ITEM #2: Receive report from Ruth Little regarding inventory of National Register Historic District and the Bellevue Mill Village (7:00 - 7:30) ITEM #3: Rezoning Request (approx. 7:35) a) Sandra & James Combs to rezone .15 ac at 770 Cornelius St from R-10 to GC (TM 4.12.A.4). b) Flint Ridge apartments to rezone 1.275 ac behind 223 Oakdale Dr from R- 10 to MF. The .86 ac which has access to Oakdale Drive will remain R- 10, the area to be rezoned will only be accessed from within the complex (TM 4.44.A.11). c) William Whiffed to rezone 2.59 ac on the east side on NC 57 from R-40 to R-20 (TM 4.6.A.15). ITEM #4: Zoning Ordinance Text Amendments (approx. 8:00) a) Amend Section 3.5 and 25 to create 5 levels of park uses and define those uses. b) Amend Section 8.11 and 8.12 to include references to HIC district. Box 429 • Hillsborough, North Carolina 27278 919-732-2104 • Fax: 919-644-2390 MINUTES JOINT PUBLIC HEARING July 25, 1995 PRESENT: Mayor Horace Johnson, Allen Lloyd, Evelyn Lloyd, Catherine Martin, Richard Simpson, Remus Smith, Wendy Olson (PB chair), Richard Bradford, Ed Gill, Louise Long, George Sagar, Pat Shannon, Jim Speed, Earl Thomas, Doreen Tuell PUBLIC: Ruth Little, Michelle Michael, Bill Crowther, Cathleen Turner, John Wright, Cathie Falconer, Bev Webb, Barbara Church, James Combs, William Whitted, Perry & Janice Reaves, Margaret Hauth ITEM #1: Mayor Johnson called the meeting to order and passed the gavel to Planning Board Chair Olson. She explained the basic hearing process. ITEM #2: Hauth introduced Little and Michael, the consultants who compiled the historic district inventory. Little described the information collected on each property. She also made the following recommendations: the town could consider reducing the local district boundaries to remove 10 blocks in the northwest section of town which were developed later and to place the Bellevue Mill Village on the National Register study list. She spoke in detail about both recommendations. She also noted that an African American history should be compiled as well as an architectural survey of the remainder of town and a more in-depth local history since 1850 be written. ITEM #3a: Hauth introduced the Combs rezoning request. She noted where the lot is on the map. Simpson asked why a lot with a commercial building on it was not already zoned commercial. Hauth said that it was probably missed were zoning was established in the area. She and other board members noted other examples that have been considered over the years. Combs spoke, noting that the previous store had been open for 40 or more years and it was their intention to reopen it. Hauth added that she had received no comments from neighbors. ITEM #3b: Hauth introduced the Flint Ridge rezoning request. She noted that area on the map and indicated that the entire lot was not requesting rezoning at this time. She added that a representative was present and that she had received neighbor comments that she would read later. Falconer spoke on behalf of the applicant. She noted their intent to demolish the existing maintenance building and build storage units, garages, and a new maintenance building on the additional land. P. Reaves spoke in opposition. He noted that this request is just another change to a neighborhood which started out as large lot development. J. Reaves spoke in opposition. She reiterated her husband's concerns and noted that they have had difficulty with Flint Ridge residents trespassing on their property. She added that the existing building had been built without a permit 5' from the property line. She said that at a meeting with the town, the owners had promised to build a fence if the neighbors would allow the fence to stay. The fence has not been built. Hauth read a letter submitted by Donna Dyer, the executive Director of Orange Community Housing Corporation, the owners of Magnolia Place. She also read the names of the owners who had submitted a complete protest petition against the rezoning and other neighbors who had signed in opposition. She reminded the boards that a protest petition requires the Town Board to approve the rezoning by a 3/4 majority, if they choose to approve it. JPH 7/25/95, page 2 ITEM #3c: Hauth introduced the Whitted rezoning request. She noted the location of the property on the map. E. Lloyd asked what could be placed on the land. Hauth said as many as five lots could be created with either access to NC 57 or a new road. She added that the ordinance does not require a new road be built if a lot has sufficient frontage. Whitted spoke in favor of his application. He said that he wanted to sell off a lot north of his lot and to do that, rezoning was required. He said the stream made the northern lot too small for current zoning. Hauth noted the stream was not perennial and would not require buffers. ITEM #4a: Hauth introduced text amendments to sections 3.5 and 25 to more narrowly define different park uses and allow them in different districts. She noted that these will increase the flexibility to locate parks in different areas. She said that the ordinance currently requires a conditional use permit for all parks, whether a small neighborhood park or an athletic park. Simpson asked if this was establishing requirements for park areas within developments. Hauth said the minimum sizes and so forth are determined by other sections and the intent of this text is to facilitate the location of parks throughout previously developed areas of town. The minimum and maximum lot sizes were discussed briefly. Crowther spoke in favor of the amendments, noting that the changes were in line with the park plan recommendations. ITEM #4b: Hauth introduced text amendments to section 8.1 Lc and 8.12.d. She noted that the only change is to include "HIC" in each of the listings of districts. She added that this change was not included in the HIC text changes earlier discussed. ITEM #4c: Hauth introduced the addition to section 8.18 establishing a sign size limit for multi -tenant development with between 30,001 and 74,999 square feet of space. She noted that this standard was not included in the amendments accommodating multi -tenant developments earlier. ITEM #5: Olson closed the public hearing and returned the gavel to Mayor Johnson. He announced some vacancies on the Triangle Regional Council and on a study group for the Neuse River Basin. He asked members to consider names for appointment.
