
26 at 7:30 pm.
ITEM #3: Edwards presented the revised subdivision plans for Governor's Downs. He said the lots now
number 106. He noted the changes in the street pattern as discussed at the May meeting as
well as greenspace connections between culs-de-sac. He described the proposed phase line
and the area to be offered for recreation. The members discussed the plans briefly. Hauth
noted that the stormwater review and NCDOT comments are not complete, but should be
before the Town Board meets. She added that NCDOT is reviewing interior streets in the
event the town chooses not the annex the project.
MOTION: Taylor moved to recommend approval of the subdivision, Speed seconded.
VOTE: Unanimous.
ITEM #4: Hauth introduced further discussion on the historic house CUP text amendment. She noted
that since the board's earlier recommendation was split, the Town Board was struggling with
a decision. She noted that they asked for a fuller discussion of options and the pros and cons
of each option. Snipes asked for permission to speak. He reiterated many points in the letter
sent to board members (in property file). He also presented a representation of the properties
eligible for this CUP. He noted how those held by himself and members of the Winecoff
family are different because they are somewhat surrounded by non-residential uses. Taylor
noted section "g" of the text which allows the Board of Adjustment to place reasonable
conditions on approvals. He asked the members if that was not sufficient to guarantee
protection to the neighbors. Hauth noted that section g could not be used to enforce an
unwritten limitation on uses, unless such uses are shown to be detrimental to the neighbors.
The members indicated they understood the limitations of section g.
MOTION: Taylor moved to recommend deletion of section f. Tuell seconded.
VOTE: 7-1, Speed opposed.
ITEM #5: Hauth introduced continued work on a new commercial district. She noted the research into
the existing uses, both conforming and not, in the General Commercial district. She also
discussed her proposal to revise some use definitions related to auto work. Dale Brown asked
to speak to the definitions. He asked Hauth to clarify the impacts of being a conditional use

as opposed to a by -right use. She said that any existing use that becomes a conditional use
may continue to operate with no time limits on being closed, the new restrictions and
requirement to have a CUP is only triggered if the use wants to expand. He said that being
a conditional use is generally acceptable to his family. He asked for some modifications to
the text to completely encompass the work in the repair shop to include transmission work
and limited body work. The members expressed general agreement with the proposed
changes. They asked Hauth for revised language and for her to contact other owners of non-
conforming properties for the next meeting.
ITEM #6: Hauth introduced the text amendment to establish different types of parks and allow them in
different districts. She noted there were no changes from last time and asked if the board
was willing to sponsor them to a public hearing.
MOTION: Speed moved to send the park text amendments to public hearing. Taylor seconded.
VOTE; Unanimous.
ITEM #7: Hauth introduced 3 text amendments to fill gaps in Section 8 of the Zoning Ordinance. She
noted that during the commercial re -write references to HIC were not made to Section 8. She
also added that a gap was left in the multi -tenant sign limitations. She asked the board to
send these amendments to public hearing.
MOTION: Taylor moved to send the sign text amendments to public hearing. Speed seconded.
VOTE: Unanimous.
Olson adjourned the meeting at 8:10 pm.
